The Centre told the Supreme Court on Wednesday that judges cannot decide the deployment of troops, and it is the fundamental job of the government of the day, and not the judiciary, to decide placement of police and armed forces to secure the nation's borders and maintain law and order internally.

The government's sharp attack was directed at the recent Calcutta High Court order directing the Centre to retain all 15 companies of Central Armed Police Forces, deployed in the restive districts of Darjeeling and Kalimpong in West Bengal, till October 27 or until further orders.

The High Court had countermanded the Centre's directive to withdraw certain companies from the two districts.

“The direction [Calcutta High Court's] ignores and virtually obliterates the very concept of separation of powers. The maintenance of order and the security of the country, which includes the deployment of police and armed forces, is a fundamental facet of the governance of the country, and is a core governmental function of the executive wing of the State.

“These matters cannot be the subject matter of judicial review, or adjudication by a court,” the petition, filed by advocate S. Wasim A. Qadri and settled by Attorney General K.K. Venugopal, contended.

The Centre mentioned the petition for urgent hearing before a Bench led by Justice J. Chelameswar, who agreed to refer it for listing before an appropriate Bench of the Supreme Court.

The petition said the demands on the Central Police Forces are “tremendous”, and arise all over the country.

“India has a long border, and in order to effectively prevent cross-border infiltration of terrorists, Central Police Forces are also deployed. Obviously, being a high-priority consideration, the thinning of border deployment has serious national security implications,” the Centre explained.

Noting that 61 officers of the various Central Police Forces were martyred this year alone, the government pointed to the various high-alert theatres like the Valley, the North East and the Red Corridor States affected by naxal extremism which require heightened presence of forces. Even natural disasters and the holding of elections would require the deployment of these forces.

“It would be the exclusive domain of the Central government to decide on the most efficacious deployment of the limited police personnel and resources, to quell pressing situations, varying in gravity, that simultaneously arise in different parts of the country... There is no yardstick by which the Court could assess the need for deployment of Central Police Forces in different States,” the petition said.

Following unrest in the two districts in West Bengal, the Centre had deployed a total of 15 companies of Central Police Forces in June-July 2017. It said the State's own police force has 73,403 personnel, followed by 20,781 personnel in the State Armed Force, 15,612 in Home Guards, two I.R. Battalions besides the Rapid Action Force, Counter Insurgency Force, Eastern Frontier Rifles (EFR) and ‘STRACO’.

The Centre submitted that its decision to withdraw some of the forces deployed was taken after assessing the ground situation. The State government had also concurred.

Union Home Minister Rajnath Singh on Wednesday assured Assam Chief Minister Sarbananda Sonowal that the territorial integrity of the State would not be compromised with, amid reports of a possible peace settlement with Naga rebel group NSCN-IM.

This was conveyed when Mr. Sonowal called on Mr. Singh here, an Assam government statement said. A key demand of the group is the integration of Naga-inhabited areas of Assam, Arunachal Pradesh and Manipur.

103 killed in Manipur since 2001; 142 in Assam since 2007

Lal Babu Singh’s bullet-riddled body was found near Manipur University campus in Imphal earlier this month. Four shots were fired at his chest from close range.

The 50-year-old native of Bihar, who was earning a living for the past 10 years in Manipur by selling dried fish, was blindfolded and his hands tied before he was shot at.

While none of the dozen active and banned insurgent groups in the state has claimed responsibility for the death even after two weeks, the incident has been termed as an act by an unidentified outfit.

Singh was the third non-local or outsider, terms used for non- indigenous people of the state, killed by insurgents in the state this year.

Similar selective killings of people from outside the state, particularly Hindi-speaking migrants, by the insurgents were also witnessed in neighbouring Assam, another northeastern state where anti-immigrant sentiment is high.

According to figures published by South Asia Terrorism Portal (SATP), a comprehensive website on terrorism and low-intensity warfare in South Asia, 103 non-locals have been killed by insurgents in Manipur since 2001.

Nearly 100 others have been injured in such attacks during the same period. Significantly, there were no reported killings of non-locals by insurgent outfits in 2015 and 2016.

In one of the worst attacks, nine persons were killed inside the Keibul Lamjao national park in May, 2009. Nine migrant labourers were killed and 11 others injured in a bomb attack in Imphal West in September, 2013.

These killings (unless the figures are very high) fail to attract much attention due to local sentiments against people from outside the state and slack investigation into the killings.

Usually the victims are migrant labourers, small time traders, street vendors etc.

Rights activists say till date there has been no conviction of any insurgent for murdering outsiders.

“Vulnerability of non-locals, who don’t have political clout, is high in Manipur. Ineffective police response to such attacks is a reason why the killings continue,” Babloo Loitongbam, executive director of Human Rights Alert (HRA) told Hindustan Times.

Since 2007, 142 outsiders have been killed in Assam, according to the SATP. Most victims were targets of the United Liberation Front of Assam (ULFA) and the National Democratic Front of Bodoland (NDFB).

The worst incident took place on January 5, 2007 when 48 persons were killed by ULFA militants in six separate locations in Dibrugarh, Tinsukia and Sibsagar districts in eastern Assam in attacks targeting migrant labourers.

“There is a strong local sentiment in Assam against outsiders, be it influx of illegal migrants from Bangladesh or people from other states. Militants tend to use this feeling to their advantage by targeting such people,” said a senior Assam Police officer requesting anonymity.

Since most of the victims are migrant workers and street vendors and their cases are not pursued actively by rights activists, investigations usually fail to make much headway and no arrest or conviction take place against the perpetrators.

“In northeast, politicians and many criminal armed gangs work hand in hand and as a result, hardly anyone who commits a crime, rape, murder is arrested,” said Binalakshmi Nepram, civil rights activist and founder of Manipur Women Gun Survivors Network.

A group of former rebels, who held guns to fight for a separate state in Meghalaya, plans to sell tickets of a traditional tambola-like board game to earn a living, saying they are frustrated at the lack of the comprehensive rehabilitation package as promised by the government.

A’chik Matgrik, a group formed for the welfare of rebels from ANVC-B, a breakaway faction of Achik National Volunteer Council, said in a statement issued on Sunday that the former rebels would actively promote Bawil Dawil, a local version of tambola or housie, to ensure disillusioned cadres don’t take up arms again.

“We want our former cadres to earn a living instead of being frustrated and depressed. This is our private project to support our former members and the youth,” the statement by AR Marak, the group’s organising secretary, said.

Formed in 1995 with the aim of carving out an Achik Land comprising Garo Hills in Meghalaya and parts of Assam, the parent group and the breakaway faction disbanded 19 years later with 447 cadres of ANVC and 301 from ANVC-B giving up arms.

The former rebels of ANVC-B started conducting Bawil Dawil games in Tura, the largest town in Garo Hills region, after the promise of a rehabilitation package by the Congress government in the state did not materialise.

They now want to promote the traditional version of the board game, based on probability in which players have to strike out numbers from a sheet and get prizes, more actively in rest of the region.

The statement by A’chik Matgrik said that they have informed the authorities about their plan to conduct the board games in the region as “rehabilitation packages are yet to be released to all”.

Nearly three years after the disbanding their outfit in a big ceremony in the presence of chief minister Mukul Sangma, the former rebels from ANVC-B have been accusing the state government of failing to dole out a rehabilitation package for them.

“There are certain technicalities that need to be addressed and in the process, there have been delays,” Sangma told journalists in Shillong in August this year.

Police officials have seized 1.41 kilograms of heroin in Mizoram and a Myanmarese national has been arrested in this connection. Aizawl district SP Neihchungnunga said the heroin was seized from the possession of the Myanmarese man in Aizawl yesterday.

The 56-year-old man has been booked under relevant sections of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Troops of the Assam Rifles early Wednesday morning gunned down a militant believed to be of the proscribed Revolutionary People’s Front (RPF) in Chandel district of Manipur, not far away from Maha Mani village, where two jawans of the 18 Assam Rifles had been killed in an explosion two days ago.

The insurgent was eliminated at Sajik Tampak, a village in Chandel district, and two improvised explosive devices (IED) and one AK-series rifle were recovered from the spot, a tweet by the Army Eastern Command headquarters said. While further details were not immediately available, the tweet said the operation was on till about 10 AM on Wednesday.

The incident took place during an on-going operation the troops of the Assam Rifles had launched on Monday after two of its jawans were killed and six others injured in a major IED attack at Chandel, not far away from the Myanmar border. Chandel is about 65 km from Imphal, the Manipur capital. The RPF had on Tuesday claimed responsibility for the Monday attack and said the Demolition Unit of the People’s Liberation Army (PLA), its armed wing had carried out the attack

At a book release function in Pune on Friday, General Rawat elaborated on the cross-border raid carried out by the Army on NSCN-K militant hideouts in Myanmar.

While India is working to improve ties with Myanmar, comments by Chief of the Army Staff General Bipin Rawat, confirming for the first time that Indian troops crossed into Myanmar in 2015 for operations, are being seen as a cause of concern, officials in the Home and External Affairs Ministries have told The Hindu.

However, neither Ministry agreed to comment on the issue. The government has been trying to get Myanmar’s support for its efforts to control cross-border movement of Nationalist Socialist Council of Nagaland rebels and Rohingya refugees.

“The Army Chief should have been mindful of the realities in Myanmar and our efforts there. Such detailed discussion on the operations wouldn’t help the situation at all,” a senior official in the security establishment, who asked not to be named, said.

At a book release function in Pune on Friday, General Rawat elaborated on the cross-border raid carried out by the Army on NSCN-K militant hideouts in Myanmar. He particularly underlined the the difficulties that Special Force commandos faced in Myanmar “after crossing over” and the “heavy losses” they inflicted on the militant camp there. It is the first time a senior government functionary has given such extensive details of the operation.

Gen. Rawat was commanding the Dimapur-based 3 Corps when the surgical strike was carried out on June 10, 2015, in retaliation for an ambush in Manipur when 18 soldiers of 6 Dogra battalion were killed by Myanmar-based militants.

Gen. Rawat, who was tasked with overseeing the operation, even told the Pune gathering that he had to alter the original plan because of a call from National Security Adviser Ajit Doval, who asked for the commando team leader to be recalled and briefed before launching operations.

“I got a call from the National Security Advisor asking if I had something in mind. I was a little taken aback because I had already launched the troops for the operation; they were on their way,” Gen. Rawat said.

“The troops which had reached the Myanmar border had to later change their route while carrying out the operation, four days from the day it was initially planned,” he said, revealing that the special commandos donned the uniforms of the 12 Bihar Battalion, which was deployed on the border, to carry out the raid.

While military sources had circulated some details of the operation at the time, the Government of India had moved in quickly to stop any official reports after the Myanmar government and military objected, saying only that an operation was carried out “along the border”.

“We will not allow any foreign military operations in Myanmar territory,” Zaw Htay, Director in the Myanmar President’s office, told journalists a day after the surgical strike. “Every country must respect the other country’s sovereignty.”

According to Myanmar’s constitution Article 41&42, no foreign troops can be deployed within the country’s boundaries for any reason. In a visit to Delhi in October 2016, State Counsellor Aung San Suu Kyi also reportedly repeated the concerns to Prime Minister Narendra Modi on the issue and a joint statement issued by the leaders “underlined their mutual respect for sovereignty and territorial integrity” when speaking of joint operations against terrorists.

In particular, the government is worried as it is in the process of sensitive negotiations on the Rohingya situation, and had also claimed some success in military-to-military ties with the first ever India-Myanmar Bilateral Military Exercise (IMBAX-2017) at the Joint Warfare Centre at the Umroi Joint Training Node in Meghalaya on November 20.

Gen. Rawat’s statement is seen as a major gaffe, particularly his assertion that more such surgical strikes could be undertaken “if required”.

A senior official said the diplomatic concerns had been conveyed to him.

Runikhata (Assam), December 5 A suspected National Democratic Front of Bodoland (Songbijit) terrorist was killed in an encounter with security forces here on Monday. Reportedly, a search operation was launched after security forces had received a tip-off on the movement of NDFB(S) terrorist near Indo-Bhutan border in the district.

During the operation, the terrorist fired at the police party after sighting them in the area. Soon an encounter ensued, following which one terrorist was neutralised while others managed to escape.

The police also busted a hideout and recovered one 9 mm pistol, one magazine, five rounds of live ammunition and other miscellaneous articles. The terrorist is yet to be identified. The security forces have launched a combing operation in the area. — ANI.

About 75-80 per cent insurgency problems in the northeast has come to an end, Union Home Minister Rajnath Singh said today. At a ‘Sainik Sammelan’ at the Assam Rifles Training Centre in Shokhuvi, he said the country’s oldest paramilitary force has been carrying out an exemplary dual service of guarding the porous 1,642-km long Indo-Myanmar border and counter insurgency operations.

“I can tell you that 75 to 80 per cent of the insurgency problems in the northeast has come to an end,” he said. Singh also highlighted the difficult task of Assam Rifles of guarding an “open border”, where a free movement regime is also in place for uninterrupted travel to each other’s territories by people of both the countries.

“It is a difficult task for you as Myanmar is a friendly country. You have to take care of the diplomatic sensitivity so that our relations do not hamper,” he said.

Three suspected ULFA-I cadre shoot dead father, son in Assam

Tinsukia (Assam), December 12 Three suspected United Liberation Front of Assam (Independent) (ULFA-I) cadre dressed in army fatigues have shot dead a Village Defence Force (VDF) president and his son in Simaluguri area of the district.

Simaluguri Village Defence Force (VDF) president Anteswar Mahanta and his son W. Mahanta were killed on Monday after they were dragged out of their house and were shot dead by AK-47.

“We reached the spot as soon as we received the information and we have started the investigation. The attack was carried out with an AK-47 whereby it seems that there are suspected ULFA militants behind the incident,” District Superintendent of Police (SP) Mugdhajyoti Mahanta told ANI.

Further details are awaited.

Earlier on Saturday, one ULFA cadre was arrested here by Dangri Kumar Army Camp of Dao Division. The said cadre, identified as Abhay Deka, was involved in the Dillighat firing incident in November 2015. — ANI.

NDFB(S) platoon commander killed in encounter in Assam

Kokrajhar (Assam), December 14

An NDFB(S) platoon commander of the West Zone was killed in an encounter with the police team in Dumbazar area of Assam's Kokrajhar district. The commander has been identified as Sergeant Major Soheton Narzary.

An AK-56 rifle, grenades and other incriminating documents have been recovered from his possession. The operation is underway, and further details are awaited. — ANI.

More than 1,000 Naga rebels were arrested by security forces since the banned NSCN-K attacked an Army convoy and killed 18 soldiers in Manipur two years ago, officials said.

As many as 531 underground cadres of NSCN-K and 542 overground workers were arrested in Manipur and Nagaland following intensive operations which began after the June 4, 2015 attack on the Army personnel.

“The operations are continuing even now and security forces have been able to restrict the NSCN-K’s movement to a great extent,” a home ministry official said.


This was for the first time in a decade that such a large number of Naga militants were arrested in just two years, the official claimed.

During the last two years, the security forces also killed 34 NSCN-K militants and recovered 571 sophisticated arms from arrested underground and overground cadres of the group.

After the June 2015 attack, the Indian Army had carried out a surgical strike on the camps of NSCN-K, killing some militants and destroying the camps.

Security forces also arrested 37 militants belonging to NSCN-IM, 26 militants belonging to NSCN-KN and four others from NSCN-R, the official said.


While the NSCN-K had abrogated the ceasefire agreement on March 27, 2015, the other three Naga insurgent groups have been maintaining the ceasefire agreement which they had signed with the central government a few years ago.

On December 8, Union Home Minister Rajnath Singh had said the violence perpetrated by insurgent groups in the Northeast has come done significantly -- by 75 to 80%.

He also said the central government is committed to do its best to fulfil the aspirations of the Naga people for a brighter future but ruled out integration of the Naga- inhabited areas of Arunachal Pradesh, Assam and Manipur.

Expectations for lasting peace have gone up in Nagaland, which has been hit by decades of insurgency, after the Centre and the NSCN-IM signed a framework agreement in 2015.

Early this month, President Ram Nath Kovind had said Nagaland was at the threshold of making history as the final agreement on the Naga political issue would soon be arrived at and a lasting peace achieved.

On September 19, Nagaland Governor PB Acharya said the vexed Naga issue would be solved within the next few months.

Arunachal Pradesh governor BD Mishra on Wednesday briefed defence minister Nirmala Sitharaman and Indian Army chief General Bipin Rawat on the security environment along the international border in the state.

Mishra, a retired Brigadier of the Indian Army, briefed Sitharaman on the border security environment and the high morale of the soldiers deployed in the border areas of the state.

Arunachal has a long international border with Bhutan in the west (160 Km), China in the north (1,080 Km) and Myanmar in the east (440 Km).

The governor also apprised the defence minister of the coordination interaction which he had with the GOC 3 Corps and GOC 4 Corps and the Formation Commanders, whose troops are deployed along the India-China border in Arunachal Pradesh.

On the initiative of the governor, the central government has decided that eight villages, which have been identified by the army in the forward most segment of the international border, will be developed into self-sustaining units with proper living amenities for the people living in those villages.

The governor suggested the defence minister for early start of work for the Sainik schools in the state. It was decided that the foundation stone of the Sainik schools would be laid as early as possible and construction work must commence latest by February 2018.

Sitharaman appreciated the Indian soldier’s good work and welfare activities, which they are rendering to the civil population in border areas.

During the meeting, it was resolved that more welfare schemes will be introduced for the civilians by the Indian Army in coming months.

Earlier in the day, Mishra also met the Indian Army chief General Rawat at the Army Headquarters in Delhi and discussed the ensuing army recruitment drive in Arunachal Pradesh.

The Union Cabinet has approved the rollout of the third batch of e-auctions of private FM radio stations for 683 channels in 236 cities.

"The Cabinet approval has paved the way for undertaking the auction of 683 channels in 236 cities in subsequent batches," a source said.

"These cities include those in the border areas of Jammu & Kashmir and the Northeast where the population is less than 1 lakh. This batch of the auction will also cover cities in districts which are badly affected by Left-wing extremism," the source added.

Batch-I and Batch-II auctions of private FM radio stations under Phase-III of the FM policy guidelines, as approved by the Cabinet in 2011, were held by the Ministry of Information and Broadcasting in 2015 and 2016, respectively.

"With the complete rollout of FM Phase-III auctions, all the 29 states and 6 out of the 7 UTs (except Dadra & Nagar Haveli) will be covered by private FM radio broadcasting," the source said.

The government hopes that the move would generate "direct and indirect employment to more than 10,000 people on a pan India basis."

"These auctions will yield an estimated revenue of more than Rs 1,100 crore," the source added.

In order to ensure complete transparency, the Simultaneous Multiple Round Ascending Process will be adopted for the e-auction.
