Shimla agreement was violated by India unilaterally by bulldozing clause 2,3, 6 in 1984, Shimla agreement didn't explain either a party hold right to invite third party into issue or not thus only approached to both parties for peaceful solution of conflicts or issues hence it has no binding on Pakistan since India violates it.

Since India & Pakistan is strict on CFL in disputed area both countries keep right to get possession literarily but India not on actual grounds as Nahru promised to give Kashmiris right for desired accession.

Even if UNSC resolutions on Kashmir are passed under chapter 6, it was/is the duty of democratic/secular duty of India to respect the mandate of Kashmiri people but not to mass kill to form PDP with frightened, harassed & assaulted innocent people with some purchased leaders thence Pakistan respects UNSC resolutions and will continue to extend its political,moral, strategic support to get free from inhuman, extremist governance.
I believe you are refering to siachin. There is no violation by India as Simla Agreement did not draw the LoC beyond NJ-9842. India only sent its troops for patrolling beyond NJ-9842 until the Chinese territory. UN resolution under Chapter 6 is not binding but still India was comitted to it until Pakistan decided not to withdraw her troops from Azad Kashmir and the subsequent wars made the resolution redundant and meaningless.

Kashmiris in India have all the freedom and power that all other Indians have. Our constitution does not debar a kashmiri or a muslim or any other citizen from occupying the highest posts in the government. The killings happenned in Kashmir when Afghan Mujahideen were diverted to India by Pakistan after Soviet withdrawal from Afghanistan. Now Kashmir is by and large peaceful. People are freely participating in political process. We dont have any issue when you provide moral and political support to separatists in India but we do have problem when you support violence and terror in Kashmir or other parts of India from your soil. As regards to exmtremist governance please be aware that our government has never used drones or air force against the extremesits nor our army has caused any exodus of kashmiris which often happens when armies resort to brutalities. We have seen people leaving their own countries like east pakistanis in 1971, Afghans in 1979, Tibetans after 1959. Have you heard about Kashmiris leaving kashmir to escape the brutality of Indian Army? No, because its not real. Its just a propaganda.

Only 34,000 refugees over 22 years???? This looks more like the number of misguided separatists.
By the way the govt of India has announced many schemes for amnesty and rehabilitation of such people who crossed over to Azad Kashmir in the past to wage "jihad" against India.

Pak. denies visa to PDP leader, says Hurriyat represents J&K

We believe the Hurriyat is the true representative of the aspirations of the people of Jammu and Kashmir, an official of the Pakistan High Commission said
Hardening its position, Pakistan has denied visa to Peoples Democratic Party (PDP) spokesperson Naeem Akhtar to attend a Track-II conference in Islamabad next week, saying the “Hurriyat is the true representative of the people of Jammu and Kashmir.”

Pakistan High Commission sources here told The Hindu that the decision was taken to “reiterate” this stand.

“Our stand on Jammu and Kashmir is very clear. We believe that the Hurriyat is the true representative of the aspirations of the people of Jammu and Kashmir, and we believe that issuing a visa to Mr. Naeem Akhtar would not reflect that position,” an official said.

While visas had been denied to many Indians planning to attend such conferences in the past, the statement linking the decision to the stand on the Hurriyat is significant as it is indicative of the hardened stand after India cancelled Foreign Secretary-level talks last year over High Commissioner Abdul Basit’s discussions with Hurriyat leaders.

What makes the decision more surprising is that the visa denial comes even when Prime Minister Narendra Modi has decided to send Foreign Secretary S. Jaishankar to Pakistan in March, and the Bharatiya Janata Party is in talks with the PDP to form an alliance government in J&K. Even the Hurriyat Conference did not seem to approve of the Pakistani move. “We believe there should be more, not less engagement between the people on both sides of the ceasefire line,” its chairman, Mirwaiz Umar Farooq, said on the phone.

Mr. Akhtar told The Hindu that he had not yet heard officially about the visa denial and was surprised by the decision.

Cancellation of talks made Pak. toughen stand

The denial of visa to Mr. Akhtar is in line with a toughening of Pakistan’s position over the past year on Jammu and Kashmir, especially after the cancellation of Foreign Secretary-level talks by India over High Commissioner Abdul Basit’s discussions with Hurriyat leaders.

Pakistani Prime Minister Nawaz Sharif’s speech at the U.N. General Assembly contained strong allegations of human rights violations by India, and on “Kashmir Day” this month, he referred to the State as the “jugular vein” of Pakistan. In contrast to previous elections in J&K, Pakistan issued a statement in December calling the recent elections a “sham.”

What these denote are drawing of new, harder lines between India and Pakistan over J&K. Just as the Modi government indicated last July that Pakistan should not have engaged with the Hurriyat ahead of talks, Pakistan now seems to indicate that it will no longer engage with anyone but the Hurriyat.

The External Affairs Ministry did not comment on the denial of visa, but it remains to be seen if the new move by Pakistan will have any impact on the fledgling attempt at restarting Foreign Secretary-level talks.

Mr. Akhtar was due to visit Pakistan to attend a “Track-II” conference organised by the Jinnah Institute in Islamabad and the Centre for Dialogue and Resolution in Delhi on February 25. “It means Pakistan is going back on its earlier stand, so they must explain if their earlier decisions in inviting mainstream Kashmiri leaders like Mr. Omar Abdullah or Mr. [Saifuddin] Soz or other Ministers flawed,” Mr. Akthar said.

In the past few years, Pakistan has allowed visits by several J&K leaders from the PDP, the National Conference, the Bharatiya Janata Party and the Congress. They include PDP leaders Mehbooba Mufti, former Minister Tariq Hamid Karra and Ifthikar Ansari and Nirmal Singh of the BJP.

Rich when you think that Pakistani forces pretty much displace whole areas in the name of fighting insurgents. Before they send in fighter jets & artillery to bomb the hell out of their own country. They even have a term for these displaced people - IDP's, internally displaced people. Of course the bowl then goes out asking the Americans to help out, they were scoffing at the $250 million that Kerry gave them like it was chicken feed. Apparently they believe in their entitlement to American money to look after their own people, displaced by their own army.

When you (a poor innocent civilian of India) saying 'no violation of an agreement'....i can understand but on state level situation is quite different. Where is written in Shimla agreement that a Non-Demarcated area should be solved by military invasion by calling it just patrolling up to NJ 9842? Wasn't written that any issue will be settled by dialogues in peaceful manners? The who is aggressor? Or you still want to be saint?

Show me a single bilateral agreement not violated by India first? I would like to inform you about Jinnah-Mountbatten talk in 1947 when it was proposed that Pakistan and India both will withdraw their troops for peace full plebiscite and It was Patel refused to participate by saying 'Nothing to discuss with Pakistan'. Now who took U turn and aggressor? And you are taking position that Pakistan should withdraw troops to let Indian expand more legs? Kid, In which world you are living?! In which UNSC resolution stated that Pakistan should withdraw its troops unilaterally? Put a copy-past and enlighten me. May be i was missed something from past.

Compromising and continue to live by protecting lives of families with aggressor power didn't called a natural aspect of living,and that's what is happening in disputed territory and even Islam allows to protect lives under aggressor's ruling but fate of aggressor is written at last and i described it in last posts.
