I've been saying for some time that Judiciary needs to be exposed as all other institutions have been. PA went through a patch to face public wrath and worked many years to fix that, now the Judiciary is facing that wrath and this CJP has taken the axe to it himself.

If COAS extension legal under constitution attorney general win the case and he get extension.
But why PM approved it first than send to president and than realize that Federal Cabinet approval is must, out of 25 only 11 signed it, man this is state we need run not a cricket team.
Poor Bajwa Sahib mishandled badly by IK legal team.

ISLAMABAD: Prime Minister Imran Khan on Tuesday called an emergency meeting of his federal cabinet for the second time during the day.

According to sources, the prime minister has decided to seek the cabinet's approval on extending Chief Of Army Staff (COAS) General Qamar Javed Bajwa's tenure for another three years.

The cabinet will be required to approve the summary granting the army chief another extension for three years.

The development comes a few hours after the Supreme Court of Pakistan suspended the notification granting General Bajwa an extension of three years as army chief.

Chief Justice Khosa rejected the application today (Tuesday) and took up a petition challenging the notification issued by the prime minister in public interest under Article 184 (3) of the Constitution, turning the petition into a suo motu notice.

“The prime minister does not have the power to extend the tenure of the army chief,” the chief justice remarked.

To this, the attorney general told the court, “Army chief's tenure was extended after the president's approval.”

“If the president approved the summary on August 19, then why did the prime minister gave the approval for the summary again on August 21,” CJP Khosa questioned.

“The prime minister signed the summary after the approval from the cabinet,” the attorney general responded.

“Did the president give approval again after the approval from the prime minister and cabinet?” CJP Khosa enquired.

“The initial approval is supposed to be given by the president,” he further said, adding that "the approval given by the president before the cabinet might not be according to the law."

We can take the approval from the president again, the attorney general suggested.

“Only 11 members of the cabinet gave approval of the summary for the extension of army chief’s tenure. We cannot say the majority gave the approval,” the chief remarked.

“In a democracy, the decisions are made through the opinion of the majority. Those members who did not give an answer, we should wait for their answer. These members did not say ‘no’ either. Did the government assume that the answer of those who did not give an answer translates into ‘yes’?” the chief justice asked.

“The prime minister was told he did not have the power. Then it was found out that both the prime minister and the president did not have the power and the final decision rests with the cabinet and on August 21, the matter was sent to the cabinet,” CJP Khosa said.

Chief Justice of Pakistan Asif Saeed Khosa on Tuesday suspended the government's notification of Army Chief Gen Qamar Javed Bajwa's tenure extension until the top court's hearing tomorrow.

The chief justice observed that "the summary and approval of army chief's extension is not correct".

The court issued notices to defence ministry, federal government and Gen Bajwa, who is due to retire on November 29 (Friday). The hearing was adjourned until Wednesday.

On August 19, Prime Minister Imran Khan had approved an extension in the tenure of Gen Bajwa for another three years.

@AgNoStiC MuSliM seems two scenario .. judiciary opening new front with present govt or Judge will correct the extension document and send back to President office and file again.
 
lot of things are not running in Iks and Bajwa, s favour had he been sensible and sincere with country would have not accepted extension,

Who filled the petition and why? why so much secrecy, if its good for the country as you claim it to be, why not come out and say we did this and this is why..

petition filled by group of lawyers , which claiming themselves affiliated with some rights and democracy groups.
 
Times are changing ..
Now the most feared and powerful institution of pakistan is answerable.
This is more about the legality of the government allowing an extension. So far the issue appears to be more of a technical on be in terms of the court arguing that:

1. The word extension isn’t present in the laws - it’s technically a suspension of retirement
2. Does The extension/suspension of retirement need to be approved by full cabinet & when does the President have to sign the notification.

Better that the court clear up these issues now instead of 1 or 2 years later if extension is challenged in court and declared unlawful based on legal technicalities.

By the way, for all those conspiracy theorists saying the courts are acting under control of establishment - how does this fit in with that theory?

this is a new development ,, o boy not good for country, not good , lot of movement behind the curtains,
 
i think ball is in sc court if they set precedence today then in future granting extension will become almost impossible for any future govt
