Justice Isa and his like minded people were spreading propaganda that nominees by CJ of Pakistan were rejected. They wanted to scandalize CJ. So CJ ordered release of full transcript of the Judicial Commission Pakistan meeting exposing Justice Faez Isa and his like minded as pathological liars

So what did the transcript say?

The letter Justice Isa made public had this keh those nominees have been rejected?

Transcript said that it was attorney general of Pakistan himself that requested to defer meeting hence CJ's nominees were not rejected as per propaganda news

Oh man that is embarrassing.

It is a travesty in itself that while our justice system is so shite and cases are pending, a Justice of the court is spending his holidays in Spain...but not only that he is also peddling propaganda and lies on behalf of N? Because let's face it, this favors N.

Yes. Listen to the meeting after 2 hours ten minutes.
Vote was a draw 4-4. Attorney general himself requested to defer the meeting. Liar Faez Isa kept insisting that names are rejected despite the draw vote. @Jungibaaz @muhammadhafeezmalik

You should look up these subjects properly and pause to think for a moment before making these reactionary statements. I’ve advised you this in the past.

At present the appointment of judges is far too discretionary. Forget the politics for a second, the last six appointments have been made with passing over senior judges. In Sindh, three times now the three most senior have been passed up. And the CJP has just tried to appoint 4th, 6th and 7th ranking judges.

Provincial Bar associations, SCBA and PBC have all called this out. Even if seniority is not an absolute guidance, it should not be ignored. Other considerations such as merit are subjective and hard to measure, but even here CJs have historically practised discretion.

Several resolutions have been adopted by the Bar asking legislators to work on codifying and writing into law a proper mode of deciding who should be appointed, whether that’s merit, seniority, it needs to be defined.

You can't have the seniority application without fixing the issue of appointment of junior judges.

Do you agree with the system in UK? If yes, why don't you advocate replica of that system for vetting and appointment at ALL levels?

I have listened to the whole meeting. This is an incorrect narrative. You should listen to the whole thing, and see how especially that deferment came about. In the letters written by Justice Isa and Justice Masood, they demanded release of the minutes. Here's a summary:

  • Justice Retd. Sarmad Jalal Usmani, he rejected Phulpoto and said he'd be in favour of the other four. (Vote in favour of four)
  • Justice Ijaz Ul Ahsan said he'd favour all five, no surprises here. (Vote in favour of five)
  • Justice Sajjad Ali Shah is due to retire in two weeks time, the Bar was already protesting the fact that he was being able to sit in and choose his own successor, he said he'd vote for all five. (Vote in favour of five)
  • AG Pakistan rejected all five. (Vote against all five)
  • Justice Tariq Masood, third most senior judge after the CJP and Justice Isa, rejected four of the nominees citing seniority and rejection rates (merit) of the four nominees and said that the matter of Justice Kaiser Rashid Khan of the PHC be deferred (he rejected four and deferred one). (Vote against four out of five)
  • The Law minister rejected all five, took issue with seniority and also challenged the CJP's perception of civil and other litigation experience of the nominees vs. senior judges as alternatives. (Vote against all five)
  • Pakistan Bar Council's Akhtar Hussain, rejected all five on the subject of seniority. (Vote against all five)
  • Last came Justice Qazi Faez Isa, he rejected all five, and during his prose, the CJP adjourned the meeting improperly. (Vote against all five)
According to the tally I take directly from the audio recording. Four of the JCP memebers rejected ALL five nominees, five of the JCP members rejected four out of the five nominees (only Justice Tariq Masood decided to leave PHC's Justice Kaiser Rashid Khan out). Justice Phulpoto was rejected by six members. In favour of all five of the nominees with the CJP, Ijaz Ul Ahsan and Sajjad Ali Shah. In favour of four of the five nominees (sans Phulpoto) were the three aforementioned and Retd. Justice Usmani.

Here's what we conclude, the 5/4 vote loss conclusion is valid. There's only 4/4 + 1 indecision on JUstice Kaiser Rashid Khan only. The CJP adjourned the meeting in the middle of ongoing deliberation, he did not take vote on deferment, he did not acknowledge that the 4/5 of his nominees had been rejected by a majority, and he left the meeting without even ruling.

And the CJP did all of this so that he can pack the court before his man Sajjad Ali Shah retires and Justice Mansoor Ali Shah takes his position, who has been wont to scrutinise the appointment of judges. All in all the CJP's conduct has been reprehensible and dishonest, the press release released afterwards was such a travesty that two of the judges wrote open letters against it. Here I fully side with the five dissenting CJP members + the Bar. You should once again revise your view.
