A federal appeals court in San Francisco said Thursday it will release its ruling by the end of the business day in the legal fight over whether to reinstate President Donald Trump's ban on travelers from seven predominantly Muslim nations.

A panel of three judges from the 9th U.S. Circuit Court of Appeals is deciding whether to block a lower-court ruling that suspended the ban and allowed previously barred travelers to enter the U.S. An appeal to the U.S. Supreme Court is possible.

U.S. District Judge James Robart in Seattle issued a temporary restraining order halting the ban last week after Washington state and Minnesota sued. The ban temporarily suspended the nation's refugee program and immigration from countries that have raised terrorism concerns.

Justice Department lawyers appealed to the 9th Circuit, arguing that the president has the constitutional power to restrict entry to the United States and that the courts cannot second-guess his determination that such a step was needed to prevent terrorism.

The states said Trump's travel ban harmed individuals, businesses and universities. Citing Trump's campaign promise to stop Muslims from entering the U.S., they said the ban unconstitutionally blocked entry to people based on religion.

Both sides faced tough questioning during an hour of arguments Tuesday conducted by phone — an unusual step — and broadcast live on cable networks, newspaper websites and social media. It attracted a huge audience.

The judges hammered away at the administration's claim that the ban was motivated by terrorism fears, but they also challenged the states' argument that it targeted Muslims.

"I have trouble understanding why we're supposed to infer religious animus when, in fact, the vast majority of Muslims would not be affected," Judge Richard Clifton, a George W. Bush nominee, asked an attorney representing Washington state and Minnesota.

Only 15 percent of the world's Muslims are affected by the executive order, the judge said, citing his own calculations.

"Has the government pointed to any evidence connecting these countries to terrorism?" Judge Michelle T. Friedland, who was appointed by President Barack Obama, asked the Justice Department attorney.

The lower-court judge temporarily halted the ban after determining that the states were likely to win the case and had shown that the ban would restrict travel by their residents, damage their public universities and reduce their tax base. Robart put the executive order on hold while the lawsuit works its way through the courts.

After that ruling, the State Department quickly said people from the seven countries — Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen — with valid visas could travel to the U.S. The decision led to tearful reunions at airports round the country.

During his remarks at a law enforcement conference, Trump said the courts blocking his divisive immigration order "seem to be so political."

Trump's own Supreme Court pick, Neil Gorsuch, finds the president's comments about the judicial branch "disheartening" and "demoralizing," a spokeswoman for the nomination confirmation team told NBC News on Wednesday.

The Supreme Court has a vacancy, and there's no chance Gorsuch, will be confirmed in time to take part in any consideration of the ban.

The ban was set to expire in 90 days, meaning it could run its course before the court would take up the issue. The administration also could change the executive order, including changing its scope or duration.

It was to be expected (even if the DOJ lawyer was someone more competent instead of the stuttering twit that was sent).

Thats fine. The suspension will be implemented to cover a longer period probably in return after SCOTUS grounding on it....and expanded as seen fit by Trump. Any bad event that transpires in the mean time (god forbid) is just going to underline what Trump said...and there is little to no cost if such doesn't happen (given Trump is not a one issue person).

You don't give Trump some room, its fine he will take your house down the road.

I am beginning to get a feeling that Trump planned this all along so the real measures (on temporary bans based on USC 1182) can go smoothly and totally unchallenged down the road as the geopolitical environment and related intelligence gathering continues to evolve.

It doesn't hurt him one bit in the meantime to illustrate when he tried something quickly (as promised to his support base, who have rallied behind him, while opponents are fracturing), past the usual pace of wash DC, the leftist establishment resorted to their usual shenanigans....and he gets to heap another nov 8th moment on them again in the end.

Judge shopping will only have a bigger blowback on the democrats and their puppet-masters.

It does seem a bit silly that some judge in Seattle is able to make some decision that affects the entire US system. As you say now people (including Trump) are just going to go "judge shopping". Future Presidents will line up a sympathizing judge before an Executive Order is issued and beat the opposition by filing a suit in his court immediately. The judge will ok it and that's that.

Good point, I didn't even think of that. But doing such pro-actively means it still would go to the supreme court at some point I would imagine....though you are probably right that it would thus be upheld in the mean time (given the US is a common law system).

I guess the democrats really opened a can of worms here....maybe that was Trump's plan all along (and hence why he didnt do what you described this time....since his legal team would surely have brought it up). Trump has always pushed for law and order, so he probably wanted a SCOTUS ruling on it without getting his fingers in the muck of judge shopping. Let the opposition start it in desperation, he can then finish it with better discretion and luxury.

Guess we can wait and see....

What nonsense...you know how this works. Republicans have done the same in the past...don't make it out like we're covering new ground here :lol:

This is how it's always worked. Oh and the judge in Seattle...was appointed by a republican and was known as a 'good conservative'.

This 9th Circuit appeal court...3 judges heard the case, 2 liberal and one Bush appointee...the decision was unanimous.

Just because you don't like how it's worked out this time around, doesn't mean you cry.

The judiciary is not subservient to the executive branch - Obama wasn't allowed to and Trump won't be allowed to rule by decree.

The country isnt Russia, yet.

If Trump had sought proper legal advice, he would have come up with a EO that was constitutional....Alan Dershowitz(I'm sure you know who he is) has been begging to write it for him.

Even today, he said...Trump should rescind the current EO and rewrite a new one - doing the same thing...bans/vetting, adding more countries if necessary etc etc..but, wording it so it passed muster legally.

How can a state judge go against an executive presidential order i find amusing. Trump needs to take out the big guns and also get his supporters to "take care" of those rouge judges... use whatever means possible.

It was an unethical ban , which does not meets US standards the US public (51%) is a different beast vs the government officials who may act in intrest of corporations

However there were too many tagic stories emerging due to the unethical ban

Trump's decree was very "UN American"

While TRUMP was successful to sway , public (less educated) to bring him to power , the ideals of that demographics was severly against the certain moral standards by the Educated class in their nation

The stop of TRUMP order showed strength of their Legal system, in mere 2-3 weeks they sorted out the most chaotic decree in their recent history

Courts cannot legislate on morals and ethics. They judge on enforcement of the law. USC 1182 is crystal clear....so the SCOTUS will have the final say on the matter and it will be just like nov 8th for many.

It wasn't a state judge that made a decision, but a federal one. And it wasn't even a permanent ban, but for only 90-days, ostensibly to put in place a better vetting system for visitors.

Trump was clumsy that he picked these seven countries and then denied those with rightful immigration and refugee visas. It wasn't thought through, which is nothing new for Trump.

The idealogy of ban and segregation is very Indian in nature , caste system so I am not suprised Indians think it is normal "stuff"

Indians are used to such decrees , the "ideas such as shoot first and call it encounter" or kill first ask questions laters

Ban on passport holders from countries from residing in hotels etc

Example: Population segregation is very common in India, so one political group remains in power etc Modi etc This still happens just so that Modi's party can continue to win confirmed seats

Americans on other hand don't have that mindset for 50 years infact they believe in open door policy to immigrants ( at least that is what the educated circle believes), most educated circle folks call themselves and ackonowledge their status as Immigrants to US many generations ago

Order by courts to rebuild Demolished mosque in Ayodhiya would not be possible as hardliners would likely demolish the court

The Trump law was temporary (90 days - 120 days depending on your status as immigrant or refugee).

So your assertion falls completely flat that the majority of regular people would be permanently banned from Sudan from immigrating to the US. An athlete like the one you posted would simply have re-applied at later date and be subject to stricter vetting and would get through (given that such a person would be no threat on the information ascertained).

Trump basically brought it out into the open beforehand (unlike Obama who did it to Iraq covertly and information about it came out only afterwards) to rally his support base and to test the waters of how the establishment would respond (would they really muddy their hands judge shopping etc). He knows that the SCOTUS will rule in line with the legal right he has to make such a ban (again temporary and not based on colour, creed, religion etc) for various countries when a clear and present danger exists to the US public (decided by him solely, not any judge) by continuing prevailing status quo of inflow.
