CAA and Ghar Wapsi

Believe me no proof would be required. Many of them do not have any documentation.

You may be confusing CAA with the proposed nation wide NRC.

Nation wide NRC will never take off.
You are just assuming things and making excuses.
Good luck and be happy with your RSS Modi love. non of your excuses making any sense.

I am not making any assumptions.

There are already more 10 big state CMs who have declared that they would not entertain NRC in their state.

Forget of about the proposed NRC, many states CMs are not even allowing NPR to start with.

You are just assuming that PM Modi is all powerful.

In India, many policies require active cooperation of the state governments which are not controlled by BJP.

I am talking about your claims, that under CAA no Documentation/proof whatsoever required to prove your religion. You are claiming that anyone can wake up and tell GoI "I am Hindu/Christian etc and get citizenship, which is very absurd and stupid to say the least. If Muslims are excluded, then all others must prove their religion as non Muslims. You have no idea what chit you are talking about and you are hell bent to defend your claims and Modi sarkar, everything is based on your personal opinion guided by Modi the terrorist love.

There is no way in hell that any legal process could be completed without any documentations, proofs etc and granting Citizenship is a serious legal process, especially when you put conditions based on religion or ethnicity.

How a dumb fack Modi sarkar can pass a law that Citizenship will granted to all illegals excluding Muslims, but no proof of religion required. how the authorities will know who is who and who is pretending something which they are not.

If CAA was not based on religion then only your fake claim could be taken under consideration. your twisted RSS mind is trying to make excuses which only RSS can bhagats could accept.

think like a normal human and all will be clear.

CAA does not require any documentation as it has been drafted in that way by design.

As I have explained earlier, it is next to impossible for the illegal immigrants to prove that they were persecuted in the countries of their origin (even if it were to be genuine )

1) In many cases, the illegal immigrants have immigrated to India for better economic opportunities.

2) Even in the case of illegal immigrants who may have been persecuted, it is next to impossible to prove. All you can get is an affidavit from the person explaining their situation. Everyone can tell a story.

The above is true for both Illegal Muslims and non-Muslims.

Hence to simplify the matters, Government of India has, by design, passed an act which requires next to nothing documentation. People would be asked for some general details like place of origin, reason for immigrating, name, religion etc which are required for citizenship documentation. All these details can be made up on the fly.

Most of these people are illiterate. So we would have facilitators helping then put their thumb prints on standard templates that would prepared en masse.

Please enlighten me/us with a quote/reference from CAA, which states, "CAA does not require any documentation as it has been drafted in that way by design."

or all are cooked up story is your personal twisted opinion. Thanks

Firstly, You have to understand the reason why this BJP led government has passed CAA.

Assam NRC which was done per the directions of the Supreme Court of India resulted in two things

1) The total number of illegal immigrants identified by Assam NRC turned out be only ~19,00,000 people. For decades BJP built a narrative that there are millions of illegal Bangladeshis living in India and BJP would throw them out of the country if it came to power. The results of NRC meant that BJP's narrative built for over 3 decades has fallen flat.

2) Over 80% of the illegals identified by Assam NRC turned out to be Hindu Bengalis. Illegal Muslims turned out to be minuscule. This meant that BJP would be seen as throwing out the Hindus instead of the Muslims.

To recover from this PR disaster, BJP led government has passed CAA in a hurry to ensure that illegal Hindus would not be put in the detention camps.

Now coming to the drafting of the law itself, CAA had to be draft in such way that it would not violate the constitution. Article 14 of the Indian constitution requires Doctrine of Reasonable Classification.

So the following steps were taken to meet this criteria

1) Limited the CAA to only countries which are neighbors of India and have an Islamic constitution

2) The exemption was provided to people who are considered as minorities. This is where BJP has to grudgingly include Christians even though Christians are not their intended beneficiaries. Making an exemption only for the Hindus would have meant that CAA would have been unconstitutional.

Mandating strict documentation under CAA would have meant that BJP was taking steps which would be looked as harassing the illegal Hindus. They could not afford another PR disaster. Hence CAA was drafted requiring absolutely no documentation. In fact it does not require people to prove that they were persecuted. This is a blessing in disguise for all the other illegal immigrants who could sneak in along with the illegal Hindus.

This is the inside story.

Again, its all your personal POV, nothing quoted which proves this wrong opinion. You are not an expert of Indian constitution and Law.
