What's new

PCB's case against BCCI has been dismissed by ICC's dispute panel

Waste of time...Around the world, MoU is not considered as a binding clause that can be used for dragging someone to court...Listen to some of your own countrymen who are saying the same thing in your newshour debate.
if not then how will u justify the ICC presidentship for BCCI man? this agreement was signed because Pakistan gave her approval to BCCI's ICC president candidate and for big 3.

I think Pakistan has a very strong case!

Najam Sethi on the verdict
Former PCB chief Najam Sethi, who was the man behind the PCB's drive to hold the BCCI accountable for not playing the agreed-upon series, had this to say of the dispute panel's verdict: "I find this finding to be a mockery of the law. This means that sports boards can in future renege on bilateral or multilateral contracts simply by clutching at "oral" or perceived views of governments without offering proof or evidence.

"It reaffirms the notion that financial power is might and might is right, exactly the philosophy that led to the discredited 'Big 3' nexus in the first place. It will also reinforce the BCCI as the big bully on the block. This is not cricket."

Kaka G now international court is the only option left!

Which international court? Remember, PCB will not just be going against BCCI, but also ICC. Does PCB have the money to do it? Also court cases take time.

What will PCB do if ICC holds back distributions during the court case which could take a few years?

Can you show any source which says ICC president ship depended on PCB?

let us just worry about it.

let us just worry about it.

So yo don't have any answers? Here are few more things for you guys to worry about

1) BCCI has filed claim to recover lawyer fees. PCB will have to spend money to defend itself.
2) PCB has o decide which court they are going to sue in.
3) that court has to accept the case
4) BCCI/ICC has to agree to courts jurisdiction
5) the court has to have power to implements its verdict

Kaka G just because one hasnt answered u, doesnt mean he doesnt have but just dont wanna give u those answers because yr questions r too futile and childish...Int. court is in Holland not in England where such laws apply and i dont think in international court there r these sort of laws to begin with, but even they r im sure we can win the case to begin with, and it maybe u who might have to give in the end! since we r in the right side yr not. U signed this agreement to get our approval of the ICC presidentship, which u got and installed yr man into that position and then didnt honor yr side of commitment that u signed with us keeping in mind that yr own government might not allow u to play us in future to begin with!

This is the whole case, and thats why PCB is asking for compensation.

ICJ in Hague? do they even get involved in economic disputes? Can you gimme a example?

not all countries recognize ICJ jurisdiction, you know that right?

The only court you have been to so far says whatever was signed was not legally binding and PCB was foolish to sign it. even Zaka Ashraf said so.

Do you have any proof that ICC presidenship was given for BCCI tours? If so why didn't PCB present it during this hearing?

there is an international sports arbitrary court too in hague......And they did presented in that hearing mister! but the ICC is a total BCCI controlled body! That president of india is still there in ICC....That is why people like Najam Sethi has responded the way he did, which i shared before.

Pakistan's whole case revolves around those claims that ICC presidentship was approved by PCB for indian candidate was because of they had signed this MOU with us to play series even knowing that their government wont allow it. This is where whole case of pakistan is based on, and thats why they r demanding compensation of 65 million for now playing 3 series as agreed in MOU.

you mean the court of sports arbitration?
1) they are not in Hague, They are in Switzerland
https://en.wikipedia.org/wiki/Court_of_Arbitration_for_Sport

2) BCCI and ICC are not signatories to that court. Do you have any source or link which says otherwise? There is a reason why BCCI doesn't have to follow WADA rules. Just becos cricket is sport doesn't mean that CAS have power over cricket

You keep repeating this icc president thing, do you have a source for this? PCB claim is that they supported Big 3 in 2014. they did not, they abstained

kaka g read the MOU..... And PCB was going to take ICC in that court during Ijaz Butt's era for kicking out Pakistan from hosting her share of WC matches in 2011 in UAE, instead of Pakistan because of 2009 Sri Lanka bus attack, which yr BCCI had lobbied behind the scenes too for taking hosting rights away from Pakistan for WC 2011.......And the ICC was made to compensate to PCB in millions at that time too for not taking the matter to the Sports court and for losing hosting rights, which included hosting Semi finals too.

1) so you don't have any specific sources for any of you claims only vague tangents?

3 lawyers, including 1 appointed by PCB read the MOU and said its not binding. Same thing was said by Zaka ashraf

Looks like ehsan mani knows it too

PCB chief: Boards should stick together, not take legal recourse

https://www.sportstarlive.com/cricket/pcb-bcci-icc-dispute-resolution-committee/article25549266.ece

As the International Cricket Council (ICC) dismissed the Pakistan Cricket Board (PCB)’s case against the Board of Control for Cricket in India (BCCI) seeking compensation for India’s refusal to play bilateral series, PCB chief, Ehsan Mani, said it is time to move on.

This is kinda getting boring. bye

We have paid it. We paid it straightaway. It wasn't the ICC. It was the arbitration panel which ruled and we respected that. We paid approximately $1.5 million.

OOPS!
