Panama Case: Joint Investigation Team probe

So what's the latest? Army rejected half baked report of government, Imran did quite the show yesterday but seems dheet PM is hell bent on confrontation as evident from his jalsa in Okara. By the way what is army take on Jindal visit and secret meeting with PM? @Arsalan @PakSword @Farah Sohail @Verve
they are absolutely silent about Jindal's visit. For now.

No, its not "THAT". Its just scary for shareefs.. As some say.. they won't know what has hit them..
Yeah that is much more likely than anything bad happening within the ranks.

No.. Our Army is extremely professional. A coup is not possible in the next 100 years as well in shaa Allah..

They have been successful in taking out the name of Baji from this leaks. This was done in "the greater national interest" as we call it, but as they call it, it was done to get the report which was stuck due to the name being there..

So now it's like...

Army: Include our findings
Gov: Please accept our apologies

Army: No.. include our findings
Gov: Please no..

Army: No way.. we need to include the name of real culprit.
Gov: We are doomed.

Army: Hey hurry up.. we are having hard time facing our officers in different garrisons
Gov: Please.. NS is being disqualified in Panama... If you name the real culprit, there will be chaos.

Army: It's getting late.. where is the report.. give it to us.. OK exclude the name..
Gov: Thank you very much.. Report is coming in a few days
Army: OK we are looking forward to it..

Army: Hey where is the report? You asked for "a few days"?
Gov: It is just with the PM.. He is reviewing it and we will issue once he is done..
Army: OK

PM House: Notification issued.
Army: Hey what the f*** we only allowed you to take out one name, you changed the whole narrative.. not acceptable..
Int. Minister: Please don't go public.. You could have called us..
Army: Now you will tell us what to do and what not to do?
Int. Minister: Just wait.. it wasn't the report.. it is just the action on a part of it..
Army: Whatever... we need the actual findings

Int. Minister to PM: Hey I believe as soon as the report will be released.. they are determined to pick some people.. That is scary.. Because we know those people will tell the name of the real culprit.. We are doomed.

PM: Keep it for a few days.. I have got the assurance.. we are going to be political martyrs.. and you know.. martyrs never die..

Suppose in given circumstances MI & ISI excuse themselves as purportedly suggests by COAS to CJP - would that be a surprise for many?

Now; if it happens; what will be the confidence level of everyone over the structure of JIT - would anyone, including SCP have any faith in members from SECP, NAB, FIA, and SBP? And what if this bench in absence of properly composed JIT, gives decision when first report of JIT is presented; which obviously would be as absurd as Qatari Letter, if not more.

So u mean to say...tht army wants to pull put from JIT..necause then no one, even the SC will have no confidence on JIT, and then SC will itself throw the findings of JIT...like the qatari letter and declare NS guilt and disqualify him?

But still i think tht it will be weird now..since army has commented twice on JIT, and assured to play a fair role in JIT...

Also, we know tht Sharif family is an expert in giving twist and spins to every situation in theor favor.. They even distributed sweets after panama verdict. And then tried to shift the blame on their lawyers for not submitting all documents in front of SC..because tomorrow..if they present more forged documents..they can say..tht we had these documents before, but our legal team didnt present it..

So this is the level..to which they can spin any situation in their favor... Considering tht, if army pulls out now from JIT.....PML N will again give the spin..tht we have again struck a deal with army..and now...look..they have even pulled out of JIT.. What impact can this have..on the morale of rank and file..esp....after dawn leaks controversy???

And now N$ is puzzled and have asked Ch. Nisar, Ishaq Dar and one English to Urdu translator so he could better understand the report and issue directives. He will claim his innocence by stating "The report was in English that's why I could not understand it - hence the directive was innocent mistake" :lock:

So u mean to say...tht army wants to pull put from JIT..necause then no one, even the SC will have no confidence on JIT, and then SC will itself throw the findings of JIT...like the qatari letter and declare NS guilt and disqualify him?

Even if Army requested to be excused from JIT - it won't be happening in actual.

As then SCP's own words carry no weight in Panama Case verdict as it will be absolute contradiction of their own words; so either there will be JIT with ISI & MI or there will be no JIT and decision has to be given based on existing evidence, as compromised JIT will be blasted off in its first report submission within 15 days.

Forged documents had been discussed threadbare in PMLN meetings, and as I said many times Muneer Kamal (brother of Gov Sindh and Asad Umar) is key player - but one of the PMLN lawyer is totally against as he believes that it can make the case 5-0 as it will be perjury since under oath we have submitted that there is nothing else than what we have submitted.

Sharifs consider asking SC to expunge Godfather analogy

LAHORE: The Sharif family appears perturbed over the court’s reference to Mario Puzo’s novel Godfather in the Panama Papers verdict and is considering filing a review in the Supreme Court to expunge the remarks suggesting an analogy between the character and Prime Minister Nawaz Sharif.

The 540-page verdict begins with the quote from Puzo’s novel: “Behind every great fortune there is a crime”, originally attributed to 19th-century French writer Honoré de Balzac.

As opposition parties, in particular the Pakistan Tehreek-i-Insaf, latched onto the analogy to drive home the allegations of corruption against the PM, several Pakistan Muslim League-Nawaz leaders spoke out against the choice of analogy used in the verdict.

“The reference to Godfather in the [Panama Papers] judgement is disturbing. We are considering filing a review against such remarks in the apex court,” Punjab Law Minister Rana Sanaullah told reporters in front of the Punjab Assembly on Saturday, adding: “We seek guidance from [the] Quran, not Godfather.”

The legal team representing the Sharif family is considering all legal aspects of filing a review petition. However, it has not yet arrived at a decision in this regard as yet. “So far it has not been decided to file a review for expunging certain remarks in the Panama [Papers] judgement,” Advocate Salman Akran Raja, counsel for the Sharif family in the Panama Papers case, told Dawn.

To a question of whether there have been past examples of requesting expunging of remarks, Advocate Raja said: “There are many such examples in our judicial history.”

However, there are some on the Sharif’s legal team who believe that the PM should not use the option of a review as challenging the court’s remarks could open a Pandora’s box for the prime minister facing an investigation by the Joint Investigation Team. “In case we challenge the adverse remarks, any further adverse remarks may not only make headlines but also provide another opportunity to the opposition to target the Sharif family,” a PML-N leader said.

Former federal law minister Khalid Ranjah told Dawn that the Sharif family might not file a review considering various complications.

“The whole judgement is full of adverse remarks about Prime Minister Nawaz Sharif and departments like NAB, FBR and [others working] under [the PM]. He may not get any relief from the apex court in this regard. This is the first time in the history of Pakistan that the SC [has] made such remarks about a sitting prime minister of the country. It is not some kind of an error in judgement that the premier is seeking to expunge. The premier has been declared dishonest and untrustworthy in the judgement unanimously by all judges on the bench. Does the premier think he will get relief in a review? If he does, he is seriously mistaken,” Mr Ranjah said.

It is for the first time in Pakistan’s history that a sitting prime minister will appear before an investigation team (JIT) probing allegations of financial misconduct against him. The SC is likely to announce the composition of the JIT next week.

Godfather analogy is not part of verdict.. Its part of dissenting judgment... So if sharif family goes for review, judges or atleast the dissenting judges can always say..tht its not even part of the main judgment, why have u gone for a review of something..which is not par of th verdict? Can other judges even review the statement, which is not part of the verdict?? Also i think..Justice Khosa, would have included it..and Justice Gulzar would have agreed to it, after much consideration.. I dont think...they will backout of it now...at any cost..since it will make themselves look bad ..or accept tht they made a mistake.. Then their whole judgment, or POV, not only this remark, will lose any importance or credibility

I am sure very soon he will be, from Principal Secretary to Wa'ada Ma'af Gawah :)

Hope so too.. The sooner it happens, the better..

Only immediate family of N$ and some sycophants who are more loyal than the king are suggesting review route - large majority of PMLN is against it and advising to avoid review fearing further humiliation.

Ok one more thing..regd panama....I now think tht JIT monitoring bench will decide the disqualification too.. Because theres some news...tht pakora judge is going on long leave.. Nusrat Javed tweeted this too..and even earlier there was news tht pakora judge is going on leave.. So new bench will have to be formed

Also, if we see court order, carefully it says tht matter of disqualification might come up..at any time...whether after 60 days or after any periodical report of JIT.....so within 60 days, if after any periodical report of JIT..matter of disqualification can come up...and PM or any other person can be summoned for this purpose..tu is se tu lagta hai ke jo bench JIT ko monitor karay ga..wohi disqualification ka issue bhi decide karay ga....kiun ke wohi bench..priodical reports consider karay ga...aur phir us ki basis par kisi bhi stage decide karay ga ..ya karsakta hai ke disqualification ka matter...

However..if an entirely new bench is formed..tu unhon ne tu case suna hi nahi hoga..how will they decide properly on issue of disqualification? Justice Khosa aur Gulzar ka new bench main hona...awkward sa lagta hai..because they have already given their verdict.. Ab tu pakora judge bhi nahi honge..tu at max...advocate aur Justice Ijazul Ahsan is bench main hosaktay hain, aur unke ilaawa koi aur judges bhi

.
Aaj tak tu JIT ban jani chahye.....7 days kab ke guzar gaye..aur kal tu advocate bhi turkey se wapis aagaye honge... Aaj JIT ke members finalise hojanay chahyein.. No reason for further delay..aur JIT monitoring bench bhi uske saath hi announce hona chahye

. .
All are free today...public holiday.. Tu hopefully...aaj unhein JIT Ke members finalise kar lenay chahyein...

@PakSword @Guvera @Arsalan

Aur hopefully JIT ke saath hi SC JIT monitoring bench bhi saath hi banaa dein.. Because i now think ke JIT monitoring bench hi disqualification ko decide karay ga....

Acha waisy..is week abhi tak Justice Khosa ka koi case nahi hai..kisi supplementary cause list main bhi koi zikr nahi hai, abhi tak...is week ke liye..

I hope woh JIT ke monitoring bench main hon..lekin ziada umeed nahi hai ke honge

Waisy mujhe tu yeh lagta hai ke all three options woh hain..jin kne liye review petition main jaana hoga...bas ye hai ke kis cheez ke liye review main jaayein? Review main tu wohi bench hota hai

Lekin kiya aisa possible hai..ke review petition main na jayein.....balke bilkol hi ek alag petition daalein ye log...judges ke remarks ke against.......jis ke liye ek new bench banay aur uske aagay..judges ke remakrs ka matter aaye? Kiya aisi koi possibility hai??? Mujhe tu nahi lagta ke aisa possible hai.. Review main hi jaana paray ga.. Koi aur bench shayad sirf remarks ke review ke liye nahi beth sakta....

Because i now think ke JIT monitoring bench hi disqualification ko decide karay ga....

Wrong.. 2 judges have decided.. 1 is remaining.. even if JIT doesn't complete it's work and one of the three judges decides to go for disqualification based on the evidence at hand, NS will be considered disqualified.

I have discussed with someone.. he says that even now, one judge can change his mind, if required.

It was a part verdict.. 2 have already made up their mind, three have started JI.. JI is even more lethal as the 2 judges stopped on disqualification, investigation may reveal crime of money laundering as well.. which will result in additional criminal cases against Shareef Family.

I told you, for a developed country, this judgment is the best, for Pakistan, it's 50-50 because of the selection of JIT members by government itself.

Waisy mujhe tu yeh lagta hai ke all three options woh hain..jin kne liye review petition main jaana hoga...bas ye hai ke kis cheez ke liye review main jaayein? Review main tu wohi bench hota hai

It seems they won't do it.. because they only have one review chance.. They will probably avail it once they are disqualified by the third judge.

It's all hogwash by Shareefs.
