"They're in for a surprise: The Philippines isn't also with the UNCLOS -- when it comes to sovereignty disputes like that on Scarborough (known in the West for Huangyan Island)."
He pointed out that back in 1984 when ratifying the treaty, Manila has made it clear that the convention could not apply to its sovereignty disputes.
To put it simply, the Filipinos would deem the treaty null and void when it comes to territorial disputes, Tiglao said.
Aquino has made no mention of such a thing when he proposed to let the international tribunal handle the case.
The Philippines said Huangyan Island, an uninhabited shoal, lies well within the country's 230-mile exclusive economic zone that is recognized under the UNCLOS.
The United States is among 34 nations that have not ratified the UNCLOS and therefore officially do not recognize it, he added.
As early as 2006, the Chinese government submitted a written statement to the UN, making it clear that China does not accept international arbitration "as described in section 2 of part XV of UNCLOS in disputes ... concerning maritime delimitation, territory and military activities," he said in an article published by the China News Agency on April 27.
By that time, Beijing had already asserted its claims to Huangyan Island in the South China Sea, which means even if the Philippines does bring the case to the ITLOS, China is not obliged to appear in the tribunal, he said.
Tiglao put forward a similar argument, speaking of China's declaration following the ratification of the convention.
"The People's Republic of China reaffirms its sovereignty over all its archipelagos and islands as listed in article 2 of the Law of the People's Republic of China on the territorial sea and the contiguous zone, which was promulgated on Feb. 25, 1992," the document reads.
"That law declared as part of China what it called the Zhongsha Islands, which included Huangyan (Panatag to us)," Tiglao said.
The Philippines said it would go it alone if Beijing insisted on turning down its invitation.
The paradox that Manila is seeking a solution which it had declared earlier it would not recognize raised questions about the true motives behind its aggressive push.
"He (Aquino) insists that the dispute be decided by a court which, however, can't have jurisdiction over it. This President is making us the laughing stock of the world," Tiglao said.
The hardball tactics, Yi said, aimed to complicate the situation instead of appease it.
"The Philippine government, fully aware of the consistent position of the Chinese government, still had its own way to push forward the invitation," he said.
"The purpose is nothing but to discredit the Chinese government as ignoring the international judicial system and rejecting dispute settlement through legal means," he added.

China is not above the United Nations. China is not above international law. You are not the
center of the world. You have no right to step on other country's rights just because you have
more money and have bigger guns.
China's historical evidence is NOWHERE TO BE FOUND. And everything is just based on what their government claiming. No pictures available on the net or newspapers. The Chinese government is
just fabricating LIES about their history. Why won't any Chinese post a link of their historical
evidence.
The Chinese claim to have 'been there first' is like arguing that Europeans got to Australia before
its aboriginal inhabitants.
All Philippine maps(Carta Hydrographical y Chorographical De Las Yslas Filipinas by Fr. Pedro Murilo Velarde, S.J. and published in 1734) are readily available over the net. Google it. Whereas the
Chinese maps ARE NOWHERE TO BE FOUND.
So WHERE ARE THE ANCIENT MAPS?? Have you seen it? I haven't! Has anyone in this forums seen it and can provide a link to it? We have always wondered why China keeps on insisting bilateral
country to country talks only, and resorts to various forms of harassment instead of just proving
their claim over the courts.
Now we know. China does not have any evidence to back her claims. Should the evidence even be produced, it would not be evidence of sovereignty of Philippine territory. Even your government
officials and proffessors from your universities cannot show any proof! Admit it. You know that
SCARBOROUGH IS PHILIPPINE TERRITORY. It will be hard to accept, but the evidence is there.
China has no evidence.
China has been calling for war all this time just because they cannot prove their claims. China's
showing barbarism, as if everything can be resolved through war in this time of peace. You will
never be right. Reasonable men will fight with reason. The lesser man will resort to violence.
Chinese wu maos have always resorted to insults and baseless comments all these time because
they cannot rebutt Philippine claims over our territory.
China's 9 dash line is nothing but an imaginary set of broken lines. Imaginary because they could
not even produce the 1200's map they used as a basis. Imaginary because should they be able to produce the map, it contains inaccurate mapping data of misplaced islands and waters as this was made during the 1200's. Imaginary as should they be able to produce the map, the map does not contain only details on china, but also those of neighboring countries. Will china claim all the
countries indicated on the map as well?
But produce it first, if it really exists. Stop with all these fictitious claims. Prove that you have
sovereignty over the islands. The Philippines already laid down their evidences and it is very
convincing. China does not have any.
Therefore, again and again i will say: THE PHILIPPINES OWNS SCARBOROUGH.
China's belief on their overwhelming arguments vs Philippines' inferior counters should give the
former enough confidence to beat the latter before UN arbitration anytime. A perfect opportunity
to shut adversaries up without bloodshed and finally will "gain license" to sink/apprehend
trespassing stubborn vessels minus the international condemnation.
The Philippines has always been ready to settle this matter in court. Based on evidences, both
historical and legal, provided by the Philippines, the Philippines' claim is very reasonable and will
stand on it's own in ANY international court.
