Unfortunately, situation and stance is not really good for nation's interest.
Both court and Govt should think for Pakistan only.
I just wish to see all major national pillar on same page and struggling to enhance National interest.

And need I remind the recent back to back bails to Godfather and the hyperactivism shown by the IHC and LHC...

IHC issuing contempt notice to two sitting ministers yet the same courts didn't take a notice of Hamza insulting the jude in session and his attack doing an offensive presser after that incidence.

CJP didn't take notice when that ATM thief was tortured to death... or anyother issues directly effecting the general public... but now a Suo Motto.

The eminent courts didn't do anything about the corruption charges against judges... including Iftihar Ch. appointing his son on so many posts and that infamous case of Malik Riaz vs his own son ... long list!

The hostility and out right malign intent shown by the Status Quo forces and their Lawyers towards the National Security of PakState is alarming.

The Military Diplomacy of PakState has borne so many fruits...including saving Pakistan from Default... credit must be given where it is due....

It is NOT just about being ArmyChief leading all corps... its about Geostrategic and Geopolitical Momentum that is built through Military Diplomacy given that our FO is essentially made defunct by Design in the DarkDecade of Zardari and Nawaz regimes....

What we see before us is the glaring Acceleration of Paralysis of Functioning of State... with unimaginable results.

It is not about a person i.e. Chief Bajwa..

Willing and unwillingly the forces of Status Quo are causing grave internal entaglements while we are at the defining moment of Third Strategic Moment in our 72 years of history... IoJK is all forgotten... Afghan Peace is still not there and yes, The Third War on CPEC is all in the open.

Imposing a Western Liberal Democracy on a people where less than 2% can effectively be considered Educated i.e. Ability of Critical Thinking and not Copy/Pasting ideas from abroad .. Ability to understand PakNationhood and PakState's challenges...

40% with Stunted Growth and more living under the poverty line...

In a way, dreadful as it is... this is a form of CivilWar ... where this juidiciary has become Law upon itself... since that One Eyed Demon has harmed PakState e..g RekoDig...

Whatever the results might be of the esteemed SCP decision... it is going to have lasting effect on the Functioning of PakState where MarasiMedia is eseentially acting as AntiState fifth column with its FakeNews and spreading of fasad!

We need to peform a Postmortem of this SuoMotto regardless of its outcome.

3- Taste of Power:
First of all, In future the role Judiciary or Military will only be emerged, if our politician will fail severely again & will create another constitutional deadlock. Rest assured in any of that situation the Judiciary will only act as a facilitator in "State Functionality" not as a ruler & this is the role determined by Constitution.

Now Judiciary will play a role of "equivalent member of the establishment" if it chose to support the functionality of the administration, remember it will not the revival of "Doctrine of Necessity" but "Doctrine of State Functionality"

In every other scenario Judiciary is a must participant and its 'alignment' with the establishment will decide the political future of Pakistan,

So this action of Chief Justice is nothing but an effort to exert and blunt exhibition of the power of Judiciary in power politics ..... mark my word nothing will happen in any case even if the Bajwa is allowed to continue or send home ....

Its just a harsh reminder to Politicians that they have lost more political space now not only their discretionary power as executive will be questioned but the unquestioned liberty of making policies just on the basis of the majority in the Parliament will also tested ....

No Constitutional Deadlock will occur IF ordered Army Chief will immediately give up his office for next term ......

ISLAMABAD: A meeting of the federal cabinet presided over by Prime Minister Imran on Tuesday approved the summary seeking an extension for Chief Of Army Staff (COAS) General Qamar Javed Bajwa.

The prime minister had called an emergency meeting of the cabinet for the second time during the day.

The cabinet's approval was sought for giving an extension to army chief General Bajwa after the Supreme Court had earlier suspended a notification over the same matter.

An amendment in the Defence Act was approved by the cabinet. Sources claimed that the new summary was sent to President Alvi for approval.

Sources further said that the word 'extension' was added in the Defence Act.

The development comes a few hours after the Supreme Court of Pakistan suspended the notification granting General Bajwa an extension of three years as army chief.

Chief Justice Khosa rejected the application today (Tuesday) and took up a petition challenging the notification issued by the prime minister in public interest under Article 184 (3) of the Constitution, turning the petition into a suo motu notice.

“The prime minister does not have the power to extend the tenure of the army chief,” the chief justice remarked.

To this, the attorney general told the court, “Army chief's tenure was extended after the president's approval.”

“If the president approved the summary on August 19, then why did the prime minister gave the approval for the summary again on August 21,” CJP Khosa questioned.

“The prime minister signed the summary after the approval from the cabinet,” the attorney general responded.

“Did the president give approval again after the approval from the prime minister and cabinet?” CJP Khosa enquired.

“The initial approval is supposed to be given by the president,” he further said, adding that "the approval given by the president before the cabinet might not be according to the law."

We can take the approval from the president again, the attorney general suggested.

“Only 11 members of the cabinet gave approval of the summary for the extension of army chief’s tenure. We cannot say the majority gave the approval,” the chief remarked.

“In a democracy, the decisions are made through the opinion of the majority. Those members who did not give an answer, we should wait for their answer. These members did not say ‘no’ either. Did the government assume that the answer of those who did not give an answer translates into ‘yes’?” the chief justice asked.

“The prime minister was told he did not have the power. Then it was found out that both the prime minister and the president did not have the power and the final decision rests with the cabinet and on August 21, the matter was sent to the cabinet,” CJP Khosa said.

It’s Pakistan - what do you think would have happened when a new COAS came in? Rumor mongering and speculation galore that ‘new COAS will get rid of PTI government’. The decision to give an extension was more from the perspective of political stability and to end rumor mongering in the media when a new COAS took charge.

In any case, this is the governments prerogative. The SC perhaps can argue that the notification did not follow the proper process but at the end of the day if the SC refuses to allow extension it will be a gross interference of the court in an elected government’s affairs.

Khosa has needlessly started a controversy in his last days as CJ & tarnished his legacy.

On the other hand, no one should complain that the courts are ‘under Establishment influence’ any more.
