'We trusted the government to fight for us': Kerala fishermen disappointed in Italian marines case

In this case, it is not the govt to be faulted, it is the supreme court which took suo motu control, after an out of court settlement between the Italian govt and the heirs of the fishermen...refer time line:

April 20, 2012: The legal heirs of the two deceased fishermen tell the Kerala High Court that a settlement for paying a compensation of Rs. 1 crore to each bereaved family has been reached between the Italian government representatives and them.

April 23, 2012: The legal heirs of two fishermen file a petition in the Kerala High Court seeking to withdraw the affidavits and submissions made by them against Italy's plea for quashing the First Information Report registered against the marines.

April 24, 2012: The Kerala High Court gives its seal of approval to the award passed by the Lok Adalat under the High Court Legal Service Committee, endorsing the settlement on compensation reached between the legal heirs of the two fishermen and Italian government.

April 27, 2012: The Kerala High Court approves the out-of-court settlement reached between Italy and J. Freddy, owner of the mechanised boat which was fired upon by two marines The boat owner accepts the out-of-court-settlement of Rs.17 lakh.

Apr 30, 2012: Describing Italy's compromise with the kin of the two Indian fishermen as “illegal” and “astonishing,” the Supreme Court says that they were “playing” with the Indian process of law.

Jan 18, 2013: The Supreme Court holds that the State of Kerala had no jurisdiction to investigate into the `Italian marines shooting incident’ and says only the Union of India had jurisdiction to proceed with the investigation and trial of the two marines.


The supreme court dragged the matter along after they reached an agreement, and after all these years has still not closed the issue.

Given the timeline, I think the statements by the family are going to be used for politics more than anything else tbh, while in reality the sc should take the blame if they dont get justice, after all these years.

In any case the UN has declared the supremacy of the Indian Supreme Court in this matter and has only asked to provide BAIL to the accused.

Then it was the turn of the CONGRESS ruled Kerala to sell out the Fishermen when they attempted to shut down the cases against them.


Now all of these scums have the audacity to blame the BJP govt with the usual cheer leaders cheering at the side lines.

Now coming to the Judgement given- The international court- decided in the favor of India and demanded that the bail conditions made the the Supreme Court of India must be met by Italian marines when they are in Italy for any medical treatment or otherwise- until the Supreme Court of India makes a final decision-

If the Indian govt. let the marines go free for the sake of Indian ties with Italy then it would be a huge disappointment for those who see India's status as a strong power in the World and believes that the foremost duty of the Indian govt is to protect and provide justice to its citizens.

Obviously Indian needs from Italy more than what Italy needs from India..heck an italian woman ruled India recently...May be if Indian was capable of securing Indian ocean there would be no need to post Italian marines on a cargo vessel.

Wrong, when there is a international dispute between two countries and one refers it to the UN hence the WTO ruling the Americans won against India. Now they passed the verdict it is a international court, you have to accept it and swallow like a good boy.
