China’s Defiance of International Court Has Precedent—U.S. Defiance

Every court's power is derived from the threat of force. You really think you would give two shits about what your local judge decides if there is no one to enforce his decisions? A court or tribunal that has no power to enforce its rulings is nothing more than a clown show.

Allow me to debunk your fantasy delusions.

One can say the same about China : PRC is hung on to territories curved up by their Qing overlords that they could not historically relate to (That is the past)
Qing is a Chinese dynasty, All Manchus are Chinese. What happened between different racial groups in the Chinese history is our home affairs. Are British Indians? India has 6 bordering neighbors 3 of which have border issues with you, That accounts for 50% disputes with the total number. China borders 14 countries and India is the only one we are having land trouble with, see the percentage here?

, P5 aint powerfull enuf to do that.

How?

For India this is golden opportunity to put pressure on China on a broad range of issues.

PCA rulling is seen by many players as golden chance to put pressure on China.Japan in ECS. India-US-Japan in SCS.

The question is: will India be able to profit from it in any tangible manner?

Now that they have, in their Indian perspective, an NSG score to settle with China.
Remember... Modi is working towards his next election. So, 'standing up' to China is good for him and his party.

Will China budge or back down from the combined efforts of India-US-Japan axis? Is India underestimating China's national resolve? Does India or Japan have the power to push China without US support?

Hopefully, a peaceful solution can be found. The players are asking China to give up her sovereign territories. Can China afford this? Remember... if China gives in here she has to give in on many many fronts.

Peace is better than conflict.

As I advised in anothar thread, China should tread very carefully. Either Vietnam or india will provoke China and the US is getting ready to strike at China's weak point, the Chinese navy. For China if she thinks she cannot afford to give up her claims at South China Sea, it will be better to choose the battle ground where China is strong. It must not get into a sea battle against the US navy at this point of time. The Chinese navy needs at least ten more years to be able to successfully face the US navy.

Dear T-rex, your view of the situation is quite correct. The USN is only masters of the seas in the world. The Chinese respect this fact. Hence their planning and posture.

The push against Russia and China is part of great power politics. Direct confrontation between the three great powers will doom the world. Hence the proxies, as you clearly elaborated.

Hopefully, a peaceful solution can be found. Vietnam is not a threat to China. The entire ASEAN is not a threat.

India and her political class is a threat to China. Because of their superpower ambitions... they might be tempted to take on China...

But let us hope peace pervails in this world. The conflict and destruction has lasted for centuries now.

What a stupid article comparing SCS case, Nicaragua case!

SCS is a part of Chinese territory. Nicaragua case is America meddling other small nation affair.

We can add the case, America ignored UN decision and start the war against Iraq. Produced region there a hell so far for 13 years.

:blah:

Looks like India had never been offered the seat. The Indian version of history is probably for a national feel-good pastime.

I was very surprised when I heard he claim that India actually declined an offer for permanent seat? Crazy!

That is funny. It's like a normal guy decling oral sex from a hot chick. You know he's lying

It's a tough case for China to make. The U.S. was not and is not a signatory of UNCLOS so the special provisions that UNCLOS requires regarding conflict resolution in court that apply to China didn't apply to the U.S.

When China signed the UNCLOS, it already explicitly stated it would not accept any arbitration and that UNCLOS does not retroactively cover historical waters. The stance is consistent.

Wow it's like signing a contract so it would not be followed only the chinese can sell that type of bull

Those were letters attached after signing. These statements do not modify the terms of the treaty and thus have no international legal merit. Indeed, I think they have served to hamper China's diplomats in performing their functions because (it seems to me) the letters made assuming certain negotiating stances or positions illegal under domestic Chinese law.

Any international treaty cannot override Chinese constitution, of which Chinese land and sea borders are specified (9 dash line included). The so called tribunal's decision has about as much merit to the Chinese as a sheet of toilet paper. If Philippines is pinning its hopes on that toothless kangaroo court giving them magical control back, then it's in for a rude awakening.

Wow, you must be pretty stupid. You never heard of exception clauses when signing contracts.

In fact, same clauses both VN and PH inserted in the UNCLOS.

These two countries do not hold any moral standing. Only thing they think they have is to be on the right side of geopolitical equation. They have pinned their entire hope on the US support.

China needs to make sure that they will have a rude awakening. Like Machiavelli said, punish once, but punish so harshly that the enemy would not be able to recover and seek revenge.
