The killing of combatants in a conflict zone is an acceptable part of war.

Some people will argue that there is no 'deliberate intent on the part of the Indian military to kill civilians'. However, what this defense ignores is that both the Indians and Pakistanis are well aware of the fact that certain parts along the LoC and IB are heavily populated.

Any escalation in firepower, especially resorting to mortars, carries a high risk of civilian casualties. Therefore the statements by the Indian BJP and Modi of 'escalating the quantity and level of small arms and artillery exchanges against Pakistan' is a deliberate statement of intent of killing Pakistani civilians and therefore a statement of intent to commit war crimes.
