The Supreme Court on Tuesday came down heavily on the CBI’s SIT, probing alleged extra-judicial killings and fake encounters by the Army, Assam Rifles and police in insurgency-hit Manipur, for not registering the required number of FIRs as directed by it earlier.

The apex court directed the Special Investigation Team (SIT) to lodge 30 more FIRs on or before January 31 this year, after the SIT informed it that it has registered 12 FIRs till date.

A bench comprising justices Madan B Lokur and U U lalit directed the probe team to complete by February 28 this year, its investigation into 12 cases lodged by them and file the final reports before the concerned court.

The bench, which perused the first status report filed by the SIT, posed searching questions to it.

The bench asked as to why all the FIRs have not been registered yet despite its July 14 order last year.

It directed that all the subsequent status reports, to be filed before it by the SIT, should have the approval of the CBI director.

The bench also asked the CBI director to monitor the progress in the investigation and posted the matter for further hearing on March 12.

The apex court had earlier said it appeared that matters related to the probe into alleged fake encounters in Manipur were not being taken up seriously by the SIT.

The top court had on July 14 last year set up an SIT comprising five CBI officers and ordered registration of FIRs and probe into the alleged extra-judicial killings in Manipur.

It had asked the CBI director to nominate a team of five officers for the SIT to lodge the necessary FIRs and complete the investigation into alleged fake encounters by December 31 last year.

The apex court, which is hearing a PIL seeking probe into 1,528 alleged extra-judicial killings, had in July last year ordered registration of an FIR in 81 cases.

These cases include 32 probed by a Commission of Enquiry, 32 cases investigated by judicial enquiries and high courts, 11 cases in which compensation has been awarded by the National Human Rights Commission (NHRC) and six cases probed by a commission headed by former Supreme Court judge Justice Santosh Hegde.

Seeking its revival by targeting the disadvantaged groups, the outlawed Communist Party (Maoist) has instigated people and pitted various communities against each other in the last four months, according to an intelligence report submitted . The outfit has organised at least 23 meetings in various parts in the same period.

The report pointed out that the Maoists were responsible for stoking violence earlier in the month, in the state.

The report was given to the police five days before the violence. A senior IPS officer said Maoist sympathisers targeted mostly youth. “The group fuelled hatred between Indians to push their anti-state ideologies,” said the officer.

Under the 50th anniversary of Great Proletarian Cultural Revolution, the group released Maoist literature.

”We have to mobilise Dalits, Adivasis, religious minorities and democratic forces against Fascism and form a united front at various levels,” read a bulletin which was circulated among people.

Another document chastised well-off castes for demanding reservations in jobs and employment and blames the government for its ‘anti-farmer’ policies.

Custody of 7 suspected CPI (Maoist) members extended

The sessions court on Tuesday extended police custody till January 22 of seven people arrested by the ATS over suspicion of being members of the banned outfit Communist Party (Maoist). The ATS had on Saturday arrested Krushna . The arrest led the ATS to arrest six others. On Tuesday, the prosecution told the court the accused were planning to do “something.” However, the agency did not reveal the exact nature of the alleged conspiracy, but said they need to further probe them. The ATS also said they need to translate and decipher the literature recovered from Krushna.

Armed insurgents set fire to nine crude oil carrying tankers at Namsik area in Jagun near Assam-Arunachal Pradesh boundary at Tinsukia district of eastern Assam on Tuesday night.

The DG of Assam Police, Mukesh Sahay suspected hands of Naga rebel group NSCN-K in the incident.

Police quoting tanker drivers who stood witness to the incident, said a group of armed militants who looked like tribal waylaid the 10 tankers that were carrying oil from Kharsang oil field in Arunachal Pradesh at Namsik in Jagun and forced the drivers and helpers of the vehicles out at gun point and set fire to the tankers pouring petrol.

The insurgents warned that it was a consequence of plying tankers without paying ‘tax’ and next time such tankers would be burnt along with the inmates.

The area is a stronghold of Naga rebel group NSCN-K and United Liberation Front of Assam (Independent).

The terror-struck drivers and helpers of the tankers have demanded heavy security escort through the route in future if they were to ply crude oil carrying tankers along it.

The Supreme Court on Tuesday pulled up the CBI’s SIT, probing alleged extra-judicial killings and fake encounters by Army, Assam Rifles and the police in Manipur, for not registering the required number of FIRs as directed by it earlier.

The court. while putting searching questions to the Special Investigation Team over the issue, directed it to lodge 30 more FIRs on or before January 31, after the team said it has lodged 12 FIRs till date.

The apex court is hearing a PIL seeking probe into as many as 1,528 cases of extra-judicial killings in Manipur.

“FIRs have to be registered in every single case. It is the investigation that has to be carried out by you (SIT).

After the investigation, you decide whether you will file the charge sheets or closure reports,” a bench comprising Justices Madan B. Lokur and U.U. Lalit said.

The top court asked the SIT to complete its investigation in the 12 matters in which FIRs have already been registered, by February 28 this year.

“We make it clear that on or before January 31, 2018, all FIRs must be registered in respect of the remaining 30 cases as mentioned in the three tables that we have mentioned in the judgement dated July 14, 2017,” the bench said.

The court had on July 14 last year constituted an SIT comprising five CBI officers and ordered registration of FIRs and probe the alleged extra-judicial killings in Manipur.


The bench, which perused the first status report filed by the SIT, had directed that all subsequent reports to be filed before it, should have the approval of the CBI director.

The bench also asked the CBI director to monitor the progress in the investigation and posted the matter for further hearing on March 12.

At the outset, Additional Solicitor General (ASG) Maninder Singh, appearing for the CBI, placed before the bench the status report of SIT.

Senior advocate Colin Gonsalves, representing the petitioners, raised the question that CBI has not yet lodged the FIRs as directed by the court earlier and statement of witnesses have not been recorded so far.

The ASG referred to the contents of the status report and said that out of 48 such incidents, the SIT has not received the documents related to six cases.

However, the bench asked the CBI’s DIG, who is in-charge of the SIT probe and was present in the court, as to why all the FIRs were not registered yet despite ordering the team to do so by December 31 last year.

“You (SIT) do not need forensic reports to register an FIR. For registering an FIR, you do not need site visit. There are orders of the Gauhati High Court and the National Human Rights Commission (NHRC). You can register FIRs in respect of these cases and then carry out investigation,” the bench said.

When the DIG said they have to examine the voluminous records of each case before lodging FIRs and see whether a case was made out or not, the bench shot back, “that is for the courts to see if cases are made out or not. The Gauhati High Court has said about unnatural deaths. You cannot say that judgement of high court is wrong.”

Meanwhile, the ASG told the bench that SIT has received the documents related to these cases in tranches.

The bench told the DIG that the apex court has asked the SIT to first investigate the cases which have already been dealt with by the high court, NHRC and a commission headed by former Supreme Court judge Justice Santosh Hegde.

“Why did we picked up these cases? Because there are some foundational analysis by some judicial authorities in these matters,” the court said, adding, “you were expected to carry out investigation from there onwards“.

Regarding the arguments advanced by Gonsalves, the ASG said that process of recording statement of witnesses have already began.

The apex court had on January 8 said it appeared that the matter relating to probe into these cases was not being taken up seriously by the SIT.

According to a report by Ministry of Home Affairs, incidents of Maoists violence in the country fell below 1,000-mark in 2017 for the first time in eight years but number of security personnel getting killed in action is on the rise.

Also, the report shows that the number of arms training camps and 'jan adalats' organised by the naxals remained almost same in 2017 compared to 2016, though it has reduced considerably when compared to 2010.

Senior security officials feel that the action against the Maoists across the country is on the right path though there is a lot more to be done in Chhattisgarh, the main theatre of Maoist violence, where an increase in number of deaths were reported despite a decline in incidents.

Last year, 908 incidents involving Maoists were reported across the country, as against 1,048 in 2016 and 1,089 in 2015. In 2010, when the Maoist movement was at its peak, there were 2,213 incidents.

One of the highlights in the analysis by the MHA is the decline in civilian deaths. While 2016 saw a rise in civilian deaths, ducking the declining trend since 2010, the casualties on this side has once again slided last year to below 200 mark at 188. In 2016, it was 213 while it was 171 in 2015.


However, there is no good news about security personnel, as the number of their deaths in action is rising for the past two years. While 2010 recorded 285 killings of security personnel, it was on the decline till 2015 when 59 such cases were reported. However, it rose to 65 in 2016 and then to 75 last year.


The background paper prepared by the MHA had earlier acknowledged that extremists had fine-tuned their Tactical Counter Offensive Campaign (TCOC) "quite well" after suffering setbacks in 2016. The naxals have managed to perpetrate "some major incidents" by resorting to ambushes and IED attacks "taking the forces by surprise," it had said.

It had then said the Maoists were trying to deflect the attention of forces away from Dandakaranya region, the naxal hotbed, by stepping up activities at the Chhattisgarh-Madhya Pradesh-Maharashtra tri-junction.

Explosive material seized from them
The district police on Sunday claimed to have thwarted an alleged attempt by some Maoist leaders to procure explosive materials and trigger landmine blasts to kill policemen and other “targets” with the arrest of three Maoist sympathisers along with some explosive material .

Acting on specific inputs about the alleged attempts by Maoists to obtain explosives for carrying out landmine blasts somewhere along the inter-State border , the police had intensified patrolling at various locations in the district, police sources said.

Two minor boys were killed on Sunday and one boy seriously injured when a hand grenade exploded in Manipur’s Imphal East district, police said.

The three were playing in Suvunglo village in Khoupum police station jurisdiction when they chanced upon a foreign-made hand grenade. Not knowing it was an explosive, they began tossing it around and it exploded.

One of the boys was killed on the spot while two others were seriously injured. The second boy died shortly after admission to a district hospital. The identity of the dead and the injured could not be known immediately.

Officials said it could not be ascertained yet if the hand grenade belonged to some insurgent group or state or central forces.

Maoists are operating in North East , I think you are aware about the real meaning of Maoists ? Followers of Chairman Mao means Maoists. And they are operating from neighboring countries and entering inside Republic of India.

Maoists are operating inside Red Corridor and entering from neighboring countries Bhutan, Myanmar and even from Nepal and there have been IB reports that even from Kachin militant group have been killed by Indian Security Forces.

Naxals are different from Maoists.

In continuation of the stepped-up drive against the courier network of Maoists, the police on Tuesday arrested four “Maoist couriers” and seized medicines worth ₹10,000 .

A joint squad of the local police and the CRPF men nabbed four “Maoist couriers” while they were proceeding to deliver a consignment of medicines on Tuesday morning.


The two boxes that were seized from the arrested persons contained various medicines, 28 saline bottles, more than 200 syringes and surgical spirit, sources said.

The seizure followed intensified vigil against the movement of Maoist couriers along the inter-State border, police said.

The district police had on Sunday arrested three “Maoist sympathisers” at two places in that division and seized explosive materials meant to be handed over to the ultras.

Senior NSCN(KN) Cadre Apprehended in Nagaland

In a major blow to Naga insurgents, a senior cadre of the NSCN (Kitovi-Neopak) group was apprehended in Nagaland on 23 Jan.

Acting on specific information from National Investigation Agency (NIA) about movement of a senior NSCN cadre from Dimapur to Zunheboto, a joint team of Assam Rifles and National Investigation Agency established multiple mobile vehicle check posts in Kohima district of Nagaland on the morning of 23 Jan 2018.

During a vehicle check at the Mobile Vehicle Check Post in Zubza near Kohima, troops of Assam rifles apprehended a Self Styled Brigadier of NSCN (KN) from a TATA Fortuner vehicle Regd No NL-07 C 2266 along with two cadres of NSCN (KN). The apprehended cadre have been identified as SS Brigadier Aheto H Chophy s/o Hozuxu, r/o Village Yehemi, Zunheboto, Nagaland along with two cadres, namely, SS Sergeant Witti Marak and Mr Mughahoto Sumi.

Mr Aheto Chopy is Accused No 3 in a NIA case No RC 03/2013/NIA/GUW pertaining to criminal conspiracy for misappropriation of government arms and ammunition belonging to Zunehboto District Executive Force Kote. A non bailable warrant was issued against him by a Special Judge of NIA on 14 May 2014 and subsequently on 08 Jul 2014.

One Type-56 rifle, two pistols, 176 rounds of ammunition, ₹1,32,320 in Indian Currency, mobile instruments and incriminating documents were seized during the operation.

Four security personnel were killed and nine others injured in an encounter on Wednesday.

The injured include two sub-inspector rank officers of the District Reserve Guard ( DRG), who were in a search operation. The DRG is a unit of the state police and its personnel are mostly surrendered Maoists.

DM Awasthi, special director general of police , confirmed the deaths and said that additional forces have been deployed to search the area. Combing operations were also on.

Sources said the encounter took place inside the Abhujmad jungles, which is a core area of Maoists in Bastar and most of its part is still liberated.

“The Maoists were more than 300 in number and the team of DRG was comparatively small. The terrains were also very difficult in that region,” said a source in intelligence.

Sources said that some personnel were still stuck in the jungles until late in the evening following the attack and attempts were made to evacuate them from the encounter spot.

After the Burkapal attack in April 2017 in which 25 CRPF jawans were killed, this is the biggest setback for security forces fighting in Bastar.

Meanwhile, in another incident in , two state police jawans were injured in an IED explosion. “The condition of one is reported to be critical,” SP Bijapur, MR Ahire, told Hindustan Times.

A redrawn counter-insurgency strategy, backed by real-time intelligence through use of modern technology like drones and involving coordinated day and night operations by security personnel, to target Maoists deep inside the jungles has brought down the number of districts afflicted by left-wing extremist violence to 58.

Latest data compiled by CRPF shows that the number of districts under the grip of Maoist violence has dropped significantly since 2015, with over 90% of attacks being reported from only four states — Bihar, Chhattisgarh, Jharkhand and Odisha.

While 75 districts across nine states reported violent attacks by Naxals in 2015, the number came down to 67 in 2016 and dropped to 58 in 2017, touted as the best year for the security forces engaged in anti-Maoist operations.

Officials attributed the success to the revamped strategy to target senior Maoist leaders and their informers with enhanced and precise intelligence. Officials said there are more joint operations by the CRPF, the IAF, the BSF, the ITBP and state forces. Along with the operations, the administration is speeding up development work, including installation of mobile phone towers and construction of roads, besides setting up police stations in remote villages.

CRPF director general Rajeev Rai Bhatnagar told TOI, "The past year, we have hit the Naxals in their den. Our coordination with state police, intelligence agencies and armed forces has been exceptional. The focus has been on leaders, over ground operatives and sympathisers. The Naxals are not able to move arms, funds and their senior leaders from one place to another."

In terms of operations, with over 150 cadres (Maoist) killed, 2017 was one of the most successful years for the security forces. The anti-Naxal strategy was revamped after home minister Rajnath Singh met CMs of Naxal-affected states in May last year following the killing of 25 CRPF men in Sukma. Singh has said that Naxal violence has come down by 60%.

In an internal policy document of Naxals — 'Action Plan 2017-2022' — recovered by agencies recently, Maoists themselves admit that 140 of their comrades, including 30 women, were killed by security forces in 2017. The document, accessed by TOI, says many of its important leaders were also killed by the forces.
