Utter nonsense. Kashmir was an independent, free state according to the Indian Independence Act of 1947 passed by British Parliament to which both new dominions - India and Pakistan agreed.
The Maharaja of Kashmir signed a Standstill Agreement with the State of Pakistan which Pakistan violated.
