Bangladesh HC endorses Death Penalty for Army and RAB Officers for kidnapping and murder charges

Bangladesh’s High Court on Tuesday upheld a trial court verdict sentencing to death 15 people including three army officers and a gangster, who had fled to India after the gruesome killing of seven people three years ago.

The abducting and killing of seven people, including councillor Nazrul Islam and lawyer Chandan Kumar Sarkar, in suburban port town of Narayanganj shocked the nation.

“The High Court upheld the death sentence of 15 and commuted death penalties of 11 others to life imprisonment while the trial court had handed down death penalties to 26 accused,” a spokesman of the attorney general’s office said.

The judgement awarded death penalty to two sacked military and a navy officers, a gangster and 11 ex-servicemen posted in elite anti-crime Rapid Action Battalion (RAB).

The three officers, a Lieutenant Colonel, a Major and a Lieutenant Commander of navy were also serving the RAB at the time of the gruesome simultaneous murders in 2014.

A two-judge bench comprising Justices Bhabani Prasad Singha and Mustafa Zaman Islam delivered the entire verdict that took hours, contrary to normal practices when the court pronounces the operative or abridged part of the judgment.

The three officers were found to be bribed to assassinate the city councillor and six others. The councillor, the lawyer and five others were abducted on April 27, 2014 from the port town and their nearly decomposed bodies were retrieved later.

According to the proceedings, a key accused of the case gangster Nur Hossain, himself a city councillor, had bribed the RAB officials to eliminate councilor Nazrul Islam in exchange of Taka 6 crore.

Soon after the murder Hossain fled to India as he was found to be the mastermind of the plot but Indian police eventually tracked him down in West Bengal and deported to Bangladesh in November 2015.

Investigations revealed 23 RAB personnel, including an army lieutenant colonel and two navy officers, were involved in abduction and killing of the seven people.

Selina, wife of slain Nazrul Islam who was a councillor of Narayanganj City Corporation, was seen rigid when speaking to the media, but she said she was happy with the judgement and demanded its quick implementation.

“We have trust in the judiciary. The High Court gave due punishment to the barbarous killers. Now, I want quick implementation of the verdict so the culprits cannot get released using ‘lacunas’ in the law,” she said.

Echoing her, Shahidul Islam, father-in-law of Nazrul, said: “The criminals have duly been sentenced for their crimes. Now, we want to see the verdict implemented quickly.”

Hailing the judgement, Khayer, father of killed Tajul Islam who was an aide of Nazrul, described the woes his family faced after his son was killed.

Tajul’s younger brother Saiful Islam Raju said: “After my brother was murdered, I had to quit my studies and started working to support our family, because it had gotten quite difficult for my father to make ends meet.”

Families of Chandan Sarkar and his chauffeur Ibrahim and Nazrul’s associate Liton, Swapan and Jahangir also expressed satisfaction with the verdict.

Chandan’s son-in-law Bijoy Kumar Sarker said: “Punishment for key players has been unchanged in the High Court judgement, which shows the judiciary is still more powerful than muscle power.”

Gazi Tipu, a follower of Nazrul and a Jubo League member in the district, said: “We are happy with the verdict. We would have been even happier had the death sentences of another 11 not been commuted to life imprisonment.”

However, lawyers and families of the convicts expressed dissatisfaction with the verdict.

Claiming innocence of death row convict Nur Hossain, his brother Nur Uddin said: “My brother did not get justice. The media is responsible for such condition [death penalty] of my brother.”

Nur’s counsel SRM Lutfor Rahman Akhond said: “The court pronounced the verdict without taking relevant legal sections and submissions into cognisance.”

He said they would appeal against the verdict once the full text of it was released.

Fazlul Haque Farid, a counsel for prime convict Tarek Sayeed Mohammad said: “The seven-murder incident took place in two phases. My client was not involved in the incident in any of the phases… We will appeal against the verdict, and we hope we will get justice.”

A High Court bench of Justice Bhabani Prasad Singha and Justice Mustafa Zaman Islam upheld death sentences for 15 people in the cases.

The court commuted death sentences handed down to another 11 people by a trial court to life imprisonment, while the lower court’s decisions for nine other convicts were unchanged in the verdict.

We applaud the High Court verdict upholding death sentences for 15 people, including high-ranking RAB officials, over the Narayanganj seven-murder case.

The gruesome details of the seven-murder case sent shockwaves throughout the nation after seven bodies were found floating in the Shitalakkhya River three days after being abducted.

With this High Court verdict, not only are the families of the victims getting the closure they deserve, but a very strong message is being sent as well.

No one, not even high-ranking members of elite law enforcement agencies, is above the law.

Perpetrators of such heinous crimes should never go free, regardless of their level of influence in the law enforcement community.

The public puts faith in law enforcement to protect them, and the Narayanganj murders were the worst kind of violation of that sacred trust.

Our judicial system has now restored some of that trust, closing the chapter on a most scandalous crime.

‘7-murder PP’s daughter ‘fed poisonous sweet forcibly’

The daughter of the public prosecutor of sensational 7-murder case in Narayanganj was allegedly fed poison-mixed sweets forcibly on Wednesday.

The prosecutor, Wazed Ali, alleged that his daughter was fed the poison-mixed sweets in front of a coaching centre near Narayanganj Club in the city.

Prosecutor’s daughter Maisha Wazed Prapti, an A-lelvel student, was rushed to Dhaka Medical College Hospital (DMCH) since she had fallen sick shortly after the force-feeding.

“As soon as Maisha came downstairs of the four-storey coaching centre building near our house after completing her coaching class for the day, three men encircled her and offered her sweets saying, ‘take this as your father has done a good job in the 7-murder case,” alleged Wazed Ali while talking to Prothom Alo.

“Maisha said to them, ‘uncle, I don’t take foods except those of homemade’. Then, the three men forcibly fed her something poisonous and fled the scene quickly. She then made a phone call to me,” he added.

The public prosecutor further said he took his daughter to DMCH as soon as she fell sick after the incident.

Physicians have cleared Maisha’s stomach.

Additional superintendent of Narayanganj police Mostafizur Rahman said they have heard about the allegation.

Three days after their abduction, the bodies of six, including Narayanganj City Corporation panel mayor Nazrul and lawyer Chandan, were recovered from the Shitalakhya River on 30 April in 2014.

The following day, the body of Nazrul’s car driver Jahangir was also recovered from the river.

On 28 April 2014, a case was filed over kidnapping Narayanganj panel mayor Nazrul Islam, his three associates and driver.

On 11 May 2014, another case was filed over killing lawyer Chandan Kumar Sarkar and his driver.

Later, on 16 January in 2017, a Narayanganj court awarded 26 accused, including chief accused Nur Hossain and sacked RAB officer Tarek Sayeed, death penalty in the much-talked about 7-murder case.

On 22 August, the High Court upheld the death penalty for 15 out of 26 death-row convicts, commuting penalty for 11 others to life-term in jail in the case.

Wazed Ali was the prosecutor in the two cases filed over the incident.

I'm not maligning Islam.....you fool....Im clearly referring to radicals....which can be found in any religion....Learn to read and write English...
