U.N. to issue Sri Lanka war crimes report demanding justice

I have already given my opinion and the entire issue ,I have given facts and even statements from the MR regime thanking the US for all the help MR govt even specially thanked the US for sensors and radars.

You said the US helped the LTTE during the without any facts and even when all the facts contradict your fantasy, and you keep repeating the same thing like a Brain dead zombie of MR.

Well first of all I must say that US didn't assist our armed forces. They just did their business. Doing business and supporting is two different things. I think you need to straight that out yourself.

Anyway I think that I oughtn't give any more facts about US support to LTTE than the visit of Robert O'blake during the last few days of the LTTE. It was very well reported that what he wanted.

Government opposes first draft text of resolution | Colombo Gazette

The Government today raised objections and concerns over the first draft text of the resolution on Sri Lanka which is to be tabled during the 30thsession of the UN Human Rights Council (UNHRC).

In a statement made during an informal consultation on the draft resolution on Sri Lanka organized by the Permanent Mission of the United States of America at the UN building in Geneva, Sri Lanka’s Ambassador to Geneva Ravinatha Aryasinha said that the text is reparative, judgmental and prescriptive and not in keeping with the spirit of the process of reconciliation and reform underway in Sri Lanka.

“Neither is it helpful in adopting a collaborative approach to reaching consensus. Many paragraphs in the current draft are in fact counterproductive to the reconciliation efforts of the Government and have the tendency to polarize communities, vitiate the atmosphere on the ground that is being carefully nurtured towards reconciliation and pace building and restrict the space required for consultation,” he said.

The informal discussion, which was also attended by the US Ambassador to Sri Lanka Atul Keshap, was held to discuss the draft of the resolution through which Sri Lanka is looking to seek support for a domestic process to investigate and address alleged human rights abuses and war crimes.

“There is real danger that the current approach will leave room for negative interpretation thus only helping spoilers in the process,” Ambassador to Ravinatha Aryasinha said at the discussion.

He also said that emphasizing excessively on the criminal justice aspects, makes the resolution imbalanced.

“It would be more helpful to have a holistic approach when making recommendations in the resolution on promoting reconciliation in Sri Lanka,” he added.

The first draft of the resolution notes that it welcomes the oral update presented by the High Commissioner to the Human Rights Council at its twenty-seventh session, the report of the Office of the High Commissioner for Human Rights on promoting reconciliation and accountability in Sri Lanka and the report of its Investigation on Sri Lanka requested in Human Rights Council resolution 25/1 including its findings, and conclusions, and calls upon the Government of Sri Lanka to implement the recommendations contained therein.

It also encourages the new Government of Sri Lanka to respect its positive commitment to bolster and safeguard the credibility of these justice processes by engaging in broad national consultations with the inclusion of victims and civil society, including non-governmental organizations, from all affected communities that will inform the design and implementation of these processes, as well as assistance from international experts and the international community throughout the process, and to ensuring strong and effective witness and victim protection measures are in place.

It also calls upon the Government of Sri Lanka, to involve international investigators, prosecutors and judges in Sri Lanka’s justice processes and review and, where required, reform domestic law to ensure that it allows for prosecution of the full range of crimes under domestic and international law involving violations and abuses of human rights and violations of international humanitarian law.

The first draft, which was released last Friday also urges the Government of Sri Lanka to investigate all alleged attacks by individuals and groups on journalists, human rights defenders, members of religious minority groups and other members of civil society, as well as on temples, mosques and churches, and to hold perpetrators of such attacks to account and to take steps to prevent such attacks in the future.

It also urges the Government of Sri Lanka to credibly investigate widespread allegations of extrajudicial killings and enforced disappearances, demilitarize the north and east of Sri Lanka, implement impartial land dispute resolution mechanisms, re-evaluate detention policies, strengthen formerly independent civil institutions, reach a political settlement on the devolution of power to the provinces, promote and protect the right of freedom of expression for all persons and enact rule of law reforms, (HRC 25/1)

It also requests the Office of the High Commissioner to assess and verify the human rights situation in Sri Lanka; to continue to assess progress on the implementation of OHCHR’s recommendations and other relevant processes related to reconciliation, accountability, and human rights; to present an oral update to the Human Rights Council at its thirty-third session, and a comprehensive report followed by discussion on the implementation of the present resolution at its thirty-fourth session.

After articles even from well renowned nationalist commentators highlighting them..The best you could come up with is " However AFAIK MR gov. tried their best to keep the integrity of SL response to UNHCR resolutions until 2015. Where did I denied what MR has done. I openly said he made critical mistakes handling the UN report in my last comment. It was you who got your butt hurt for erroneously assuming that I denied everything. That my friend is not right.

However I was hoping you would reply to the questions I posted cuz I believe that they are critically important to compare our views on the matter at hand. Otherwise we can argue about what had happened and what will happen forever with breaking any ice.

The Office of the United Nations High Commissioner for Human Rights (OHCHR) has defended the findings of its report on alleged war crimes in Sri Lanka, which drew criticism from several quarters for its “silence” on genocide in the island nation.

Responding to a question sent by The Hindu in this regard, Ravina Shamdasani, spokesperson for the High Commissioner, stated via email: “This [the U.N. report] does not preclude such a finding [that genocide was committed] being made as a result of further criminal investigations, including by the hybrid court that we recommend.”

“The crime of genocide requires specific objective and subjective elements. On the basis of the information we were able to gather, we did not come to the conclusion that these elements were met,” she said.

In February, Sri Lanka’s Northern Provincial Council passed a resolution, blaming successive governments in the country of committing “genocide” against Tamils.

The spokesperson pointed out that given the circumstances in which the investigation was carried out, the OHCHR was able to conduct “a comprehensive investigation”, with over 3,000 written submissions, interviews in 11 countries, photos, videos, and satellite imagery with expert analysis.

However, criticising the report on different counts, including that of relying on the testimony of people whose identity has been kept confidential, former Foreign Minister of Sri Lanka, G.L. Peiris, argued that the “purported evidence, on which critical findings are based, is shrouded in secrecy”.

“There is, consequently, a breach of the requirements of fairness and transparency even at the basic level.”

He contended that Sri Lanka had every opportunity to use well-established principles of international humanitarian and human rights law, applied with “reasonable uniformity in precedents” across the globe, to make a cogent case for the protection of the military personnel. “Sadly, we seem to be treading instead a different path fraught with the greatest danger.”

What a misleading caption under the pic.. The UN rules out genocide in it's findings.. Which is well known to everybody but is being propagated by Tamil separatists in Europe and Tamil Nadu and affiliated NGO's.

The Hindu is considered credible news out let in India, Which is very rare.. This is a major faux pas on their part

The government will soon set up several commissions including a South African-style parliamentary truth commission, a compassionate commission and a permanent office to look into disappearances, Prime Minister Ranil Wickremasinghe told parliament today.

Making a special statement in Parliament, he said advice will be sought from South Africa to set up the truth commission but it would not be a carbon copy of what South Africa itself set up in that country.

The Prime Minister said the compassionate commission will comprise leaders of all religions and would be under the purview parliament.

He said permanent office to look into disappearances would be within the precincts of parliament and would be mandated to provide information on the missing and provide compensation to the families of those gone missing.

"For this the government will obtain the advice of the International Red Cross," the Prime Minister said and added that special courts would be set up to provide redress to mete out justice to those who have been affected by the armed conflict.

"These measures are being adopted by the national government not with the intention of satisfying the international community but in an effort to bring about much needed reconciliation and to avoid such conflicts and misunderstandings in the future" he said.

The Prime Minister assured parliament that none of these mechanisms would contain parts brought down from abroad," he said.

He underlined the fact that the reason for the international community to develop a negative attitude towards Sri Lanka because nothing was being done to bring about peace and reconciliation after the armed conflict ended in 2009 in line with the assurance given to UN Secretary General who visited Sri Lanka that year. LLRC report highlighted certain suggestions that gov. should initiate to bring reconciliation. But that does not necessarily mean everything LLRC report highlighted and suggested are right. Gov. have the authority to choose what to implement and what to discard. No one including UN has any say about how we should implement the suggestions. If they do it will become unnecessary meddling of internal affairs of a country. And it is very unreasonable to say that nothing has done to implement the LLRC. Maybe no suggestion was implemented that will enhance the separatism in Sri Lanka again. Maybe that is what you say as nothing was done.

Moreover Ban ki Moon was scheduled to visit SL during the last few days of the conflict. He was intended to go to the Pudumathalan. MR knew it and strategically went abroad instead. Anyway Ban ki Moon visited SL right after the end of the conflict and MR said we will do things to bring reconciliation again. Maybe MR said he would conduct an investigation. But he didn't say when.

These talks about LLRC and reconciliation are really BS. US (includes UN, Canada, Norway and the European bunch) wanted to frame us since may 2009 for what we have done. The only reason US is after us is the death of Prabhakaran.

LTTE was a terrorist organization. How on earth a self respecting country unfreeze known terrorist assets. US had to do it. But they never freeze assets of TRO, GTF and the like fully knowing they funneled the money to LTTE. Anyway there were not much LTTE activity happened in US soil. Most of it happened in Canadian and European soil. And I feel by mentioning US I'm unknowingly criticize the USA only. The criticism should extend into Canada and Europe also.

There is a UN investigation for SL because MR finished the war. Are you that dumb to realize that?
