Diplomatic conventions violated, says Ambassador.
Diplomatic troubles mounted for India over the case of a Saudi diplomat accused of torturing and raping two Nepalese women at his home in Gurgaon over three months. On Wednesday, the Saudi Ambassador Dr. Saud Mohammed Alsati met Ministry of External Affairs (MEA) officials dealing with West Asia and protested the Gurgaon police’s raid on the diplomat’s home, saying it was “against all diplomatic conventions.”

A press statement released by the Saudi embassy said the allegations against the diplomat and his family were “false” and “have not been proven.” According to the statement of the two Nepalese women, aged 50 and 30, they had been locked up in the diplomat’s apartment at a posh residential complex in Gurgaon, and raped by the diplomat and several other Saudi Arabian men, and prevented from leaving the house by the diplomat’s wife and daughter at knife-point.

They were rescued on Tuesday by the police on a tip-off from an NGO that works on trafficking cases called, Maiti Nepal India, after a specific request from the Nepal embassy. Addressing a press conference on Wednesday, Nepal’s ambassador Deep Upadhyaya said they had been in touch with the MEA and the Gurgaon police and were “satisfied with the cooperation from the police.”

However, after the protest by the Saudi Ambassador, and the release of a mobile recording of the police’s entry into the diplomat’s house, the government is on the backfoot over the diplomat’s immunity. In the video, police are seen barging into the residence, pushing aside family members including a young girl who were physically resisting their entry. According to Articles 29-31of the Vienna convention (UN 1961), that governs the treatment of diplomatic officials, any diplomat is “inviolable” and the state is bound to prevent any attack on him, his family and even his private residence, that “enjoys the same protection” as an embassy. Gurgaon Commissioner of Police Navdeep Virk indicated that they had been unaware of the diplomat’s status, telling reporters, "We have since been able to establish the identity (of the diplomat who has been accused of rape) and we have also been able to establish that the residents of that flat enjoy diplomatic immunity," he said.

The MEA declined any comment on the issue, and the spokesperson only said they were “waiting for the detailed police report.” That report has now been sent by the Gurgaon police to to Director General of Police (Haryana), the Ministry of External Affairs and the Embassies of Nepal and the Kingdom of Saudi Arabia seeking directions on how to proceed in the case. Sources told The Hindu that the three-page report contains FIR details, statements of victims recorded in front of the magistrate, and statements of the NGO Maiti Nepal India that tipped off Gurgaon Police to their plight.

The two women are expected to fly back to Nepal on Thursday as they are still under treatment for injuries they allegedly received from their employers over the weekend.

“They are still in trauma and were counselled by our staff. We have already contacted their families in Nepal and they will be reunited with them soon.” said Bal Krishan, the president Maiti Nepal India.

Vienna Convention is there to protect interest of nations and safety of diplomats and thier families. Geneva Convention is there to protect lifes of citizens of other nations and in there only there is about refugees, asylum seekers but when certain countries doesnt want to understand it then its start the problems.

India is working for reforms in UN and this diplomatic immunity comes in that reforms only.

Nepalese women allegedly raped by Saudi diplomat leave for Nepal | Zee News

New Delhi: The two Nepalese women, who were allegedly tortured and raped by a Saudi Arabian diplomat at his Gurgaon residence, left for Nepal on Thursday, police said.

"The women are not required to be physically present as far as the investigation is concerned. They went through medical examination twice and their statements have also been recorded in front of a judicial magistrate," said a senior officer of Gurgaon Police.

Meanwhile, Rajendra Man Shrestha, Police Counsellor for Nepal Embassy, went to the Gurgaon Police Commissioner's office over the ongoing investigation into the case, that came to light on Tuesday.

"The meeting between Shrestha and officials lasted for around 20 minutes, in which they shared basic details about the progress of the case and Shrestha also expressed his gratitude to Gurgaon Police for their efforts in the investigation," the officer added.

Diplomat rape case: MEA awaits Saudi Embassy's response | Zee News

New Delhi: Saudi Embassy here has not responded to the Ministry of External Affairs' demand to cooperate in the case involving a Saudi diplomat charged with rape of two Nepalese women, amid speculation that Saudi government may withdraw the accused from India.


A day after India had asked Saudi Arabia to waive the official's diplomatic immunity and cooperate in the investigation, official sources said, "a response is awaited to what we conveyed to them yesterday".

Yesterday, Saudi Arabian Ambassador Saud Mohammed Alsati was called to the MEA and told that the accused diplomat should give a statement to the Gurgaon police probing the case.

"MEA Chief of Protocol called in Saudi Ambassador and conveyed request of Haryana Police for cooperation of Embassy in the case of two Nepali citizens," Spokesperson in the Ministry of External Affairs Vikas Swarup had said.

It is learnt that the diplomat along with his family has shifted to the Saudi Embassy. The two Nepalese women have already gone back to their country yesterday.

The envoy was called a day after MEA had received a "detailed report" about the case from Gurgaon Police including the second medical report confirming rape and sodomy.

Asked whether Saudi Arabia has invoked diplomatic immunity of the diplomat, accused of confining and raping the women at his house in Gurgaon, to enable him escape prosecution, the sources said India has not been informed about any such move.

The options before Saudi Arabia are to either withdraw the diplomat or waive his diplomatic immunity to enable prosecution proceedings. The latter being very unlikely.

India can declare him persona non grata if he does not cooperate with the investigation.

The Saudi Embassy has termed the allegations as "false" and said it has protested police "intrusion" into a diplomat's house against "all diplomatic conventions".

The two Nepalese women have alleged that they were confined and raped by the diplomat and his "guests" repeatedly in a flat in Gurgaon on the outskirts of the national capital after which the local police filed an FIR in the matter.

As India sought waiving of immunity for the diplomat accused of raping two Nepalese women in Gurgaon, an agency report said he and his family have shifted to the Saudi Embassy while the two women have left for Nepal earlier in the day.

There were conflicting reports on whether the diplomat had left for Saudi Arabia or whether he was staying at the embassy here, till a decision was taken.

The case has put Indian diplomacy in the spotlight as the victim and the accused are of different nationalities.

Nepal has a special relationship with India and its citizens are treated on a par with Indians on many issues, and the government would wish to satisfy the Nepal government that it has taken effective action.

On the other hand, the government would rather not strain ties with Saudi Arabia where three million Indians live and work. Saudi Arabia has been India’s largest provider of oil since 2001.

Meanwhile, as more details emerged of how the two women were locked up and raped repeatedly, the government could face political pressure to take stronger action against the diplomat.

Congress spokesperson Randeep Surjewala demanded that “the Prime Minister and the External Affairs Minister speak to the Saudi government, and get justice for the two women.”

Rajya Sabha member Rajeev Chandrashekar said External Affairs Minister Sushma Swaraj “must request the Saudi government to waive diplomatic immunity in the interest of justice.”

“The Vienna Convention must not be a cover for rape and sexual abuse,” he added.

New Delhi: The waiting game in the case involving a Saudi diplomat, accused of raping two Nepalese women, continued today with External Affairs Ministry yet to get any response from the Saudi Arabia embassy here on its demand to cooperate in the investigations.

Official sources said the MEA was yet to get any kind of response from the Saudi Embassy which was asked to waive the official's diplomatic immunity and cooperate in the investigations. They also indicated that the government will wait for some more time before deciding on any further action in the case.

Diplomat rape case: Nepalese women to be approached after MEA responds, says Police | Zee News

New Delhi: Gurgaon Police is awaiting the MEA's response to its report before approaching the two Nepalese women, who were allegedly raped by a Saudi diplomat and others, for identifying the suspects in the CCTV grab of the apartment where they were confined.

Police on Sunday said that they need permission from Ministry of External Affairs (MEA) to approach the two victims who returned to Nepal three days ago.

However, police will send their proposal to MEA only after the latter responds to the "detailed report" sent earlier by it in connection with the case.

"The Ministry's response is expected to include what action is to be taken next," said a senior police officer.

Meanwhile, the MEA said that it has not received any response from the Saudi Embassy on its demand to cooperate in the investigation.

Gurgaon Police yesterday managed to extract CCTV grab from a corrupt hard disk in a digital video recorder (DVR) connected to several CCTV cameras covering crucial spots outside the diplomat's apartment.

Several persons are visible in the CCTV grabs and only the victims can identify whether any of them had allegedly sexually assaulted them, said the officer.

The DVR was sent to the state's only Forensic Science Laboratory (FSL) min Madhubani, where experts managed to extract the CCTV grabs of last 18 days up to September 7 night.

Police had taken the DVR into its custody when they rescued the two Nepalese women and handed it over to a special team working on retrieving data crucial to the case.

The team had, however, failed to do so as the hard disk turned out to be corrupt. Later, the task was assigned to a private enterprise. When the private enterprise failed, the cops opted for the Madhubani FSL.


The two Nepalese women, who were rescued last week, have alleged that they were confined and raped by the diplomat and his "guests" repeatedly in a flat in Gurgaon on the outskirts of the national capital after which the local police filed an FIR in the matter.
