ECP decides against de-seating 20 dissident PTI MNAs, dismisses references against them

The Election Commission of Pakistan (ECP) on Wednesday decided against de-seating 20 dissident Pakistan Tehreek-i-Insaf (PTI) Members of National Assembly (MNAs), dismissing references against them sent by the party.

The electoral body had reserved its verdict in the case earlier in the day.

The matter first came to light in March after several PTI lawmakers were found staying at the Sindh House in Islamabad ahead of the no-trust vote against then-prime minister Imran Khan, some of whom spoke to the media about their grievances with the party.

They had refuted allegations that they had been offered money to make the opposition's no-trust move a success but said they would vote in accordance with their "conscience".

Subsequently, the PTI had filed declarations and references against 20 members of the National Assembly, seeking their disqualification under Article 63-A of the Constitution.

The PTI had filed references against MNAs Noor Alam Khan, Dr Mohammad Afzal Khan Dhandla, Nawab Sher Waseer, Raja Riaz Ahmad, Ahmed Hussain Deharr, Rana Mohammad Qasim Noon, Asim Nazeer, Amjad Farooq Khosa, Aamir Liaquat Hussain, Chaudhry Farrukh Altaf, Syed Mobeen Ahmed, Sayed Sami-ul-Hassan Gillani, Mohammad Abdul Ghaffar Wattoo, Sayed Basit Ahmad Sultan, Aamir Talal Gopang, Sardar Riaz Mehmood Khan Mazari, Ramesh Kumar Vankwani, Wajiha Qamar, Nuzhat Pathan and Javeria Zafar.

Eventually, the dissident MNAs' votes were not needed in Imran's removal, as the opposition managed to stitch together support from government-allied political parties.

After Imran Khan was removed as prime minister on the night of April 9, his declarations against the dissident PTI MNAs were sent to the ECP on April 14 by the acting NA speaker.

Last month, the Election Commission had issued notices to the 20 MNAs, directing them to appear before it.

In their written replies, the defected MNAs said they had neither resigned from the PTI nor had joined any other political party, nor had they voted against their parties stated line.

The declaration and the reference were "baseless, unsubstantiated and vague", one reply read.

"It has been actuated by bad faith in order to suppress a voice of dissent within the party lines. Such actions are tantamount to converting the party into an authoritarian group commanded in a dictatorial mindset of one individual," the reply said.

Another reply submitted to the ECP said the reference and the declaration did not fulfil the mandatory requirements under Article 63-A.

Article 63-A​

According to Article 63-A of the Constitution, a parliamentarian can be disqualified on grounds of defection if he "votes or abstains from voting in the House contrary to any direction issued by the parliamentary party to which he belongs, in relation to election of the prime minister or chief minister; or a vote of confidence or a vote of no-confidence; or a money bill or a Constitution (amendment) bill".

The article says that the party head has to declare in writing that the MNA concerned has defected but before making the declaration, the party head will "provide such member with an opportunity to show cause as to why such declaration may not be made against him".

After giving the member a chance to explain their reasons, the party head will forward the declaration to the speaker, who will forward it to the chief election commissioner (CEC). The CEC will then have 30 days to confirm the declaration. If confirmed by the CEC, the member "shall cease to be a member of the House and his seat shall become vacant".

ECP should investigate how these people joined PTi in first place.
 
This chairman needs to be replaced if you want to have fair and free elections.
There will be a bloody revolution east pakistan style if these clowns add more fuel to the dumpster fire they created.

I have not seen such levels of stupidity before. Contradicting your own claims and stating there was a cipher, IK was kicked out for choosing the army chief, declaring horse trading legal, blatantly threatening and insulting the public, and making no effort to hide the illegitimacy of your power.
 
Best thing to do is to call an early election and break the deadlock in parliament. Speed proceedings to the extent possible. These steps are just building up to the inevitable.

Pakistan needs a credible government TODAY, I don’t think we can afford to wait until the end of the year.

When it came to voting... The dissident PTI MNA did not vote. The offence would have happened if they voted?

What is the basis of disqualification that they were unhappy with their party leader? We know the reality that they would have voted against Imran Khan, but the fact is... The opposition was smart enough to save them and keep their votes in reserve. PDM was able to show 198 members when they held the election before the official NCV, but on the day the NCV voting was held, only 174 people voted against Imran Khan, and the dissident PTI leadership abstained from voting

The opposition was smart enough to save them and keep their votes in reserve. PDM was able to show 198 members when they held the election before the official NCV, but on the day the NCV voting was held, only 174 people voted against Imran Khan, and the dissident PTI leadership abstained from voting

Yes ECP can't decide on the wishes of PTI.
This is important for PMLN else Hamza Shahbaz would need vote in the PA.... ECP is literally PMLN 2
If I am not wrong this decision is only for MNAs not MPAs. MNAs didnt vote but MPAs did vote.

Even if you accept their decision as in actuality these members have not voted in favour of the opposition, it becomes interesting in what the CEC will do in punjab where these members have actually voted against their own party so this is an open and shut case. If Punjab falls the Center becomes irrelevant. so we should accept this decision on technicality. Irrespective of what happens i think the PML N Government is going to call for elections soon as these conditions are not suitable for them and the longer they stay in power the more difficult life will become.

All valid points.

But 63A-1(a) says that if a member joins another party, that too counts as defection. Now, afaik, joining has to be in writing.

But surely the law needs to be changed that if a parliamentary leader judges his members to have defected, by means of collusion with another party or otherwise, he can expel them from the party and they be disqualified.

Because logically speaking, these 20 members have for all effects and purposes defected from PTI.

As I said before, the previous mess could have been avoided if the SC was a bit more serious about the PTI petition, and the current mess in Punjab can be resolved if the ECP disqualifies the Punjab MPA's, as that case is open and shut. The new excuse by the ECP is that no formal declaration was givene by the party for the same, but PTI leaders are adamanat that formal declaration was given.

I have no hope from the ECP here though, and I would not be surprised if those MPA's do not get disqualified.

The defendant has already said that no formal order was given by the party to not vote for them.

Would not surprise me one bit to see this argument holding in front of the ECP.

It's only in PPPs interest to delay the elections.

We will discuss Punjab parliament when the time comes. It's high time Punjab frees itself from Khotay Sikkays of electables
