Thanks to ALLAH for showing a safe way to COAS through legal , constitutional lines . In Shaa ALLAH for further extention it requires only simple majority in NA which is easy IA.
Why the **** do we need to go from this hassle and turmoil beacuse of a single man. It's like undermining the entire army and thereis no other capable general.
It's simple Bajwa is gonna stick till 2023 to make sure PTI wins again....

Prime Minister Imran Khan has ruled out a clash of institutions in the country.

Minutes after the Supreme Court allowed Army Chief Gen Qamar Javed Bajwa to stay in his office for another six months, Prime Minister Imran Khan reacted to the top court's judgement, calling it "a great disappointment to those who expected the country to be destabilised by a clash of institutions".

Taking to Twitter, he said the fact that a clash of institutions was averted "must be of special disappointment to our external enemies and mafias within - Mafias who have stashed their loot abroad and seek to protect this loot by destabilising the country".

In another tweet, Prime Minister Imran said 23 years ago, the PTI was the first political party to advocate for an independent judiciary and the rule of law. In addition, he said the PTI was at the forefront of the Movement for Independence of the Judiciary in 2007 and he was "jailed for it".

"Also, for the record, I have the greatest respect for CJ [Chief Justice Asif Saeed] Khosa, one of the greatest Jurists produced by Pakistan," the prime minister wrote.

The Supreme Court earlier today in its short order announced that Gen Bajwa will remain the Chief of Army Staff (COAS) for another six months, during which the parliament will legislate on the extension/reappointment of an army chief.

A three-member bench — comprising Chief Justice Khosa, Justice Mian Mazhar Alam Khan Miankhel and Justice Syed Mansoor Ali Shah — announced the much-anticipated verdict after being assured by the government that parliament will pass relevant legislation within six months.

'Matter resolved'
Commenting on the SC judgement, Foreign Minister Shah Mehmood Qureshi while talking to DawnNewsTV said the government had tried to assist the court and address its concerns. "I think this matter has been safely resolved and I do not see any ambiguity in it now," he added.

Answering a question, he said the government will not need to amend the Constitution in order to carry out legislation as per the Supreme Court's instructions.

Qureshi said there was "nothing lacking" in the government legal team's performance in the top court, and that the procedure explained by them was based on past precedents.

A cabinet meeting will examine the SC verdict and take appropriate measures because the country "cannot afford any sort of crisis at this stage", he added.

The minister noted that although the issue of the army chief's tenure is Pakistan's internal matter, "celebrations were being held in India" because it wanted to create instability in the country.

In response to a question regarding whether the government will use the legislation in this case to assert civilian supremacy, Qureshi said the government will maintain its "functional relationship" with the country's security institutions as it has since the start of its tenure.

"I want to state clearly, the authority to [grant] an extension rests with the executive," he said, adding that Prime Minister Imran had approved the extension under the Constitution.

ISLAMABAD: It has been a pattern in recent times of heating judicial activism that an intriguing individual comes up with a petition on burning political/ constitutional issue and triggers a debate and suddenly disappears.

Same was repeated on Tuesday when a petitioner threw almost certain extension/ re-appointment of Army Chief General Qamar Javed Bajwa in doubt. It was Riaz Rahi who challenged General Bajwa’s tenure first and later moved an application to withdraw the petition but the top judge, however, rejected the plea, observing it fell into the domain of public interest under Article 184 (3) of the Constitution.

In April 2018, Riaz Rahi challenged appointment of Justice Qazi Faez Isa as judge of the Supreme Court of Pakistan. The timing and ground of the petition against the Chief of Army Staff was very important as General Qamar Javed Bajwa has to retire tomorrow, Nov 28, 2019. Similarly, the timing of filing petition against Justice Qazi Faez Isa as the SC judge and his appointment as the Balochistan High Court chief justice in August 2009 looked like one such effort to undermine the credibility of a jurist who otherwise was known to be as an upright man among the legal fraternity. Now judge Faez Isa is facing a trial in the Supreme Judicial Council (SJC) as well as in the apex court.

In March 2018, Riaz Rahi filed two contempt petitions against ex-premier Nawaz Sharif. On Dec 2013, the IHC rejected Riaz Rahi’s petition challenging the constitution of a special court for the treason trial of former president Musharraf. On July 10, 2017, Riaz Rahi filed a petition seeking a halt on transfers and postings of all public servants on the directions of then PM Nawaz Sharif until the final decision of the Panama case was announced in the apex court. All petitions were dismissed and this list goes on with Justice Faez Isa’s fine of Rs10, 000 imposed on Aug 13, 2015. The Islamabad High Court (IHC) Justice Shaukat Siddiqui imposed a fine of Rs100,000 on Riaz Rahi in 2014 and then after a few months, Justice Athar Minallah of the IHC fined him Rs10,000 on filing frivolous petitions challenging the judicial policy and electoral system of the country and for withdrawal of security from former CJP Iftikhar Muhammad Chaudhry. Justice Sheikh Hakim Ali of the Lahore High Court, Bahawalpur bench, had jailed Riaz Rahi for one month for contempt of court and also fined Rs30,000 in 2005 when he, during the hearing of his case, misbehaved with the judge. In March 2010, Riaz Rahi challenged reinstatement and appointment of the then CJ Iftikhar Muhammad Chaudhry and Justices Ghulam Rabbani and Khalilur Rehman Ramday but later his entry into SC premises was temporarily blocked. On Dec 17, 2013, Riaz Rahi challenged the creation of a special court to try former president Pervez Musharraf for high treason in the IHC. On April 15, 2009, Riaz Rahi filed a writ petition in the IHC challenging the notification of Justice Sheikh Hakim Ali as a Supreme Court judge. On August 8, 2017, Riaz Rahi lodged petition against ex-PM Shahid Khaqan Abbasi’s order of forming a committee to probe MNA Ayesha Gulalai’s allegations in the IHC.

Riaz Rahi, despite repeated attempts made by The News to take his viewpoint, did not respond.

This will remove constitutional problems for future Army Chiefs as well . if he faced it he did it for his Institution future clarifications n will help in war or emergency situations n nobody in future will challenge it in SCP . In Pakistan we dont know what will happen tomorrow ( killings of PMs n COAS , wars , martial laws in Past e.t.c ) n u are talking about 2023 ???

Dear friends , most corrupt hiring system in Pakistan is for Judges , just look at how we put them in in High courts , you all may remember Salman Taseer VS Shabaz Shreef ON appointment of Lahore high court Judges ,,,, those and these appointments always payback mostly .. lol .. If army act can be changed and if Army chief appointment (sole authority of PM) can be challenged and ridicule like that , Why Not Appointing (hiring) system of these so called Judges ? Time has come.
This should be change now . Just like Army act and Parliament Should decide , As you all know(remember) current system is enforced by 1st political CJ Iftikhar Choudry(no free will of Parliament is there).
Some Suggestions :
  1. No direct hiring of Judges for High Courts from (Political) Bars.
  2. 7 years experience as lawyer for lower judiciary and then test (some thing like CSS). Education Must be M.A LLB. And then hire for lower Judiciary.
  3. 15 years experience in lower judiciary then test (not extremely strict) , back ground check , history in lower judiciary check ,, if Pass then 1 year training for high court.
  4. 10 years in High Courts , reports should be made .
  5. Then President should and will decide (which one) who will join SC , PM/cabinet and Parliament have no say into this . President will chose Judges from High courts for Supreme Court and ONLY President will appointe CJ.
 
The court has just made the extension of COAS a public joke. Nonetheless, supreme court didn't need to question the prime minister's decision, as it's so legitimate and followed to multiple precedents in the history and he also possess the constitutional right to do so. I believe that the courts should set their priorties to better have settled the hundreds and thousands of pending cases, instead of making such issues, not relevant to them, a news headline for the public.
Besides, I've failed to understand the procedure adopted by the court that when a person files a suite for begging justice, he's been given dates for hearing till years and when such scruples petitions are filed, they just start hearing immediately with skepticism .

You are right. Now, these scoundrel judges are trying to damage PA, as far as they can. Whether knowingly, or inadvertently, they are becoming tools in the hands of enemy states and their agents.
