1. He has been proven a spy and a terrorist in our country court.1- One is not an spy unless its proven in court.
2- Unless proven, one is innocent.
3- An innocent need to be provided fair trial and his choice of defence.
4- Viena Convention safeguard his rights.
5- Even if he is a serving armed force officer and raising war on pakistan, he shall be treated as per geneva convention.

2. He is not innocent and he confessed it.
3. Even a terrorist like kalboshan was given a free and fair trial under the law of the land.
4. Vienna convention safeguards his right but 2008 agreement don't.
5. He was not raising any war during a time at which war was declared but doing it in peace time. And according to your definition if he is a POW then he can be subjected to crimes against humanity and be treated as a war criminal for his role in killing civilians.
And plz don't tell me That Pakistani courts are kangroo blah blah.
Ajmal kasab was never proved guilty at ICJ too. This doesnot mean he was never proved guilty at any court.
