MANILA, Philippines (UPDATED) – The Philippines came out in full force on the first day of its oral hearings at The Hague, the Netherlands, over its historic case against China over the South China Sea.

On Tuesday, July 7, the Philippines argued that the arbitral tribunal at the Permanent Court of Arbitration, based in The Hague, has the right to hear the Philippines' case. (READ: Philippines vows to smash China's strongest argument)

Eventually, if the tribunal decides it has jurisdiction, the country can proceed to invalidate China's expansive claim over virtually the entire South China Sea. (READ: PH vs China at The Hague: '80% of fish' at stake)

Deputy Presidential Spokesperson Abigail Valte, who was among the Philippine officials at The Hague, said Solicitor General Florin Hilbay introduced the Philippines' case during Tuesday's hearing. Hilbay also presented the order of speakers.

Foreign Secretary Albert del Rosario, for his part, "made an impassioned plea for the tribunal to recognize its jurisdiction." Del Rosario cited the importance of the case "not just to our country but to the entire world, owing to its impact on the application of the rule of law in maritime disputes."

The Philippines' chief counsel, Paul Reichler, and Professor Philippe Sands later argued why the tribunal has the right to hear the case.

This first round of arguments is set to continue Wednesday.

Behind-the-scenes photos

Images published by the Philippine government show a powerhouse team defending the Philippines.

A photo released by the Philippine Department of Foreign Affairs showed an 18-member Philippine delegation at the Peace Palace in The Hague.

The photo includes Hilbay and Reichler, an internationally renowned lawyer.

On Tuesday, Valte tweeted other photos showing the Philippines' last-minute preparations.

Philippine Communications Secretary Herminio Coloma Jr earlier told journalists that Manila is "following its position of seeking a rules-based, diplomatic and peaceful solution."

But Chinese Foreign Ministry spokesperson Hua Chunying said China opposed the arbitration.

"China has on many occasions expounded its position by neither accepting nor participating in the arbitrary procedure unilaterally initiated by the Philippines in breach of the agreement repeatedly confirmed with China as well as the Philippines," she said.

"China opposes any moves by the Philippines to initiate and push forward the arbitral proceedings," Hua said.

Still, in an interview with Rappler, Senior Associate Justice Antonio Carpio of the Philippine Supreme Court said China would be forced "one way or another" to comply with the tribunal's ruling. He expects the ruling to favor the Philippines. – With reports from Agence France-Presse

I support the Philippines but honestly it won't do much. China sits in the UN Security Council and holds Veto power over regional issue on the Asia Pacific. China will just ignore or reject the tribunal case.

I know voilence isn't the answer but what you need right now is military force and strategic allies like what Vietnam is doing. PRC will not take you seriously on your sovereignty claim without a strong military. Action speaks louder then words.

unless the court can authorize the military action, it is useless, any war without the authorization of the UNSC is illegal.

and it's not like Philippines stand any chance against China militarily anyways.

unless UK withdraw the falklands and Israel vacate from the west bank, China doesnt have anything to worry about.

Don't act innocent both countries are guilty of trickery and deception. South Vietnamese took Southwest Cay and Chinese took Scarborough Shoal. The Pinoys shouldn't be so gullible they let their guard down and got screwed.



South Vietnam
In 1975, a party was held for the Filipino commanding officer at Northeast Cay. Filipino forces guarding the Southwest Cay attended the party and upon their return, found that theSouth Vietnamese, who were then allies, had occupied the island in their absence.

Southwest Cay is in the northern edge of the Spratly group. It is within Dangerous Groundin the South China Sea which also contains the Filipino-occupied Northeast Cay (Parola), South Vietnamese-occupied South Reef and unoccupied North Reef. Southwest Cay and Northeast Cay are just 1.75 miles (2.82 km) away from each other. Each island can actually see the other within their respective horizons.

The incident took place when all the Filipino soldiers guarding the island of Pugad left to attend to the birthday party of their commanding officer who was based on nearby Parola. The storm that day is also believed to have persuaded all the soldiers to regroup temporarily on Parola. A report also came out saying that South Vietnamese officials managed to send prostitutes to the birthday party to lure the Filipino soldiers guarding Pugad. It was said to be a "present" to the Filipino commander for his birthday and as a move of South Vietnamese forces to befriend all Filipino soldiers guarding the Spratlys. Filipino soldiers did not expect that South Vietnam would resort to foul play since both the Philippines and South Vietnam, together with the United States, were allies in the Vietnam War. This tactic is believed to be the reason why South Vietnamese forces knew that the Filipino soldiers left the island, an action that is usually kept confidential.

After the party and after the weather cleared out, the returning soldiers were surprised that a company of South Vietnamese soldiers were already in the island. The South Vietnamese flag replaced the Filipino flag flying on the pole created by Filipino soldiers themselves. The soldiers returned to Parola immediately for fear that Parola would be the next target. After higher-ups of the Philippines were informed about the situation, they instructed the troops based in Parola and Pagasa to stay on red alert status. For the following mornings, the only thing the Filipino soldiers could do in Parola was to "curse" while South Vietnamese sang their national anthem. Malacañang officials, who did not want to compromise the alliance while the Vietnam War was still being fought, decided to remain silent.

China
Under a 2012 deal mediated by the United States, China and the Philippines promised to withdraw their forces from the shoal until a deal over its ownership could be reached.[citation needed] The Philippines complied with the agreement and withdrew. China, however, did not abide the agreement and maintained its presence at the shoal, effectively militarizing it. Philippine presidentBenigno S. Aquino III later compared China's behavior to Nazi Germany's annexation of Czechoslovakia.[23]

By July 2012, China had erected a barrier to the entrance of the shoal, according to the Philippine Department of Foreign Affairs.[24][25][26] Since then, vessels belonging to the China Marine Surveillance and Fisheries Law Enforcement Command have been observed in the nearby disputed shoal[27] and Chinese government vessels have been turning away Filipino vessels sailing to the area.[28] In response, the Philippines has stated that it would be preparing to resend vessels to the shoal, in what has been described as a "cold standoff".[29] By January 2014, China continued to maintain a presence within the shoal, among heightened tensions regarded a new law which requires non-Chinese fishing boats to seek permission from China when in the South China Sea, however Philippine fishing boats were able to fish around the shoal without Chinese interaction.[30]
