Reason Why Army men beaten motor way police officers?

Question is not who beat up who but was the police man wrong to ask soldier to hand over his gun. Was the soldier in uniform or civilian clothes, even if he was in uniform didnt we have a history of terrorist dressed as soldiers. I am 100% on the side with the policeman, he was only doing his job and maybe he was risking his life when he saw someone with a weapon he would have been even justified to shoot him on the spot when he refuse to hand him over his weapon. Yet everyone here is siding with the army guy and then we wonder why do we have law and order situation in the country, why do we have VIP culture when you are insisting that Soldier should be treated as a VIP. and before you all open you mouth I do belong to an army family

You know this is a major concern. In my university whenever an army officer arrives whether in uniform or CV's all he has to do is mention his rank and he is let in with a salute without even checking who else is in car with him and forget about University security card. But when we go they even let their filthy dogs sniff our shoes..........And when we complain they throw our way the usual excuse "This is for your own safety" and when we argue with facts that most of the terrorist attacks were carried out by terrorists wearing military uniforms then we are told to join other universities and not military one's like the one i unfortunately happened to join: NDU Islamabad. You see this is the sad state of affairs in this wretched country of ours. BTW my father was from 2nd war course ( i bet senior most serving today was in diapers at that time:p:) and i have 2 brothers serving in Army, 2 brother in laws and 1 sister in law.

You know, i don't blame the two captains as they are young, immature and devoided of experiences, its their senior officers who let that happen should be penalized.

Aik to saray apnay aap ko badmash sumajhtay hain. there needs to be SOP when army and police deal with each other if there are any problems the police should just pursue the matter via the chain of command rather then thinking they are going to teach the phaujis a lesson, they will loose everytime.

I have consulted a retired Naval Captain of the HM’s Navy known to me.

Police officer can arrest anyone including the Prime Minister if found breaking the law in the area under his jurisdiction. I was given to understand that there are no legal restrictions on civilian police arresting uniformed/ serving military personnel unless it was a restricted area where police cannot enter without authorization. Only person beyond the law is the Queen / King who is supposed to be the fountain head of the law of the land.

However once arrested, the military personnel is obliged to inform the Commanding Officer and he /she can demand full access to do so. Normal procedure would be for the service personnel to be handed over to the Military/Naval police and tried by the military. I would expect that generally similar rules apply in Pakistan as well.

Since there is no respect for the law in Pakistan society and army officers/ personnel being members of the same society, also have similar attitude towards the law of the land. In my humble opinion, even if Motorway Police were totally in the wrong, Pak Army Captain should have voluntarily surrendered and taken the case up through the official military channels. Beating up of police officers in the course of their duty should not be condoned under any circumstances.

The Army regulations (on either side of border) dictate that the civil police can arrest a serving personnel in a case wherein an arrest is warranted ie a cognizable offence. Subsequent to the arrest, it is the duty of the arresting officer to intimate to the concerned unit and liaise with the local Military Police (all Police Stations/HQs have the necessary numbers/means to contact) and subsequently hand over the personnel to the Military Police and then it is incumbent upon the armed forces to produce the personnel for any trial/investigation if required by civil authorities.

However, there is a caveat. No arrest can be made if the personnel is on official bonafide duty short of any offence which comes under the definition of cognizable offence. In such a case, the erring military personnel is required to furnish the details of service and unit and contacts and proceed on duty.

In this case, it is apparent that the Police was right in stopping the officers as they were carrying a weapon. However, once identified, there was no cause for the officers to be detained further.

I don't know what has happened hence can not comment on the merits or lack thereof in this case, but aforementioned position is the valid legal position.

The problem was speeding. And then evasion. And only then the weapon.

Nevertheless. I was just putting out the legal position as per the Army Act.

No matter how one looks at it, it would be tough to justify speeding and evasion under both civil and military law.
