Kerala high court judge Justice B Kamal Pasha stirred a hornet’s nest on Sunday by asking why Muslim women could not have four husbands while the men enjoyed the same privilege under the Muslim personal law.

Addressing a seminar organised by an NGO run by women lawyers in Kozhikode, Pasha said Muslim personal laws are heavily loaded against women. He blamed religious heads for establishing the hegemony of men and wanted them to introspect during religious discourses on sensitive issues.

Under the Muslim personal law, a man can marry four times. Although many Muslim countries have banned polygamy, it is still prevalent in India.

“Religious heads should do self-introspection whether they are eligible to pronounce one-sided verdicts. People should also think about the eligibility of persons who are pronouncing such verdicts,” he said, adding that women were deprived even of the rights enshrined in the Quran.

Pasha also said that it was unfair to oppose a uniform civil code. “Even the highest court is a bit reluctant to interfere in this. Women should come forward to end this injustice,” he said.

“Personal law is loaded with discrimination. Besides denying equality, it also denies women’s right to property and other issues,” he said. The judge added that the Protection of Women from Domestic Violence Act, 2005, will be fruitful if the right of a woman to her husband’s property is properly defined.

India should implement Uniform Civil Code ( UCC) - one rule for every citizen. The Muslim Community is The Epitome of Secularism in India. Hence, they should wholeheartedly support UCC. :p:

In Hinduism u can marry even tree, dog and 2 man can marry a women.. and thousands of Taboo.. Thats why India is called land of taboo and snake charmers.. why he failed to question those?

The discussion is about legality. You brought in a custom and compared it to legality. Because, the discussion is about legality. Use your brains for once.

I am an Indian. And I have the right to discuss legal Indian procedures. Be they Muslim, Christian, Hindu or Sikh. A concept, you you will not be able to grasp. And I understand this.

I have seen enough of his videos to spend a life time laughing. And I would prefer watching John Oliver to him.

Yeah. We discovered the characters in StarWars much before George Lucas did. Walking rodents and llamas. But anyways, I do not want to discuss Hinduism on this thread.

The point being the Constitution and the Penal Code needs to be supreme. All other books are books. Revere them, follow them. But do not expect them to be legal paper.

You can't really give rational explanations to religious dictum.

If a religion says it is necessary to paint your face blue or hop on one leg or cover your right elbow or whatever you cannot argue with it by providing scientific proof that it is not necessary.

Presumably the original reason that men were allowed to marry many women was that it enabled alpha males to reproduce more than their meeker counterparts, you cannot use modern notions of feminism to counter that. You have to find some religious justification for it, which I am sure can be found and will be found. When people see the need for change they will find the religious justification to do so.( or bend ancient rules with modern interpretations)

Give it ten to fifteen to years at most , India will have UCC.

These Judges have some guts man... they say things that a common man can not.. even though he wants to ...God created everyone equal... why should laws be different for anyone... On man... One woman...Why is it such a problem for some people. Quoting some random examples form history doe not justify your acts.
