I remember, last takeover was under forced circumstances.
After Kargil, India asked NS to deliver Musharraf, where Musharraf fought back his life and rest of passengers.

Without getting rid of all 3 popular political parties, its not possible to progress or army to do effective role.

Now as i told indians all intelligence agencies keep a close eye on their enemy spy until his mission is revealed and all evidences are gathered during this time. no mentioned of stay order. By all measures it means Pakistan should find some good lawyer and appear before the court.

2) Issue raised by India is of 'Human Rights Violation' as per International Laws and therefore It will be accepted as no counsellor access was given despite KbY having genuine Indian passport.

3) Pakistan has to take all evidence to incriminate KbY and India to ICJ. In Fact it is a God sent opportunity for Pakistan to expose India Internationally

Legal experts need to provide reasons
Indians must be fool that they didnt covered up the jurisdiction role.

2) Pakistan will fight this case at any cost.

Well since pakistan is signatory, it has to fight respond / fight the case, no other option out

KY confesional statements under custody doesnt hold much ground. They will have to come up with some strong evidences.

1) terrorists don't have human rights and this is an internationally recognised stance.
2) counsellor access can't be given to spies.
3) Kalboshan death sentence is our domestic and security matter. According to declaration by Pakistan in march to UN , ICJ have no juristriction over domestic and internal security matter.
The same way ICJ have no juristriction over india disputes with common wealth countries. Hope you get it.
Pakistan can simply say to ICJ through letter that it's our domestic matter as kalboshan was a terrorist and ICJ have no juristriction on our domestic matters. Same way as china did with ICJ at south asian sea.

That Col is also dead for us, actually his brain is dead who can not see the bait, so you can keep him anyway ..
for KY i know our govt/Army will release KY in the end, all this drama of hanging him will end, and when he cross the Wagha he will say he was Spy just like another one we released ..

i think i wrote the reasons too. Kalboshan was caught doing terrorism , which makes it our domestic matter. According to declaration made by Pakistan in march ICJ now don't have any right over Pakistan internal security and domestic issues. Hope you get it now.
India have already benefited from this juristriction issue due to some declaration made in 1974. It's our chance now.
