Exaggeration and misrepresentation are nothing new, either. Civilians lose their protected status in international law when they are employed as human shields. Those who employ them are committing a war crime by doing so.

The question reduces not to an issue of training but proportionality: assessing whether or not the civilian deaths that may be incurred for the military gain anticipated is appropriate is left to the judgment of the "reasonable military commander" - and of course such "reason" is something the commander can be held accountable for, at least to his superiors.

So what you're left with is the certainty that the terrorists were committing a war crime, whereas you can't be certain (at least for now) that the Americans did; and since American soldiers are quite accountable for their deeds, they must be set in the "innocent until proven guilty" category.
