Since the destruction of his country, this is the first time that the son of Gaddafi speaks publicly.Released for some time and under the protection of certain loyalist tribes, he wrote (in Arabic) this memorandum, published exclusively by the secret Tunisia site, to take stock of the legal and political situation of his country and to bring the contradiction at the International Criminal Court.

This memorandum aims to identify what the Libyan people have suffered in the last six years.These crimes were committed in the name of humanitarian interventionism, the protection of civilians, the introduction of democracy and prosperity. NATO forces, with the help of some Arab states and some Libyans, attacked Libya with all the means at their disposal. The justifications advanced were as false as for the invasion of Iraq in 2003. It was a systematic destruction of a sovereign country and a peaceful nation. This note attempts to present these crimes to the international community, human rights organizations and NGOs, in order to support Libya and its people in their countless efforts to rebuild this small country.

Libya at the crossroads: in the beginning

The agony of Libya began on February 15, 2011, when a number of citizens gathered quietly to protest the incident in Abu Salim prison. The demonstration was quickly held hostage by elements of jihadist groups such as the Libyan Islamic Fighting Group (LIFG). These elements attacked police stations and army barracks in Derna, Benghazi, Misratah and Al-Zawiya to steal weapons and use them in their planned war against the Libyan people and their legitimate government. All these actions were accompanied by a machine propaganda channels Aljazeera, Al-Arabiya, BBC, France 24 and others who encouraged the Libyan people to confront the police who tried to protect government buildings and private property from attacks and looting.

Horror scenes took place in the streets, on the bridges and in security forces buildings where protesters committed unspeakable crimes contrary to all humanity. Members of the security forces, military and police were slaughtered, their hearts were extracted from their bodies and cut into pieces; a spectacle of brutality and indescribable savagery. For example, on the first day of unrest, on February 16, 2011, in the city of Misrata, the so-called peaceful protesters killed and burned a man, Musa Al-Ahdab. The same day in Benghazi, a police officer was killed and dismembered [1 ]. These barbaric acts were committed by armed persons using tanks, machine guns and anti-aircraft machine guns in the cities of Misrata, Benghazi and Az Zaouiyah [2 ].These scenes are well documented and can be viewed on YouTube [3 ] and on social networks.

Thus, the victims fell by dozens contrary to what was reported by biased media. According to Aljazeera, and Libyan opposition groups, by the end of 2011, the number of people killed was 50,000. However, in 2012, the government of Abdel Rahim al-Kib announced that the number of victims registered between February 17, 2011 and the end of the war in October 2011 was 4,700-including deaths from natural deaths. [4 ] Despite the very high number of victims mentioned by statistics, their names and identities are not disclosed and no family has asked to be compensated by the government.

The propaganda campaign and the lies that accompanied the accusations against the military did not stop at the inflation of the victims, but claimed that the regime used military planes to attack civilians, ordered mass rapes to the army and security forces, [5 ] with Viagra found in tanks [6 ], resorted to African and Algerian mercenaries, and had to cope with flight defections to Malta [7 ]. None of these imputations has been proven to date and does not correspond to any truth whatsoever. Investigations by the UN, Amnesty International and Human Rights Watch [8] ] could not verify any of the 8,000 kidnapping cases reported by the Libyan opposition. In reality, all these imputations were made by Al-Jazeera and are devoid of credibility. Identically, the charge of using Mirages at Al-Weathy airbase, in the far west of Libya, to attack civilians in Benghazi has no weight since these planes could not go return considering their fuel consumption. It is impossible for this type of aircraft to attack targets at 1,500 km and to return without refueling, and there were air bases around Benghazi that could be used by the Libyan government if necessary. Similarly, Viagra allegedly found in the chariots comes out of the same trap: Libya had a young army, professional and moral, who did not think of committing such crimes and did not need Viagra to activate his sexual desires. These fabricated stories are simply poisonings comparable with the seven minutes needed for Iraqi weapons of mass destruction to attack the West. Today, Iraqi and Libyan affairs have begun to make people in Iraq, Libya, the United States and Europe laugh. The International Court of Justice (ICC)

The ICC (International Criminal Court) [10 ] issued in 2011 a warrant for the arrest of Muammar Gaddafi, Saif Al-Islam Gaddafi [11]. ] and Abdallah Senoussi, accused of crimes against humanity. Despite the seriousness of the crime, the ICC did not conduct any field investigations and drew its conclusions and identified the perpetrators within two weeks of being seized by the UN Security Council. The timetable given to the prosecutor was not presented and he did not have the necessary time anyway to specify the penalties incurred. To this end, Ahmed Al-Jehani, the coordinator of the CNT CPI-Libya, said that "The ICC case against Libya is purely political because NATO members have asked the National Transitional Council (NTC) to draw up itself the list of officials who would be accused of crimes against humanity ". The CNT has appointed Al-Jehani to prepare this list of about ten names, however the ICC has retained only three. Al-Jehani also added that all charges were fabricated. He reaffirmed his point of view during his meeting with Saif al-Islam and assured him that the Libyan justice could not convict him. Al-Jehani added that with his team, he had made this case because they knew it was lost in advance, and that they pursued it in order to implicate Saif al-Islam in financial and corruption cases. .

Al-Jehani justified his fabrications and lies by claiming that they are [religiously] lawful during the wars (al-Jehani statement documented on 1 January 2012 and at the Al-Zintan court).

The ICC has adopted a double standard on the war in Libya and NATO intervention. It involved Libyan political figures in invented crimes while ignoring and condemning the barbaric massacre of Muammar Gaddafi [12 ] and his son Moatassem by NATO-backed militias [13]. ]. The only reaction of the ICC was to drop the charges against Muammar Gaddafi after his death. However, the ICC was a solid case, as the media had documented the murder well, there was no need for additional evidence to bring those responsible to justice. The ICC could easily arrest perpetrators who assume political and diplomatic responsibilities in various European capitals. A similar position was taken by the ICC against Abdallah Senoussi after he was kidnapped in Mauritania by the Libyan government [14] ]. The Court merely stopped requiring extradition. It did not even follow the violation of its rights, nor the inhuman treatment it suffered in the militia prison, even though it was held by well-known jihadists, the Libyan Islamic Fighting Group (GICL). The director of the prison was none other than the head of the GICL, Abdelhakim Belhadj.

Belhadj is well known to the CIA and Western governments. The CIA arrested him after his escape from Kandahar, interrogated and extradited to Libya in 2002, accusing him of terrorism. [15 ] In 2009, he and members of the GICL were released from prison under the General Amnesty Law [16]. ]. The terrorist record of Belhadj speaks for itself. In 1994-1997, he ordered the massacre of 225 people. In 1997, he ordered the murder of German tourists Steven Baker and his wife Manuela Spiatzier. Nevertheless, he assumed a senior position in Libya. He was Minister of Defense and Security Officer in Tripoli, Director General of Libyan Prisons and as such directly responsible for Abdallah Senoussi's cell. Informed of Belhadj's criminal record, the ICC expressed its assurance that Al-Senussi was in good hands and supported his trial in Libya.

NATO and some Gulf states have ignored Belhadj's terrorist activities and recognized him as both a political and military leader and a businessman. It has the largest TV channel in North Africa, the largest airline in Libya, a cement plant, properties in Spain and Turkey and a private airport in Tripoli. This airport, however, was used to transport terrorists from Libya to Syria.These terrorists were funded to the tune of $ 160 billion in 2010.

Belhadj and others are responsible for the misuse of Libya's assets and for ending the $ 200 billion Libya development plan, according to the World Bank. Belhadj, the man from Qatar, is an example of the sumptuous life of the warlords as ordinary Libyan citizens are plunged into extreme poverty.

Human Rights Violations by Militia Militia

Commanders and Warlords have committed despicable crimes against humanity, destroying cities and vital infrastructure over the past six years. Among them:

People were burned, cooked alive, and subjected to the most abject forms of torture.
Political prisoners, security agents and soldiers were thrown into the Misrata smelter.
Above all, the militias organized a trafficking of human organs taken from the prisons.
In the context of the complexification of the Libyan political scene, Daesh has also added other atrocities by massacring, crucifying and emasculating people.

An unprecedented racial and ethnic cleansing, genocide, was committed against five Libyan cities and its people. 55% of Libyans were forced to flee their country to neighboring states. In addition, hundreds of houses were burned in Bani Walid [17 ] and in five other cities of Warshafana, [18 ] the city of Sirte was destroyed [19]. ] populated residential areas were bombed in Benghazi [20 ] and Derna. Even Tripoli the cosmopolitan endured ethnic and racial cleansing especially in areas loyal to Muammar Gaddafi.

In addition to systematic violations of human rights, militias and their leaders have destroyed critical infrastructure. [21 ] In July 2014, they set fire to the Tripoli airport and the air fleet as well as the oil reservoirs numbers 24 and 25 [22 ] [23 ] [24 ] [25 ].

Despite the destructive actions of militias and brutal torture, the international community and UN bodies have ignored these crimes and have not brought these warlords to justice. [26 ]

The atrocities of NATO and Libyan militias against civilians and public figures

NATO planes targeted civilians in various cities, namely Zlitan, Sirte, Surman, Tripoli and Bani Walid. In southern Zlitan and specifically at Majeer [27 ], 84 families, mostly women and children, were killed in cold blood by NATO air strikes while sleeping [28]. ]. The media showed bodies of children out of the rubble and a woman, Minsyah Khleifa Heblow, cut in half. Others died in this very disturbing scene. In another case, Khaled K. Al-Hamedi's family was killed by NATO air strikes targeting her house killing her children. [29 ] In addition, the Al-Jafarh family was killed in Bani Walid [30 ] while NATO was targeting his house during the holy month of Ramadan. Not to mention the well-documented shelling of Gaddafi's convoy in Sirte, and the assassination of his youngest son, Saif al-Arab, at his home in Tripoli [31 ].

Human rights violations, systematic killings and torture against Libyan civilians continued after the militias took control of Libya. The victims were civilians who had not participated in the war.The majority were elderly and could not carry weapons. Popular comedian Youssef Al-Gharyani was detained and tortured by Al-Zawiyah's militia.

The Misrata militia also detained and tortured former 80-year-old Mufti of Libya Al-Sheikh Al-Madani Al-Sharif [32 ] because he did not approve or support the intervention of NATO [33 ].The famous singer, Mohammed Hassan, was raped and placed under house arrest [34] ].Others, such as economist Abd al-Hafid Mahmud al-Zulaytini, have been tried and sentenced to long prison terms. Similarly, the president of Islamic Relief, Dr. Mohammed Al-Shareef, was sentenced to a long prison term. The director of customs and the head of training at the Ministry of the Interior have also been sentenced to long terms of imprisonment with other persons sentenced to death and various prison terms. It seems absurd that these personalities were tried for drug trafficking, human trafficking and rape in addition to 17 other charges [35 ]. The question is, how could they have united and conspired together to commit such crimes for nine months?

After NATO placed these militias in the government, more horrendous terrorist crimes were committed against Libyan and foreign nationals. One Coptic was killed in the Misrata Battalion [36 ], others in Sirte [37 ], many Ethiopian Christian workers were murdered [38 ], the English-US teacher Roni Smith was murdered in Benghazi [39 ], Red Cross staff in Misrata was murdered in 2014 [40 ] a bomb attack was committed against the French Embassy in Tripoli [41 ], and especially the US ambassador to was murdered in Benghazi in 2011 [42 ] by terrorists including Tunisians.

All of the above-mentioned victims have been reported by Human Rights Watch and, in some cases, NATO has admitted responsibility. However, the ICC turned a blind eye and did not investigate such crimes despite the various national and international bodies that demanded the opening of a transparent investigation. The ICC has failed with regard to the war in Libya. She did not produce a single arrest warrant against the leaders of the militia and NATO forces. It seems that the deliberate policy of the ICC is to ignore these proven crimes and focuses only on the indictment and the trial of Saif al-Islam.

With regard to Muammar Gaddafi's family, the ICC is not considered serious, as in the case of Al-Saadi Gaddafi's torture, about which the ICC prosecutor claimed to pursue the investigation.However, a video showed him being beaten during his interrogation. The same standard applies to the case of Abdallah Senoussi where the ICC prosecutor said that he is still deliberating on his death sentence [pronounced in Libya]. A similar statement was made by his predecessor regarding the bombing and assassination of Muammar Gaddafi and hundreds of people in his convoy. The ICC has never been serious about other crimes committed by militias against thousands of Libyans.

NATO member states and some Gulf mini-states should be held responsible for the chaos created in Libya since 2011. They intervened in Libya on the pretext that Moamer Kadhafi massacred his own people. The scenario of a leader who kills his own people reminds us of Tony Blair about Iraq. He said in 2016 that it was "the right thing to do and that if Saddam had remained in power during the Arab Spring, he would have slaughtered the rebels" [43 ]. As a result, countries were destroyed, thousands of people were displaced and national property stolen. As a result of NATO's military intervention in Libya, Muammar Gaddafi, his sons and thousands of Libyans were killed and millions more were displaced.

Six years later, the stabilization of Libya is far from being achieved. In short, the Libyan militias are fighting each other as well as the military forces of the Western countries who are siding with the different militias. France remains militarily involved and lost three soldiers in Benghazi in July 2016 killed by groups that supported the 2011 uprising. Paris had then called the uprising a "revolution" that it had to support. If this belief were true, why does the war continue today?And why were 700 mostly army officers murdered? Why were US Consulate personnel killed in Benghazi? Why does the West ignore the barbarism of Daesh, which gorges at Sirte, Misrata and Derna?

The answer to this last question is clear, these criminals were supported by the West in 2011 because they fought the government, apostate according to their statements. Why did Daesh wear the same uniform as the one imported for the Libyan soldiers, and who gave it to them?Why did Daesh members receive a salary from the Libyan Ministry of Defense? The answer to these questions must be found among the real leaders of the country, namely Belhadj, Al-Shareef, the Libyan Islamic Liberation Group and their co-leaders, members of the National Congress. Those who govern Libya today are well known to the Libyan people and some international NGOs. Until now,

Is it not strange that Western countries, from Norway and Canada to the North, Malta and Italy to the South, not to mention Qatar, the United Arab Emirates, Jordan, Sudan and Morocco are were associated in a military aggression against civilians who were not hostile to them, against Saif al-Arab, Muammar Kadhadi and the Khuwaylidi family and the 84 innocent victims of Madjer? While these same states are patient and tolerant with Daesh in Sirte, Misrata and Benghazi, they endure bombings in French and Belgian cities. Yet, NATO member states and their allies should attack and bomb them as they did in Libya in 2011.

Finally, in addition to this series of crimes, Western states have designated a war criminal responsible for the destruction of Bani Walid and the killing of his children, Abderrahmane Souihli, as Libyan leader. They appointed Prime Minister his nephew, Ahmed Miitig [44 ], Director-General of Foreign Affairs his niece, Nihad Miitig [45] ] then his brother-in-law, Fayez el-Sarraj, new Prime Minister. In addition, Abderrahmane Souihli has reached an agreement with Abdelhakim Belhadj, the commander of the Libyan Islamic Fighting Group (GICL), to take the Islamist part of the presidential election. However, it is well known in Libya that if elections were to be held today, the above-mentioned people would not guarantee and guarantee even the vote of their families. Belhadj's popularity was demonstrated in the parliamentary elections when he received only 50 votes in Sauaq Al-Joumah district, which has 250,000 inhabitants.

During this time and during the writing of these lines, the population of the cities of Libya, including the capital Tripoli where inhabits a third of the population, suffers from water scarcity, lives in the dark because of the power cuts, and is deprived of medical facilities and means to meet basic human needs. According to the UN, 65% of hospitals have stopped working [46 ]. As the Libyan dinar collapsed and oil production went from 1.9 million barrels a day to 250,000 barrels [47 ]. To add to the suffering of the Libyan people, the main roads were cut off due to military operations and banditry, in addition to the bombing campaign that stretches from Derna east of Sirte to the West in Benghazi and Ajdabiya . The most common daily news is kidnappings for ransom and the booming arms trade as it is sold over the Internet.

In conclusion, we must thank our "brothers" from Qatar, Sudan, Tunisia, the Arab League, the NATO countries, the European Union and all those who have transformed Libya into a state of bankruptcy. After the liberation of Islamist prisoners and others, Libya has become an area to house the largest private prisons. A country that attracted investors from around the world has become a migrant exporting state, including its own citizens. 55% of its population migrated and took refuge everywhere abroad. A state that brought together the best legal and constitutional experts in the world, who was able to forge a new and modern constitution, is now transformed into an area ruled by 1,500 militias. And finally,

Commentary on Herland's report: Saif Al-Islam Gaddafi and the ICC

Before the uprising, Saif al-Islam was the architect of the new Libya. He presented his new vision of Libya liberated from political prisons, attached to the Charter of Human Rights, the distribution of wealth, prosperity and democracy [ 48]. ]. He undertook political and economic reforms by which radical Islamic prisoners gained their freedom, were rehabilitated and engaged in Libyan society. After the violent uprising in some cities, local sources confirmed that he offered help by helping displaced people across the country, freed the prisoners from the uprising, and secured the people of Misrata from the fighting. and the people of Benghazi who fled the combat zones.

He also called and supported peace efforts to resolve the war. According to sources on the spot, he asked the administration of Sirte University to print 5,000 leaflets and distribute them to the peaceful convoy party in Benghazi observing human rights. He called on the army to abide by its rules of engagement, banning the use of force against protesters, according to 2011 joint operation chamber chief Marchal Al-Hadi Embarrish, who was taken prisoner by militia fighters. 'Al-Zintan, abused and denied medical care until his death from cancer in prison in 2014 [ 49 ].

Despite the tireless efforts of peace of Saif Al-Islam Gaddafi, the planes of NATO targeted in an assassination attempt that resulted in the death of 29 of his comrades and imposed a permanent disability [ 50 ]. [ 51 ] In addition, the ICC persisted in demanding his arrest and trial when he was sentenced to death by a Libyan court sitting in Al Hadba prison under the leadership of Khaled Al-Sharif, the man from Belhadj.

For these reasons, the instruction being unfair, the dismissal of the case is the only continuation that should be approved. It could be argued that the case in its entirety should be abandoned, especially after the assassination of the Attorney General in Benghazi and the flight of most of the public prosecutors while facing immense pressure from the militia. In these circumstances, the ICC's arguments are that his death sentence has not been applied and that he should therefore be arrested and imprisoned in Al Hadba Prison.

However, the Libyan Ministry of Justice has appealed its death sentence for unfair trial, with the court being placed in a prison controlled by Al-Sharif, which has power over the court and magistrates. Nevertheless, the ICC continued to call for a new trial and turned a blind eye to the fact that Saif Al-Islam was being held at Al-Zintan prison and that the Tripoli court had tried him through a closed circuit. of TV. The ICC should respect Libyan law and be aware that a person should not be tried twice for an alleged crime. But the final game for the West and the ICC is to get rid of Saif Al-Islam Gaddafi as they did with his father Muammar Gaddafi and his brothers.

It is time for the ICC to abandon its double standards and side with the Libyan people in its ultimate goal of saving its country from these militias and building a new Libya where human rights, prosperity, development and the rule of law. We are also asking the ICC to abandon its call for Saif Al-Islam to be extradited and tried in The Hague.

The ICC should recognize and respect the law of general amnesty of the Libyan Ministry of Justice. Saif Al-Islam Gaddafi should be able to assume his role in the fight for a new democratic Libya. In this regard, and after Western states began to see their mistake, they should work with sincere Libyans and NGOs to bring these militias and their leaders to justice for the sake of peace and reconciliation.

For More than Four Decades Qadaffi managed to control the Populace and Resisted International Sanctions Of course via Selling oil.

And feeding People with the same dose of hate West /U.S.A over and over again Since Libya was in Good Terms with Russia.

He Even kept his Huge Mansion (More Like a Military Garrison) in Tripoli a War Trophy of American Airstrikes to Assassinate him due to his Pro-Russian Stance.But he got Lucky when Russians Informed him before the bombing of U.S.A.F.

The time he gave up all his Anti U.S/West policies and Virtually Surrendered his Country.That is the time Libyan Society Opened to the Western world and U.S and got planted with Spies/Agents and Traitors against his Rule.

Then Social Media also Played a Very Big Role Like Facebook e.t.c which was still new to average Libyans but it helped in Organizing Anti-Qaddafi Elements and unite them to start of Demonstrations later they got Violent.Some Military/Police officials Joined the Rebels some went against it.

It was not that there were no Anti-Qadaffi Elements from the start of his Rule of Libya
