KARACHI: The number of judges of Sindh High Court (SHC) has been increased from 28 to 40 on Wednesday.

Sources said law ministry has issued a notification to raise the number of judges from 28 to 40 and restoration of eight deposed judges.

According to notification, Anwer Zaheer Jamali would be the chief justice of SHC. The summary had been issued earlier but notification has been released today.


there are reports, saying that 8 of the LHC judges will be taking oth in PUNJAB too.


With this master stroke PPP already defeted the lawers movment, there are more worries for, NAWAZ, AITAZAZ, QAZI, and IMRAN all are out. no more mess???:lol::tup:

lolz not so fast there is no mention of restoration of Iftikhar Chaudhry which is the bone of contention.

Rest zardari was willing to restore all sans Iftikhar Chaudhry earlier too.

And BTW even if they restore Iftikhar dont be so happy that he will last long as zardari thug has already planned to sent him on forced retirment.

SHC deposed judges take oath

KARACHI: The eight deposed judges of Sindh High Court (SHC) took oath here today.

According to sources, Justice Anwer Zaheer Jamali took the oath of SHC chief justice. Governor Sindh Dr. Ishartul Ibad has administered the oath.

Other seven judges who sworn-in today were Justice Khilji Arif Hussain, Justice Ameer Hani Muslim, Justice Zafar Ahmad Khan Sherwani, Justice Sajjad Ali Shah, Justice Salman Ansari, Justice Faisal Arab and Justice Abdul Rashid Kolhoro.

Chief Justice Anwer Zaheer Jamali has administered their oath. Earlier, law ministry has issued a notification to raise the number of judges from 28 to 40 and restoration of eight deposed judges.

What i am getting, is that ZARDARI & ppp realy playing, well thier cards here.
yap, i agree with you not so fast, but ZARDARI is doing well by not giving any space to NAWAZ SHARIF to expolite the issue of judges.
By taking all the credit, surly ZARDARI isnt going to ready to restore all of them specially, JUSTICE CHOWDARY. but by , restoring most and un important of them, he is killing the issue , guss what! after that he willbe cracking down to lawyers mafia too.:tup::lol:

I, am only happy because these all judges had accepted by thier actions that , actions taken by MUSHARAF were right.:agree::lol:

Now, many of politicians like, AITAZAZ, QAZI, IMRAN dont have any major issue to do thier dirty politics. plus NAWAZ SHARIF had lost all maybe, govt. in PUNJAB.:lol:

On the other hand unless Iftikahr is restored Nawaz is not going to sit calm even if he is restored i said time and again the two political parties can not walk togather.

Nawaz has only one option if he file a case against Zardari in NRO case otherwise if zardari is elected no action as per constitution could be taken against him.

Now either all the factions of PML should join hands also asking Imran, Qazi to to join and few others to halt election of zardari

It will indeed be interesting to see the power struggle between Baadmash Sharif and Mr 10% however what saddens me is that Pakistan will suffer at the cost of this struggle and with Musharraf gone, country is again at the mercy of these democratic thugs. God Bless Pakistan.

I want to clear, some of perceptions here. the situation in which pakistan is suffering now is because of MUSHARAF wrong political dececions and also because of MUSHARAFs unneeded reliance on USA, which ultimtly ended in his shocking ouster from the presidency. it was mr, MUSHARAF who made the deal with these croupt political elites, why was NRO implemented? and who did it, & did NRO brought the desired results?
I, guss all the answers of asked qustions would be NO, its right to think that he failed politicaly, & left this shattered, uneducated, emotional nation.

Even i like him personaly, but there are some fatal mistakes he made. in the end of his days, he did what ever he was asked by USA , and as a result of these actions, he lost all.

i would, like to see the power strugle between these thugs, because it will bring a situation, once again! where again pakistan willbe needing a COMMANDO PRESIDENT as its CHIEF EXECUTIVE with political experince , and with a revloutionary cabint making dececions, on revloutionry basis for the next 10 years.:angry::tup::flame::smitten::china::pakistan::sniper::usflag:

Eight deposed SHC judges may take oath today

ISLAMABAD, Aug 26: Eight deposed judges of the Sindh High Court are expected to return to their seats on Wednesday, opening the way for more inductions as the federal government is planning to increase the strength of high court judges to 40 from 28.

“The government is contemplating appointing additional judges to raise the existing strength of the high court to 40 for a period of one year in view of the heavy work load,” an official source told Dawn, adding that timely disposal of cases in the province had become a big issue.

He said the government might adopt a similar strategy for appointments in the Lahore High Court.

While extending an apology on the break-up of the five-month-old ruling coalition on Monday, PPP co-chairman Asif Ali Zardari had appealed to PML-N chief Nawaz Sharif to let the deposed judges be reinstated, saying that reinstatement of the chief justice will also come ‘eventually’. He said that all deposed judges would be restored ‘very soon’.

Deposed chief justice of the Sindh High Court, Sabihuddin Ahmed, had recently stated that the deposed judges seeking a fresh oath under the Constitution should not be called PCO judges.

Also, Law Minister Farooq H. Naek has been asking the deposed judges to take fresh oath under the Third Schedule of the Constitution.

At present 18, out of a total of 28 sanctioned judges, are working in the SHC.

The judges who are likely to take fresh oath are: Anwar Zaheer Jamali (expected to become the Chief Justice), Khilji Arif Hussain, Amir Hani Muslim, Faisal Arab, Sajjad Ali Shah, Zafar Ahmed Khan Sherwani, Salman Ansari and Abdul Rashid Kalwar.

Earlier, their re-entry to the superior judiciary was aborted after Mr Sharif protested their appointments before the signing of the Islamabad communiqu้ calling for restoration of all deposed judges within 24 hours of the impeachment or resignation of former president Pervez Musharraf.

Then reports about the signing of a summary by the former president for their appointments had sent a wave of shock and anger across the country, with a number of lawyers and political parties describing it as an attempt to sabotage the agreement between PPP co-chairman Asif Zardari and PML-N chief Nawaz Sharif to impeach the president.

Former Supreme Court Bar Association president Muneer A. Malik said the fresh appointments would mean that the judges had been validly dismissed on Nov 3 and, therefore, amount to accepting the validity of the Provisional Constitution Order.

In reply to a question about the seniority of judges, a senior official said the seniority would be reckoned from their original date of appointment by implementing the formula devised for former Supreme Court judge Mohammad Nawaz Abbasi.

Justice Abbasi had to start practice after leaving the Lahore High Court as a consequence of the judgment in the 1996 Al-Jihad Trust, commonly known as the judges’ case. He was re-appointed sometime in 2000 in the superior judiciary on a representation, but for the purpose of seniority, his date of appointment was reckoned as August 28, 1992 -- the date of his elevation as high court judge.

Syed Faisal Shakeel adds from Lahore: Deposed judges in Punjab have expressed their ignorance about any fresh offer of restoration or re-appointment.

A source said a summary for the appointment of judges in the Lahore High Court was in the pipeline.

The judges to be appointed are: Justice Mian Saqib Nisar, Justice Asif Saeed Khan Khosa, Justice Umar Ata Bandial, Justice Sheikh Azmat Saeed, Justice Ijaz Chaudhry, Justice Sair Ali and Justice M.A. Shahid Siddiqui. He claimed that the names of Justice Khawaja Mohammad Sharif and Justice Iqbal Hameed-ur-Rehman were not included in the list.
Deposed Justice Sarmed Jalal Usmani said: “I do not know of any offer. All I know is that I am not going to accept any offer if it excludes any judge sacked by the former president Pervez Musharraf on Nov 3 last year.”
He said there were five or six judges who were unwilling to accept the offer.

Deposed Justice Mian Saqib Nisar said no one had approached him with any offer. He said an offer could be considered only if it was routed through parliament. “Even then we reserve the right to either accept or reject the offer,” the judge said.
Deposed Justice M.A. Shahid Siddiqui said a fresh oath would amount to accepting the imposition of emergency and the removal of judges as legal and constitutional.

I necessarily don't disagree with what you have said above. It is true and for one i too lost hope in Musharraf when NRO was implemented. However on the other hand he was there when no one else was and indeed whatever decisions that he took, was to save Pakistan from a direct US assault. Obviously no one is a saint and neither was Musharraf but what we have now, well i can only say May GOD have mercy on our pathetic souls who brought these thugs back in the government and bless Pakistan.

:) These eight judges were the same whome Musharraf reinstated before his retierment and to whom Nawaz Sharif reacted and refused.

Building a system of checks & balances



ESSENCE requires that Pakistan should have been playing a leading role in world political affairs. Pakistan’s promising potential compels one to think that it could have played a greater role in introducing justice, dignity and education to the humanity in general and to the Ummah in particular. These attributes are some of the cardinal objectives of Islam, which enlightened humanity centuries ago.

Unfortunately, the situation is quite the opposite. The world system is based on rampant injustice, while Pakistan has remained engulfed by internal problems for the last 30 to 35 years. Also, Pakistan could not achieve political stability because of some internal and external interventions; the latter has even put our sovereignty at stake.
Political instability resulted in the lack of earnest political leadership. A sovereign nation gives priority to the welfare of its people in making significant national decisions. Hence, the welfare of the public and nation should have been the basic norms of our society, but unfortunately this is not the prevailing approach of our policymakers.
Personal gains and vested interests of some specific individuals and groups are given priority in our policies. Our traditional educational curriculum is not delivering, thus needs a drastic reform. Merit and justice are the two basic characteristics of a civilised society, which are not promoted in our society. They should have been the central theme of our system, but the reality is the reverse.
Corruption and favouritism are some of the unfortunate essential hallmarks of our society. Majority of our young generation are in a state of complete disappointment and distress.
Health and education are the two core pre-requisites of a creative and dynamic generation, which are not given proper attention in our decomposed structure. A good health guarantees prolific mind that leads to a sound and stable society. However, the situation is alarming as the daily commodities are not even conveniently available.
Currency has been devalued to the maximum and fuel prices have risen beyond the reach of an ordinary citizen. Consequently, talented young people of our society are looking towards the West for better lifestyle and prosperity. It is time the nation not only thought seriously but also acted accordingly.
The question arises: are we going to continue with this status quo? The answer is of course ‘no’. We need to restructure our civil institutional composition because it is not resilient. A robust system of checks and balances needs to be introduced in our ranks, whereby each and every responsible person would become accountable.:tup::smitten::pakistan::china::sniper::usflag:

NAB Ordinance repealed, new law to be enacted: Sherry
Updated at: 0102 PST, Thursday, August 28, 2008 ISLAMABAD: The Federal Cabinet Wednesday decided to repeal the National Accountability (NAB) Ordinance and replace it with a new bill which will be presented before the parliament.

Federal Information Minister, Sherry Rehman said this while briefing the media on the decisions taken by at the Federal Cabinet meeting here.

Amendments will also be made in the Oil and Gas Regulatory Authority’s Ordinance.

She said the Cabinet has approved a 50 per cent increase in taxes on import of 350 items described as luxury goods including expensive vehicles.

It was also decided to table a bill before the parliament to regularize the service of contractual employees of Grade-1 to 15.

Sherry Rehman said the daylight savings time will continue till October 31, 2008 instead of earlier date of August 31, 2008.

The Cabinet also decided to enhance representation of minority in the Senate, the Information Minister said.

To a question she said, increase in import tax will also bring reduction in the import bill of the country.

LAHORE, Aug 29: Some deposed judges of the Lahore High Court are reported to have expressed willingness to accept the government’s offer to resume work.According to sources, a summary about reinstatement of at least four judges, who are inclined to take a fresh oath, has been sent to the acting president.
“But there is some mist about a fifth judge,” the sources said.

Lawyers associated with the move said the judges might be sworn in on Saturday or Monday.

An official, however, claimed that a notification was still pending and unless it was issued, the judges could not take oath.

“If you ask me about the oath, mark Monday as the right day for the oath,” he said.

Lawyers here are also anxious to find out the terms offered to the deposed judges.
They said though they were not sure but they were surprised to hear that the deposed judges of the Sindh High Court had been appointed under a notification issued in the name of President General (retd) Pervez Musharraf.

Lahore High Court Bar Association president Anwar Kamal said he was surprised that the PPP could bring these judges back when it had been talking about the need for amendment to the Constitution for reinstating the judges.

The judges start breaking up, i guss more to come. awam starts looking the other way and the lawyers movent going in to ruins?:lol::tsk:
