NEW DELHI — Italian company Oto Melara will not be permitted to participate in a $400 million global tender issued recently by the Indian Navy for 110 30mm naval guns because of an ongoing probe into charges of corruption against its parent company, Finmeccanica, a source in the Ministry of Defence (MoD) said.

The tender issued under the "Buy and Make" category has been sent to Israeli companies Rafael and Elbit, South Korea's Samsung Techwin, and British companies BAE Systems and EM Digital.

"Since it was competitive bidding, Oto Melara could not have been allowed as per government policy," a Navy official said.

Prime Minister Narendra Modi's government said after coming to power in May 2014 it would do no further business with Finmeccanica companies pending a final opinion by India's legal authorities in the case against the Italian group. Finmeccanica's AgustaWestland stands charged with corruption in connection with India's purchase of VIP helicopters worth $640 million in 2010, an MoD official said, and a probe by India's Central Bureau of Investigation is ongoing.

The Indian probe continues despite the fact that the Italian investigation that prompted it ended in the aquittal at trial of AgustaWestland's then-CEO Giuseppe Orsi, who later became Finmeccanica's CEO, on corruption charges.

The Indian decision put on hold a long-pending deal worth $300 million for the purchase of 98 Black Shark heavyweight torpedoes, manufactured by Finmeccanica's Whitehead Alenia Sistemi Subacquei (WASS) and urgently required for the six French-designed Scorpene submarines being built for the Indian Navy at state-owned Mazagon Docks in Mumbai.

"When various companies are able to offer a product to India, Finmeccanica companies are currently excluded from bidding," an Italian source said. "But if only two companies can offer a product, one of which is a Finmeccanica company, then it is admitted for the sake of competition. For smaller-caliber cannons there are numerous contenders."

The tender for the 30mm naval guns was issued in March 2013 but no overseas vendor participated because there was a condition of transfer of gun barrel technology to state-owned Bharat Heavy Electronics Ltd. (BHEL), which will produce the guns under license, the Indian Navy official said.

"The condition for transfer of technology of the gun barrel has been removed in the latest tender issued last week and we expect a good response from overseas companies now," the Navy official added.

Another Navy official said Oto Melara's participation would have been preferred because India is already using 76mm naval guns license-produced by BHEL under license from the Italian company, and Oto Melara's gun technology is "superior."

Delay in acquiring the 30mm naval guns has led to "frequent overhauls of existing Oto Melara guns," said Shyam Kumar Singh, a retired Indian Navy captain.

The Navy plans to purchase 110 30mm naval surface guns with electro-optical fire control systems (EOFCS) along with ammunition. The technology transfer will be done in favor of Haridwar-based facility of BHEL, Chennai-based facility of state-owned Bharat Electronics Limited (BEL) will get technology for the integration of the gun system. The ammunition will be license-produced by India's state-owned Ordnance Factory Board.

"Defence Minister Manohar Parrikar has announced on several occasions that a new defense procurement policy [DPP], which could include policy changes in the blacklisting of overseas companies, will be announced," defense analyst Nitin Mehta said. "However, the new DPP of the new government is still awaited."

Stupidity, they are the best out there.We need to keep them at good terms .

If they wish they can stop selling us ,the more important 127mm, 76mm guns.


But if China was at our place , then they would have simply combined the electronics present with the CRN91 gun.

MTCR, and new SC expansion where Italy has taken ;lead with our dear friend,,, a Italian economy which can fall to junk status officially the moment Euro faces any more crisis.

Italy these days has taken very leading position in anything against India in UN. No wonder they are getting response like this. Barring Italian companies is a good step.

Please someone explain me this.......o_O.. In above paragraph it is written that no technology will be transferred but in latter paragraph it is written that there will be an agreement for Technology Transfer......:o:.......

Just old wine in new bottle.
Barrel is key technology in Gun neither FCS or other things we can develop locally.

What about the support of the ones that were already procured?

Bound to provide support as part of contractual obligation. Moreover i think its done via BHEL with whom Oto Melara had collaborated as part of the contract.

OTO Melara's 127/64 LW - Vulcano gun system has been chosen to arm 13 Shivalik-class frigates and Delhi-class destroyers
OTO Melara was the sole bidder for the requirement after BAE Systems decided not to go for the contest
India's Ministry of Defence (MoD) recently approved the INR15 billion (USD243.5 million) procurement of 13 127 mm guns for Indian Navy (IN) warships, for which Italy's OTO Melara was the sole bidder. ( i think in Jan 2015)
The November 2013 tender stipulated that three of the 13 naval guns would be imported and the remaining 10 licence-built by state-owned Bharat Heavy Electricals Limited (BHEL) at Haridwar, 200 km north of New Delhi.
Clearance for the OTO Melara gun is unlikely to be problematic as defence minister Manohar Parrikar recently rejected blacklisting defence vendors as such a move would restrict India's materiel procurement options.
"Finmeccanica has 39 subsidiaries. Should we stop dealing with all 39? I don't agree. The military needs equipment," Parrikar told a Delhi-based television news channel on 12 December.
Since its single bidder, and MOD approved, i dont see it as a problem.

To be fair guys, I don't think this is as politically motivated as that. This is the MoD/IN/GoI complying with the findings of the Attorney General of India.


The terms, which has been cleared by the Attorney General, state:


* All ongoing contracts will continue unhindered.
* All contracts related to spares will continue
* Contracts with Russian manufacturers, where Finmeccanica group is involved in the back-end, will continue
* Finmeccanica will be allowed to participate in all tenders but if there are multiple options, the group will not be considered regardless of the competitiveness of the offer.
* However, where the group is the single vendor with no other firm providing options, the government is empowered to go ahead with the deal.

So from where we will procure 127mm guns?

The 127mm guns will still be coming from OTO as per the Attorney General's Guidelines from last year, as stated below:

"But if only two companies can offer a product, one of which is a Finmeccanica company, then it is admitted for the sake of competition. For smaller-caliber cannons there are numerous contenders."

The AG's ruling said that if there were more than 2 other bidders any Finmeccanica would be barred from taking part in the tender, if it was a Finmeccanica company and one other they are allowed to take part so as to avoid a single-vendor situation. Some pragmatism at last.



God damn it feels good to have a pragmatic DM and GoI that seems to actually be interested in securing India's interests.
