PESHAWAR: A trader filed a writ petition at the Peshawar High Court on Tuesday challenging the blocking of Nato supply lines by members of Pakistan Tehreek-e-Insaf (PTI), the major coalition party.
The petition was filed by Haji Lal Muhammad through his lawyer Shah Nawaz Khan. Muhammad is a businessman who exports various items, including rice, to Afghanistan. He filed the petition under Article 199 of the Constitution of Pakistan.
The federation of Pakistan through the Ministry of Interior secretary, government of K-P through the chief secretary, Home and Tribal Affairs secretary, provincial police officer and PTI provincial president were made respondents.
“Members of PTI and other [parties] continue sit-ins to block supplies to Nato, for which their supporters are checking documents of loaded trucks en route to Afghanistan without lawful authority.
The unauthorised and unwarranted checking of documents and permits causes traders multiple problems, including losses because of the wastage of perishable items loaded in the trucks,” reads the petition.
It further reads that of these respondents, four are duty bound to maintain rule of law, check and control violation of law, and address problems faced by citizens. However, at present they failed to perform their duties and have multiplied the public’s hardship.
“The impugned action so taken with regard to checking of permits/documents of loaded trucks en route to Afghanistan by members/supporters of political parties is unconstitutional, illegal and without lawful authority,” it reads.
“The respondents be directed to implement the rule of law by controlling the situation and address the hardship faced by citizens, including the petitioner, and to restrain members/supporters of political parties from violating rule of law,” seeks the petition.
PTI has blocked Nato supply routes which run through K-P since November 23, along with other political parties in coalition with the provincial government.
