Something seriously wrong with Pakistan society and courts as this is too regular a occurrence. 13 with 44 year old.
And not from some remote village but in the heart of Karachi.
Court allowing legal child abuse on a regular basis.
Shameful.

This whole thing smells fishy. No article I found interviewed the girl or asked her opinion of the matter, only her family. And none of them said which documents are real? The picture makes her look like shes 13 but it looks to be an old one.

India is a equal opportunity society for criminal acts. The cases will drag through the court systems.
But never heard of regular kidnapping of minority kids for marriage to Hindus.

And the beef reference is more comparable to the offense to religous feelings like the cartoon controversy. I am sure you justify the killings in France as the muslims have been insulted ? So support the Hindus angry for their beliefs ?
I personally have had beef both in India and abroad, i am not a believer.

Early Marriage after post puberty age

Under the Islamic laws when a male and female child complete the process of puberty and have their first ejaculation or menarche (first mensuration cycle) are considered as adults and all Islamic laws become applicable on them. Even their sins are being noted by the angels Raqib and Atid (Kiraman Katibin) and will be held accountable on the Day of Judgement.

A girl after the first mensuration cycle is eligible for marriage and/or subsequent consummation. However, the Nikah (marriage contract) is always finalized after the consent of the bride.

Islamic laws (Sharia) are the modern laws and very much applicable in a modern Islamic society. Early marriage of a young men and women eliminate the possibility of illicit relationships between the two sexes and hence avoiding many crimes related to sex.

Raymond Davis Case

As far as Qisas (accountability/retaliation) and Diya (blood money) is concerned, Holy Quran clearly specifies the principles of Qisas and Diya:

O ye who believe! the law of equality is prescribed to you in cases of murder: the free for the free, the slave for the slave, the woman for the woman. But if any remission is made by the brother of the slain, then grant any reasonable demand, and compensate him with handsome gratitude, this is a concession and a Mercy from your Lord. After this whoever exceeds the limits shall be in grave penalty.— Quran 2:178

We ordained therein for them: "Life for life, eye for eye, nose for nose, ear for ear, tooth for tooth, and wounds equal for equal." But if any one remits the retaliation by way of charity, it is an act of atonement for himself. And if any fail to judge by (the light of) what Allah hath revealed, they are (No better than) wrong-doers.— Quran 5:45

It is not for a believer [Muslim] to kill a believer unless (it be) by mistake. He who hath killed a believer by mistake must set free a believing slave, and pay the diya to the family of the slain unless they remit it as a charity. If he (the victim) be of a people hostile unto you, and he is a believer, then (the penance is) to set free a believing slave. And if he cometh of a folk between whom and you there is a covenant, then the diya must be paid unto his folk and (also) a believing slave must be set free. And whoso hath not the wherewithal must fast two consecutive months. A penance from Allah. Allah is Knower, Wise.— Quran 4:92

However, Raymond Davis being a non-Muslim killed the victims deliberately and not by accident, therefore provision of compensation is questionable according to various Islamic schools of Sunni as well Shia origin.

The marriage of a 13-year-old is not compaitable with modern society.
If you think that's a strict Islamic law, then no, it's still not compaitable.

Society has changed, it's child centred. They're not mature enough just because they have passed puberty.
You should have proof or evidence that the decision of taking blood money by the victim's relatives was forced upon them. Accusation without any evidence is simply a invalid statement just to create hype.

There is a possibility that the relatives were given incentives and adequate amount of blood money.

Furthermore, this decision was taken under the supervision of court, and no no mullah was involved.

However, correctness of the decision is debatable issue because the killer was a non-Muslim and the crime was deliberate, not an accident. If this case was under trial in Islamic court, the decision would have been more "interesting".

Islam and its teachings are for the most modern societies. Islam is not only a religion, but also a complete code of life. Islamic code of conduct is based on human nature - strength and weakness. Right (Halal), wrong (Haram) and acceptable (Makroo) are well defined. By implementing Islam and Sharia in a society, crime rate will be reduced to zero as there will be fair justice available to every cast and creed.

The problem is that we Pakistanis from top to grass root level, failed to implement it. Pakistan is created for Muslims, its essence is Islam, but we - Pakistani nation are ignorant never realized what our founding fathers Qaid e Azam, Alama Iqbal and Chaudhry Rehmat Ali dreamt about Pakistan.

My dear friend, we've been applying these 'most modern of modern' Islamic laws for the past 60+ years, we saw Zia's era and even "liberal" governments force Islamic laws under public pressure.
As you can see the result is pretty Islamic and modern. I am sure every moderate Muslim is dying to live in the Modern Islamic Republic of Pakistan, and not abroad, and also has no reservations over the situation of the country in every sector.

We all know about the Jagjit Kaur drama. A Sikh girl fell in love with a Muslim boy, decided to convert to Islam of her own volition and marry him. Then her family couldn't handle the dishonor so they accused the Muslims of having kidnapped their daughter and forcefully converted her to Islam. Then the story because international headlines, with Capt. Armarinder Singh the East Punjab CM exploiting it to poison Sikh minds against Pakistan. So the Pakistan government was under pressure to return the girl to her family, but when she was interviewed by the courts and it became clear she didn't want to return to her family, the shameless Sikhs began saying that she was being coached and "groomed". This is the same type of accusations Sikhs used to make about Pakistani Muslim boys in the UK, that the reason their girls are running off to marry Muslim boys is because the Muslims are grooming them.
But I think it's something else. The truth is these Sikh, Hindu and now Christian girls in Pakistan prefer to marry a Muslim because in all honestly why would a beautiful young Sikh woman want to marry a turban wearing hairy, uncircumcised Sikh man?
Look what the Sikh scripture says, it reveals the psychology and insecurity of the Sikhs:

Sakaṯ sanehu kar sunaṯ karī▫ai mai na baḏ▫ugā bẖā▫ī. Ja▫o re kẖuḏā▫e mohi ṯurak karaigā āpan hī kat jā▫ī. ॥2॥
Because of the love of woman, circumcision is done; I don't believe in it, O Siblings of Destiny.
If God wished me to be a Muslim, it would be cut off by itself.

According to the Sikhs, we circumcise ourselves for the sake of women, because apparently women prefer to have relations with a man who is circumcised. So this reveals their psychology that their girls secretly desire to be with a circumcised Muslim man and why they are so sensitive about their girls running off with Muslims. After all, the Muslim community never had a problem of our girls running off to be the girlfriend of some Sardar

The other side is that we believe a 13 year old kid indeed married a 44 year old guy.
That side is not legally acceptable or morally.

If you look into your grandparents' ages, I am sure you will find the same thing. It was more prevalent back then.

She's most probably 13, even the way she speaks shows she's a bit too immature...with that in mind consent and culture ko maaro goli it shouldn't be allowed in the first place period

In many places in Pakistan this is normal. We cannot stop people from marrying, nor should we.

Islamic stance on that is clear.

If we throw out our religious laws, then age of consent can be enforced, otherwise it is puberty according to Islam.


Apparently Catholic church played politics to secure funding from International NGO, using this case.

Something needs to be done about these NGOs and these Church politics, esp if even liberal diehard Jibran Nasir is warning us.

If she is a convert, she doesn't need consent from her parents. Fiqh recognizes her own right to choose or she can take a Muslim Wali.

2. Is she marrying of her own free will?
3. She needs consent from her parents or Wali?
4. Is she a convert? and did she convert on her own free will? Will need a testimony of the Sheikh.

From what i know so far and the actions of the other party suggest that something is not right here.

1,400 years ago in a totally alien culture. Islam is not Arabism, we do not (and should not) mimic everything from 7th century Arabia (and I'd go as far as to argue that much of what we have borrowed from that detestable culture ought to be chucked right back out into the sea where it came from).

The court is the best place to prove all those points, and according to her statement, she doesn't want to go back to her parents and wants to remain Muslim and married to her husband.

It is her choice and I 100% support what she chooses for herself.

If she wishes to go back, then I support her also, but she doesn't want to.

That was a very different time. A 13 year old isn't mature enough.

In Islamic fiqh, the rule is already established. We don't expect non-Muslims to understand.
