A tribunal of eleven eminent judges has unanimously found the Sri Lankan Government guilty of the crime of genocide against ethnic Tamil people.

Sitting in Bremen, from 7 – 10 December, 2013, the Second Session of the Peoples' Tribunal on Sri Lanka found that the crime of genocide has been and is being committed against the Eelam Tamils as a national group.

The Tribunal found that genocide against the Eelam Tamil group has not yet reached the total destruction of their identity, however the genocide is a process and the process is ongoing; the military killings of May 2009 have been transformed into other forms of conduct causing serious bodily and mental harm to members of the group.

The Tribunal considered that the proof established beyond any reasonable doubt that the following acts were committed by the government of Sri Lanka:

a) Killing members of the group, which includes massacres, indiscriminate shelling, the strategy of herding civilians into so-called "No Fire Zones" for the purpose of massive killings, targeted assassinations of outspoken Eelam Tamil civil leaders who were capable of articulating the Sri Lankan genocide project to the outside world

(b) Causing serious bodily or mental harm to members of the group, including acts of torture, inhumane or degrading treatment, sexual violence including rape, interrogations combined with beatings, threats of death, and harm that damages health or causes disfigurement or injury

(c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or part, including

*expulsion of the victims from their homes

*seizures of private lands

*declaring vast areas as military High Security Zones (HSZ) to facilitate the military acquisition of Tamil land

The Tribunal undertook to further examine allegations of forced sterilization and contraception of Tamil women.

The UK and USA were found to be guilty of complicity in the crime of genocide, including complicity by procuring means, such as weapons, instruments or any other means, used to commit genocide, with the accomplice knowing that such means would be used for such a purpose; and complicity by knowingly aiding or abetting a perpetrator of a genocide in the planning or enabling of such acts.

The Tribunal recognised that Sri Lanka did not have the capacity to achieve genocide without assistance and on the basis of evidence provided came to the conclusion that the UK, USA and possibly India are guilty of complicity. However due to the constraint of time the Tribunal limited its findings to the UK and the USA pending the availability of further evidence against India and other States not yet identified.

US releases photos of civilian casualties of Sri Lankan civil war | Firstpost

Colombo: In a significant move coinciding with the visit of a top US official probing war crimes, American embassy here today posted pictures of places where civilians had died allegedly during Sri Lanka's final war against rebel Tamil Tigers four years ago.

The US embassy's official Twitter handle uploaded a photo with a caption saying, "St Anthany's Ground-site of Jan 2009 killing of hundreds of families by (Lankan) army shelling".

Sri Lanka had for long dismissed accusations that army had fired shells at civilian locations.

In May 2009, Sri Lankan military had defeated the Tamil Tiger rebels. Colombo has resisted calls to probe claims that over 40,000 ethnic minority Tamils were killed by the military during the final phase of the civil war.

The Twitter account also posted other photos of the final battle zone where the LTTE and the army had declared no fire zone to allow Tamil civilians to flee the conflict area.

Rapp's visit met with a protest opposite the US embassy. A nationalist group slammed the US for interfering in the country's internal affairs.

A protest was sparked when Rapp told the main Tamil party TNA that the March resolution would push for a international war crimes investigation.

Nope! Improving standards of living for poor Tamils in those areas is considered as a big sin by these LTTE baboons. Train some terrorists, send arms and make a hell for ordinary citizens in Sri Lanka. Now that's righteous.
 
I wonder how will India react to US backed resolution after "The ambassador incident". Indian member please shed some light on it.
 
Let me end this argument once and for all.

The legal context for the word 'genocide' arises from the General Assembly Resolution 260 adopted by the UN on the 9 December 1948.

Now when we determine if a crime has occurred, first thing we do is determine is there a 'cause of action' i.e legal precedence. The next thing we do is determine weather we have legal jurisdiction. Only after these two elements of Law have been satisfied can we then look into evidence to support the violation of a law and thus the commission of a crime.

GAR 260 was Acceded by Sri lanka on 12 October 1950.

GAR 260 requires all signatories to the treaty to be in compliance with one another. As I cannot see "Eelam Tamil" being a signatory to the treaty, Sri lanka remains to be in compliance with GAR 260.

In relation to jurisdiction, the UN does not have jurisdiction in Sri lanka.

As such a treaty is made in law in two ways, either acceded or ratified. Prior to ratification or accession, a country normally reviews the treaty to determine whether national laws are consistent with its provisions and to consider the most appropriate means of promoting compliance with the treaty.

Most commonly, countries that are promoting the convention sign shortly after it has been adopted. They then ratify the treaty when all of their domestically required legal procedures have been fulfilled. Other countries may begin with the domestic approval process and accede to the treaty once their domestic procedures have been completed, without signing the treaty first.

In conclusion I find that GAR 260 has jurisdiction in Sri lanka, and any corporates in violation of GAR 260 can be prosecuted and dealt with by Sri lankan courts in accordance to manner dictated by Law. I am also satisfied that breach of GAR 260 has not occurred by any individual with the Sri lankan Defence force engaged in hostile combat operation against "Eelam Tamil"

Therefore I am satisfied that the Sri lankan Armed Forces has maintained compliance with GAR 260.
 
the biggest sin that SL did is not killing the remaining terrorists too after 2009..11,000 terrorists have been rehabilitated ! Some of them are in parliament ! why on earth SL gov do that ? Do these terrorists deserve to live like normal people after what they`ve done to this country for 30 years ? They should be prisoned for life time or shot dead as they are a threat for Sinhalese , Muslims , christians , malays and also for that handful number of non terrorist tamil immigrants.

It is absurd that gov spending tax payer money to give free houses , give free electricity and schooling for the remaining tamilians .most tamils in north are people who helped LTTE terrorists..they deseve what they got and they shouldn`t get anything for free imo..if they don`t like it here they should be kicked back to their homeland in TN

I assure you that any individual with an adverse security assessment will not be eligible for rehabilitation programs.

I am not aware of any GoSL program which provides free houses, electricity and schooling to the populous in question.

India aided and abetted the ethnic cleansing of Tamils in Lanka. These houses if and when constructed will help the Sri Lankan government colonise the Tamil homeland. India can only fund and build these houses but the Sri Lankan military administration decides who gets them. Tamils or India has no say in that.

If India is to built hospitals , just ensure genocidal Sinhalese regime won't use the same hospital to forcefully sterilize Tamil women.

If you are referring to the northern province as 'Tamil homeland', I advice you that the Sri lankan government already maintains command and control over the northern province, a territory under the jurisdiction of the GoSL.

I assure you that GoSL does not need 'help' colonizing the northern province, when it is has already colonized it.

why are you acting silly ? The North, East and NE of Lanka prior to independence from British and current occupation by Lankan military, have traditionally been Tamil homeland, if you push back history by a few 1000 years, the whole region now known as Lanka was part of Tamil kingdom

Prove it. Even I can say Tamilnadu was once Sinhala Territory under the king Rawana. But you will laugh at me cuz there are no evidence and logic to it. Like wise now I'm laughing at you.
