UN not in position to judge Kulbhushan Jadhav's case, says world body spokesman

Too funny that Indians think world's silence on the subject is their victory. Kulbhushan is on death track waiting for execution and every "no comment" from the world takes him closer to death.

they have neither made comments supporting Indian narrative on yadhav just like they kept silent on URI attack and so called surgical strikes.

Actually UN condemned uri attack as well as Saudi Arabia and Turkey did.

Pakistan got humiliated as U.N. gave zero credence to multiple Pakistani dossiers.

so it was never asked while the MOUs were signed but all of a sudden they realized they have to have an access to Kasab as well knowing very well that it wont be allowed since it wasnt discussed prior to the MOU signed.

second thing that your link says is

The LeT’s lawyers say Kasab’s statement is inadmissible in Pakistani courts. So it’s not clear what would be achieved even if they got Kasab to retract his confession

so the lawyers were not even sure what is the prupose of demanding such access and ppl here are blaming us for not giving the access ?

once again you proved that indians live in delusion, UN neither took an action nor rejected the pak dossier, But how long ? UN has to accept the rightful dossier of pak or else there is no good of keeping UN at the place of justice. pak is not like india we always submit proof with final evidence whereis india always had lack of evidence
 
On India's involvement in terrorism in Pakistan, the file doesn't only have case of Kulbhushan. Case against India has many prongs, including support of TTP, MQM, BLA and secterian terrorism. Kulbhushan is one aspect of case against India. So no - UN hasn't given India a clean chit on terrorism charges.
Actually Pakistan itself admitted UN gave no trations to its dossiers on India.
Ambassador Lodhi had earlier in October 2015 presented three dossiers to the then secretary general Ban Ki-moon, which were said to be containing proofs of Indian interference in Balochistan, Federally Administered Tribal Areas and Karachi. But, the move did not get much traction.

When the attention of the officials was invited to the “credibility deficit” that Pakistan internationally faces, they expressed the hope that the UN would look into the fresh evidence that would be placed before it.

The United Nations on Wednesday declined to comment on the death sentence handed to convicted Indian spy Kulbhushan Jadhav and said the world body was not in a position to judge the case.

“We are not in a position to judge the process or to have a position on this particular case,” the UN secretary general's spokesman, Stephane Dujarric, said in response to a question from an Indian journalist at the regular noon press briefing.

The spokesman called for a dialogue between Pakistan and India, following heightened tensions between the two countries after Jadhav’s sentencing.

“Overall in terms of relations between India and Pakistan, we underline and continue to underline the need for the parties to find a peaceful solution and to engage through engagement and dialogue,” the spokesman added.

On Tuesday, Defence Minister Khawaja Mohammad Asif ruled out immediate execution of the convicted Indian spy and said three appellate forums are available to Jadhav under the law.

Jadhav's arrest and trial
Jadhav was arrested on March 3, 2016, through a counter-intelligence operation in Balochistan's Mashkel area for his involvement in espionage and sabotage activities against Pakistan, the Inter-Services Public Relations (ISPR) said in a statement on Monday.

Although the accused had been provided with a defending officer as per legal provisions, according to ISPR, Pakistan had turned down India's request seeking consular access to Jadhav last year due to his involvement in "subversive activities" in the country.

Jadhav was tried by the FGCM under Section 59 of the PAA and Section 3 of the official Secret Act of 1923, the statement said.

Jadhav confessed before a magistrate and court that he was tasked by Indian spy agency Research and Analysis wing to plan, coordinate and organise espionage and sabotage activities seeking to destabilise and wage war against Pakistan through impeding the efforts of law enforcement agencies for the restoration of peace in Balochistan and Karachi, the ISPR said.

Following the announcement, India summoned Pakistan's High Commissioner to New Delhi Abdul Basit on Monday and handed over a demarche saying, "If this sentence against an Indian citizen, awarded without observing basic norms of law and justice, is carried out, the government and people of India will regard it as a case of premeditated murder."

Dawn reported that Jadhav now has 40 days to file an appeal against the FGCM in the army’s court of appeal, according to retired Col Inamur Rahim, a military law expert.

In case the appeal court upholds the FGCM verdict, Jadhav would have the opportunity to seek mercy from the army chief and the president of Pakistan.

Simultaneously, Col Inam said, the convict could approach a high court if he felt that due process was not observed during his trial and his fundamental rights as an accused were not fulfilled.

Experts view the military's announcement about Jadhav's trial and prosecution as an unprecedented move, viewing it as a strong message to India as well as other foreign intelligence agencies.

UN can't do it because of India's isolation. Remember Pakistan is isolated and only India can talk with Pakistan

Question wasn't if India is involved in terrorism in Pakistan or not but weather Kulbhushan was given a free trial or not. UN responded by saying "We are not in a position to judge the process" which means they refused to comment on the prosecution process.

Yes, Thank you Captain Obvious for a good job- repeating what I had already stated. AGAIN MY OBSERVATION WAS- The report handed to the UN has already been on the floor and caught no traction whatsoever. The article quoted in the Original Post goes on to prove how the whole diplomatic attack with terrorism allegations was a complete failure. NO ONE besides you is calling him a terrorist. NO ONE believed the evidence Pakistan provided, no meetings since have discussed India's role in propagating terror.
Meanwhile using the same evidence Pak has sentenced Kulbhushan to death. And whats even funnier is knowing even less evidence ( since I believe not all the evidence has been released to the public ), and not having any access to court proceedings -you, the rest of the Pakistani population, and the Pakistani media are so sure that Kulbhushan is a terrorist.
That still stands. Read my first response to you- where I said that they do not doubt/wish to intervene in the internal Military Court process of your sovereign nation.
And I'll repeat my stand again- IF he is responsible for carrying out terror in Pak- he should be hung. But to the unbiased minds at the UN and EU- he still ins't a proven terrorist. Same goes for me- the evidence as it stands is very inadequate and knowing the where our two countries stand I can't for sure say he is a terrorist. Hopefully more clarity comes to this case.
