The South China sea has kept its tranquility one week after the arbitration award was issued. China is continuing with its island construction activities. It has conducted trial test flights at two newly established airports in the Nansha Islands and carried out a combat air patrol over Huangyan Island. On Wednesday, eight Taiwanese lawmakers visited Taiping Island in a move to reassert sovereignty.

Despite all this, there has yet to be any strong backlash by the US, Japan, the Philippines and Vietnam. The arbitration result, which is merely a piece of paper, failed to yield any actual effects.

Nonetheless, the US and Japan have engaged in some petty tricks. US Vice President Joe Biden has won over endorsement of the arbitration result from his Australian host during a recent visit. Japanese Prime Minister Shinzo Abe tried to make an issue of the award at the just concluded Asia-Europe Meeting, to no avail.

In a statement on its official website, the Vietnamese government denied that Vietnam's top leader agreed on China's position on the South China Sea arbitration award. Philippine Foreign Minister Perfecto Yasay said on Tuesday Manila has turned down a Chinese proposal to start bilateral talks on the South China Sea dispute because of Beijing's pre-condition of not discussing the arbitration result.

The stance of Vietnam and the Philippines is not unexpected, nor it is provocative. This is not an indication that the pressure on China over the South China Sea is mounting. Other external powers, save the US and Japan, have no interest in stirring up the South China Sea arbitration. The US interferes in the South China Sea out of its hegemonic ambitions, while Japan can't accept a rising China.

Hanoi and Manila know full well that the arbitration result cannot be put into effect. Even though they are unwilling to admit it's just a piece of paper, they understand the award is only an illusion created by the US and Japan. They also clearly know that the US and Japan use them as pawns. Solving disputes through peace talks falls in line with their genuine interests.

The US presidential campaign is in full swing. Will President Barack Obama take the plunge of a showdown with China in the South China Sea? Probably not. China believes the US can abide by the bottom line of rationality. Democracy is supposed to prevent silly decisions. But it's believed the Chinese government will make contingency plans.

The South China Sea has become a battlefield of strategic competition between China and the US. After a new president is sworn in, the US muscle-flexing in the waters is highly likely to be intensified. But at that time, the wrangling will have nothing to do with the arbitration case, but will be more about collisions between two powers on their way to exploring a new type of relations.

U.S. says its forces will keep operating in South China Sea
BEIJING (Reuters) - U.S. military forces will continue to operate in the South China Sea in accordance with international law, the U.S. Chief of Naval Operations John Richardson said on Wednesday during a visit to a Chinese naval base.

China has refused to recognise a ruling by an arbitration court in The Hague that invalidated its vast territorial claims in the South China Sea and did not take part in the proceedings brought by the Philippines.

China has repeatedly blamed the United States for stirring up trouble in the South China Sea, a strategic waterway through which more than $5 trillion of trade moves annually.

China, Brunei, Malaysia, the Philippines, Taiwan and Vietnam all have rival claims, of which China's is the largest.

The United States has conducted freedom of navigation patrols close to Chinese-held islands, to Beijing's anger, while China has been bolstering its military presence there.

Meeting Yuan Yubai, commander of the Chinese North Sea Fleet, Richardson "underscored the importance of lawful and safe operations in the South China and elsewhere professional navies operate", the U.S. Navy said.

U.S. forces would keep sailing, flying and operating wherever international law allows, Richardson added.

"The U.S. Navy will continue to conduct routine and lawful operations around the world, including in the South China Sea, in order to protect the rights, freedoms and lawful uses of sea and airspace guaranteed to all. This will not change."

Freedom of navigation patrols carried out by foreign navies in the South China Sea could end "in disaster", a senior Chinese admiral said over the weekend.

State news agency Xinhua said on Wednesday that countries outside the region should stay out of the South China Sea issue lest they cause unwanted problems.

"Western countries have a long history of failing to establish orderly rule over parts of the world. The Middle East is a classic example," it said.

Richardson said he was supportive of the deepening of relations between the U.S. and Chinese navies.

"But I will be continuously reassessing my support conditioned on continued safe and professional interactions at sea. In this area we must judge each other by our deeds and actions, not just by our words," he added.

The United States has complained that Chinese aircraft and ships have performed "unsafe" manoeuvres while shadowing U.S. ships and planes, particularly in the South China Sea.

Why the Next US President Should Pivot to the South China Sea
The U.S. needs to get proactive and expand the scope of activities with new partners like Vietnam.

A handful of Democrats and Republicans have expressed an interest in running for their party’s 2016 presidential nomination while others are considering. Whoever is elected as the next president of the United States, he/she should place higher priority on the South China Sea (SCS). Why?

First, the SCS has emerged as a central aspect of regional geopolitics of the Indo-Pacific. The issue has been high on agenda of both track I and track II diplomacy, from day-to-day discussions to regional strategic calculations and beyond. It encompasses both traditional and non-traditional security issues, and engages major players in Indo-Pacific, including the U.S., China, India, Japan, ASEAN, and its member states. More importantly, the SCS is widely seen as a litmus test of Beijing’s strategic intentions and actions, and of Washington’s resolve.

Second, U.S. policy towards the disputes in the SCS has been largely reactive. In retrospect, Washington has modified the content of its policy in response to tensions triggered by China’s assertive posture in the SCS. For example, the first U.S. policy statement on the Spratlys and the SCS was released in 1995 in response to growing instability deriving from China’s move to seek control of Mischief Reef. Meanwhile, when then Secretary of State Hilary Clinton declared at the 2010 ASEAN Regional Forum that the U.S. has national interest in freedom of navigation, it was a corollary of a series of aggressive Chinese actions, including harassment of the USNSImpeccable. A U.S. State Department document, Limits in the Seas, released in consequence of China’s unilateral actions, particularly the HD-981 episode, found that Beijing’s 9-dash line is inconsistent with international laws.

Third, regardless of Washington’s call for upholding a rules-based stability in the region, Beijing insists on altering status quo by “sheer size and muscle.” Most recently, the U.S. warned China against “militarizing” the SCS through its land reclamations and constructions on some of the features it has occupied in the Spratly archipelago, which fuel anxiety within the region, and urged it to avoid destabilizing activities. Beijing responded by arguing that it is “building shelter, aids for navigation, search and rescue, etc.,” and it “does not affect and is not targeted against any country.” However, the Fiery Cross Reef images published by CSIS Asia Maritime Transparency on its website show different outcomes of the constructions (for instance, a 3,110-meter airstrip that can accommodate almost any type of aircraft; and port facilities that may be capable of docking military tankers). Once the constructions are complete, American military bases in the region will be under growing threat from these outposts.

Clearly, the U.S. should make some adjustments to its SCS policy, so that it becomes more proactive. Specifically, (i) Verbal assertions of freedom of navigation remain insufficient. The U.S. naval and air presence in the SCS must be maintained or increased; (ii) The U.S. should reinforce a new web of partnerships throughout Asia that includes traditional allies but goes beyond them. Among the new team in Southeast Asia, Washington should deepen ties and seek to expand the scope of joint activities with Vietnam in the maritime domain
