PPP, MQM to enact law protecting dual nationals

According to reports, Pakistan Peoples Party (PPP) and its key coalition partner Muttahida Qaumi Movement (MQM) have agreed, in principle, to enact a new law protecting dual nationals from being disqualified as parliamentarians.

The agreement had reportedly been reached during a telephonic conversation between Prime Minister Raja Pervaiz Ashraf and MQM chief Altaf Hussain on Sunday.

The telephonic conversation between the prime minister and the MQM chief follows a meeting between President Asif Ali Zardari and Altaf Hussain in London on June 29th, where the issue also came under discussion.

Both sides agreed that an amendment in electoral laws, enabling dual nationals to take part in elections should be materialised as soon as possible.

Several lawmakers, including former interior minister Rehman Malik and PPP’s Farahnaz Ispahani—wife of former ambassador to the US Hussain Haqqani—had earlier been disqualified by the Supreme Court (SC) on the basis of their dual nationalities.

Many political parties remain opposed to the disqualification of parliamentarians on such a basis, but the paucity of any legal safeguards ensures that these concerns remain unaddressed.

“This is our stance and it will not change. We want Pakistanis living abroad and having nationalities of other countries to become eligible for the membership of parliament,” said MQM spokesperson Wasey Jalil while talking to The Express Tribune on Sunday.

“There is a basic contradiction here. When Pakistanis send billions of dollars in remittances, we admire them. But when they demand a right to be legislators, we respond in the negative,” he pointed out.

According to a press release from the MQM on Sunday, Altaf termed talks on the prospective legislation for dual nationals a ‘positive step’.

Meanwhile, in Islamabad, some senior PPP leaders also confirmed that the law ministry was preparing a draft of the proposed bill, aimed at abolishing the electoral rules’ clause, which bars dual nationals from being a member of parliament.

During one of the hearings, Chief Justice Iftikhar Muhammad Chaudhry had questioned the sincerity of dual nationals to Pakistan, indicative of the strains that might fracture the already brittle relationship between the legislature and judiciary over the issue in future.

Both the incumbent premier and his predecessor Yousaf Raza Gilani had severely criticised the law, while MQM chief Altaf Hussain cited it as being a violation of the fundamental rights of citizens during a party address in Karachi last week.

ISLAMABAD: The Supreme Court, during the hearing of dual nationality cases, suspended the memberships of Muhtahidda Qaumi Movement (MQM) Member National Assembly (MNA) Farhat Mahmood and Member Provincial Assembly (MPA) Nadia Gabol, Express News reported on Wednesday.

Earlier, the Supreme Court suspended the membership of Pakistan Muslim League-Nawaz (PML-N) MNA Muhammad Jamil Malik for holding dual nationality.

A three-member bench, headed by Chief Justice Iftikhar Muhammad Chaudhry, was hearing cases pertaining to dual nationalities of assembly members.

ISLAMABAD - The Awami National Party (ANP) and Pakistan Muslim League-Nawaz (PML-N) on Thursday expressed their reservations over an amendment allowing dual nationals in parliament. The ANP said that the law should only be applicable for the person’s nominated for the offices of president, prime minister or the army leadership and judges. Opposing the bill, the PML-N criticised the contempt of court amendment bill and said that the bill is equivalent to restricting the judiciary’s authority. Haji Adeel, a central leader of the government allied ANP, presented the party’s stance when President Asif Ali Zardari contacted him. Adeel said, “If such laws are not enforced, then people like Mansoor Ijaz can also become the president of Pakistan one day.”

Constitutional amendment: ANP refuse to budge on dual nationality bill

The fate of a proposed dual nationality law, which requires an amendment to the Constitution, hangs in the balance as a key ally in the ruling coalition has refused to support the new legislation.

Support from the Awami National Party (ANP), an important ally of the Pakistan Peoples Party (PPP), is crucial for amending the Constitution, which requires two-third votes in both houses of parliament.

The ANP has proposed some changes in the draft bill which, if incorporated, will change the nomenclature of the proposed amendment, which the government wants to introduce as the 22nd Amendment to the Constitution during the ongoing session of the National Assembly.

Senator Haji Adeel, who is part of the ANP team that has been holding negotiations with the government, told The Express Tribune that his party has proposed amendments to be incorporated in the bill.

The ANP believes that a dual national cannot hold any important public office, including the offices of the president and prime minister, key posts in the military, judiciary, bureaucracy and other sensitive departments.

“We want an amendment to the bill barring dual nationals from holding important offices. We also want it to be applicable to top civil bureaucrats of grade 21 and 21,” he added.

If the government wants to give overseas Pakistanis an opportunity to take part in the elections, then the amendment should make it clear that either before taking part in the polls or immediately after getting elected they would have to renounce their second nationality.

The Mutahida Qaumi Movement (MQM), which is the main mover of this bill, is pressing the government on the amendment, while the ANP and PML-Functional are opposing it.

Already short of numbers, the government is also facing stiff resistance from the PML-N and its ally PML-likeminded group.

Sources said the already fractured PML-Q also fears defections on this issue.

To all the people heading ministries and big government offices irrespective of which government they worked under or which political party they are from:

Just one question; will you be able to contest in your real country for the offices that you administer in Pakistan? Let alone being appointed to run that office.

You people are not even eligible neither morally nor educationally to even work as office clerks in the offices that you run. Also, nor as per constitution*.

Just show us any single article from the constitution relating to the common man which has the highest implementation rate and tell us the ratio in percentage.

*elections are a big fake drama to begin with up to your violations of the same constitution in view of the dual, triple or more nationalities and up to the implementation of the constitution for giving the rights to the common man.
