LONDON: Former National Accountability Bureau (NAB) chief Lt Gen (retd) Syed Amjad had told a British court that the accountability watchdog’s agreement with Broadsheet was signed without getting approval from the concerned government departments.

“Broadsheet did nothing to bring back wealth looted from Pakistan,” said the former NAB chief. He also added that former prosecutor general of NAB, Farooq Adam Khan’s son, used to work for one of the partners at Broadsheet.

Amjad also claimed that Broadsheet used information provided by NAB against the "targets" mentioned by Pakistan.

“Broadsheet could not provide any useful information to NAB nor did it help in bringing back [looted] money,” said the former lieutenant general.

The former head of NAB had visited Broadsheet's office in Colorado in April 2000 where he signed the agreement with the company.

It has been reported that during the visit the Pakistani delegation was given a presentation based on fake information.

The scandal


The Broadsheet case has caused a political storm in Pakistan ever since NAB lost the case in a British court forcing the government to millions of dollars to the asset recovery firm.

PM Imran Khan took notice of the scandal after court documents revealed that the accountability bureau made a deliberate decision to disregard financial damages that may be caused to Broadsheet LLC by entering into a settlement with an unauthorised individual and paid around $1.5 million to a fake firm.
The arbitration court that heard the case - Broadsheet LLC vs. The Islamic Republic of Pakistan and the National Accountability Bureau - was chaired by Sir Anthony Evans. The court's ruling titled Part Final Award (Liability issues) was handed down in August 2016 under the Chartered Institute of Arbitrators, Case No. 12912001.

The case details the whole saga from establishing NAB to signing and then three years later rescinding the agreement between the NAB and Broadsheet LLC, breach of the contract, illegal payments from Pakistan to wrong entities; and all that led the court to ascertain that NAB was involved in intentional wrongdoings.

The anti-graft body and Broadsheet had signed the agreement in June 2000, which was breached by Pakistan in October 2003.

The judgment documents reveal what the arbitration court had concluded that the claimant [Broadsheet LLC] was entitled to recover damages from the respondents [the Islamic Republic of Pakistan and the National Accountability Bureau] for the "tort of conspiring to cause unlawful economic loss to the Claimant by entering into the Settlement Agreement dated 20 May 2008 with Mr. James and companies controlled by him and/or in making payments to him or them thereunder."

Payment to Broadsheet: NAB’s mistake inflicts heavy loss to national kitty

ISLAMABAD: Broadsheet case has taken another turn as it has emerged that the national exchequer had to suffer loss of millions of rupees due to alleged mistake of the National Accountability Bureau (NAB) while paying damages on the order of Arbitration Court of London.

The NAB did not deduct 15 percent withholding tax while paying $28.7 million as damages in Broadsheet case. The Federal Board of Revenue (FBR) has sent a notice to pay Rs60.9 million.

According to reliable sources, a notice was sent to NAB to pay Rs60.9 million ($40.3m) to the FBR. The notice was sent to DG NAB Headquarters on behalf of International Tax Department of FBR under Section 152 of FBR Ordinance.

It was stated in the notice that it had come to the knowledge of tax department that NAB had paid $28.7 million damages to Broadsheet LLC. It was also stated in the notice that the NAB had to deduct 15 percent withholding tax and deposit to the national exchequer at the time of paying $28.7 million under the Income Tax Ordinance, but it was not followed.

Under the Income Tax Ordinance, the withholding agent has to pay this tax if the withholding agent does not deduct tax. It means that the NAB, as a withholding agent, will have to pay non-deducted tax amount. The FBR directed NAB to deposit Rs60.9 million with the national kitty.

Earlier, an Arbitration Court of London had imposed $20 million fine on NAB in Broadsheet case. However, the NAB had to pay extra $9 million under the head of mark-up due to non-payment on time. The court in London had withdrawn over $28 million partially in this regard by freezing accounts of Pakistan High Commission.

FBR demands $4.3m in taxes from NAB over Broadsheet payment

ISLAMABAD: The federal revenue body FBR has issued Thursday a notice to National Accountability Bureau (NAB) demanding from it taxes against the $28.7 million payment the accountability watchdog made to Broadsheet company, ARY News reported.

According to the notice the tax amount comes at $4.3 million which the FBR authorized saying it is due to the supremacy of law which everyone is responsible for.

The revenue body has issued the tax notice to the Director General of NAB headquarters saying that against the payment made to Broadsheet a tax amount of $4.3 million dollars was to be deducted in withholding taxes payable to FBR.

The notice said that according to the rules, the amount meant to be paid to Broadsheet was to incur withholding tax deduction which is 15 per cent of the total amount. It translates to $4.369 million.
Separately earlier today, the federal government has prepared the terms of references (TORs) for an investigation into the Broadsheet scandal by a one-member commission headed by former apex court judge Justice (retd) Azmat Saeed.

The TORs for the Broadsheet investigation commission would be approved by the federal cabinet through a summary circulation process.

The commission would look into agreements with IAR Ltd, Broadsheet and Trouvons LLC in 2000 and another agreement with Broadsheet and IAR Ltd in 2003.
