KUALA LUMPUR: The then Home Minister had acted in breach of the constitutional rights of the publisher of the Herald in imposing a ban on the use of word “Allah,” the High Court heard.

Lead counsel Porres Royan, who acted for the applicant, submitted that Tan Sri Syed Hamid Albar had acted in violation of several articles of the Federal Constitution by prohibiting the use of the word “Allah” in the Catholic weekly.

Porres submitted that the applicant has the constitutional right to use the word “Allah” in the Herald as provided for by the Federal Constitution.


He argued that the minister had also acted ultra vires (outside the law) of the the Printing Presses and Publications Act 1984.

“The Act was not meant for the purpose of regulating any religious groups in the practice and progagation of their faith which includes the use of religious publications,” he submitted before High Court judge Justice Lau Bee Lan on Monday.

He submitted that the use of the word “Allah” is essential for the worship and instructions in the faith of the Bahasa Malaysia speaking community of the Catholic Church in Malaysia and is integral to the practice and propagation of their faith.

“Imposing a condition under the Act to prohibit the use of this word would have the effect of regulating this religious group in the practice and propagation of their faith,” he said.

Among others, he argued that there were serious doubt as to the identity of the decision maker of the decision dated Jan 7.

He said Syed Hamid affirmed in his affidavit dated July 6 that he had made the decision to prohibit the use of the word in the publication while his secretary-general Che Din Yusoh in his affidavit-in-reply dated May 26 stated his division had make the decision and another part stated that it was his (Che Din) decision.

Senior Federal Counsel Datuk Kamaluddin Md however submitted that the minister has the power to impose such a condition and that the minister had exercised his power lawfully.

He said the granting of a publication permit is the absolute discretion of the minister and the permit holder has no choice but to comply with the conditions attached to it.

“Any challenge can only be in respect of the decision of the minister not to grant or to revoke or suspend the permit,” he said.

He said there was no evidence that the minister was prejudiced or biased, had acted in bad faith or had acted contrary to the rules of natural justice in attaching the condition.

“In our country, if one refer to Allah or mentions the kalimah (verse) Allah, it will bring to one’s mind that it refers to the God for Muslims. Kalimah Allah is sacred to the Muslims and put at the highest position and its sanctity must be protected.

“Thus, kalimah Allah is not just a mere word or translation of the word God as described in the Herald, but it is a special name for the Muslims’ God.


“The usage of the kalimah Allah as an intepretation of the word God may cause confusion, religious sensitivity amd disharmony between the Muslims and Christians,” he said when asking the court to reject the judicial review application.

He said further that “the applicant’s contention that the Bahasa Malaysia term for God is Allah and Lord is Tuhan is clearly perverse, erroneous and misconceived.

“We submit that that Allah being exclusive and special name cannot be interchangeably used as a general term,” he added.

The Roman Catholic Archbishop of Kuala Lumpur Tan Sri Murphy Pakiam had applied to declare that the Herald is entitled to use the word and that its use was not exclusive to Islam.

Rev Murphy had named the minister and the Government as respondents in the application filed on Feb 16.

The archbishop is named as an applicant in this action as publisher of the Herald.

This is a serious issue because the Malaysian Archbishop is going to use 'Allah' as an translation for God in their publications. They claim that there is no translation of God in Malay. Well first of all, Allah is not a general term for God.

Look at this way, Christians in Pakistan use the word 'Khuda' for translating God but they never use the word Allah for translation of God.

Issue is that we will have missionaries in Malaysia preaching Christianity to the country side people by using the name Allah. Imagine someone saying 'Masiah ko Allah ney bheja apna beta bana ker' (naouz-e-billah). In this example, word God has been translated with the Allah instead of Khuda.

Malaysians need to find a word (I am sure it is available) to translate God instead of using Allah.

At the same time, Pope should tell his Archbishop in Malaysia to stop playing these stupid games which only create more hate between communities instead of harmony.

Why translating God as Allah is linguistically wrong is as bellow,

God is often considered as masculine, thus its feminine like Goddess pops up whereas Allah is unique, one and doesn't have any partner (Illaha). Thus, it's wrong to translate Allah as God, thanks.

but arab christians use the word Allah too as God, or the word Elah which is basically similar in root.

HE did not name Him anything. Allah is an Arabic word and Quran was revealed in Arabic.

We cannot fight everyone/everything. HE the creator knows everything. If I say God it is my personal faith. You cannot judge my acts by your statements.
If you think I am wrong than it is your personal opinion..you cannot prove as you don't know what HE knows.

Shia's say go to Lahore
Sunni's say NO go to Islamabad..

They all blame eachother and the most interesting part is when every sect says that they are right.

Caution : My intention is not to Hurt any Christian bro.

Christian Concept of God.

Creator / Father of Jesus PBUH and according to some the father of Whole Humanity!

Muslim Concept of God ( Allah)

Creator / Pure of Gender / has no Son / has no father / pure from body & image.

Now Allah the word itself can't be played around with its a unique word which represents the true Muslim view of the Creator. unlike God that can be altered into Gods / Goddess / Godfather that changes the concept of God.

If a Christian says Allah it means they accept that he has no "Son" as the word spells for itself .

Christians want to call their god what they wish that is their problem

Muslism want to call their god what they wish its their issue

so an so , really - :what: you can't call Jesus John wyne in christianity etc or you can't use Allah as a universal name for all religions that is a Muslim view point on religon , and other religions have their own views , so we can't assume or gov should not force this issue ...

Just image USA saying tomorrow , ok all you muslims you will now call your god , Jesus , I hope you all understand my point of view

And so I say gov should not interfere this should be the local religous body's own decision , I doubt they would get any authorization from catholic churches in Italy to call Jesus'a god , Allah but then again , not even christians understand Catholics

those christian & jews actually worshiping the same god but they only differ in how they believe it. they follow the Injil and Taurat and refuse to believe Al Quran but this 3 book is all from Allah

Well first of all - if the Churches in Malasia will say Allah is their God, I am sure all of the Catholic main brach churches (Italy , Pope etc) they will all Shun - out the Churches

a) One of the main principles of Catholicism is well the concept
of holy spirit etc and jesus etc and marry etc
so they don't really use the term Allah

b) When Malasian gov says can't use Allah - in Churches its clear
that you can't because based on Chirtian , churches (the mecca)
for Christians in Italy you can't use Allah -

So Malasian gov is doing the correct thing - and alot of , christians would agree.

But if a church says we want to call our god , Allah then also as Muslims do we care - don't we say Allah is creator of all - infact go ahead say that you believe in Allah and not the holly spirit and Jesus or Marry etc

I think a resolution is simple , to refer the problem to Cataholic heads in Italy to decide , and make it clear - instead of passing rules and court rulings. They control all the catholic churches matters

Lets not forget - out own religion says Allah is the god of Christians and Jews as well
so are we now contradicting things - Allah is creator of all

I say let the ppl decide what they want to call their god, I know who mine is Allah you go figure out who created us all if you differ if you want to call him Allah too great - no problem its 2010 ... now ... go live in peace already
