Well ayesha if you consider the state of victim and the life she had to spend (on support of others), (sorry for wrong choice of words), but she was no better than a dead person. She lost her dream, life and everything else, and for her medical condition, Hospital management should've known, that she has nothing to loose.
In these circumstances, Rape charges should've been pressed and strictest punishment meted out to the beast who led to her condition.
It wouldn't have made any difference to Aruna, but atleast made out an example for others than such a wrong doing and ruining an innocent life will lead to harshest possible punishment.

Getting emotional now is what I question, this case could & should have been dealt with strictly when the crime happened, What is the point now when that poor woman has been in a vegetative state for so long.
The rapist was never prosecuted for rape - so whether or not 42 years have elapsed, he still remains unpunished for that crime.

If so, they should also be prosecuted for obstruction of justice. OoJ is itself a crime, not a defence.There is absolutely no chance of a reasonable prosecution now with such a tampered case. Quite a lot of people were involved in acts of covering up which pretty much qualifies as obstruction of justice.
I'm sure there is evidence for anal penetration - that can be established even from her corpse. Besides, since then, many people have spoken up about what really happened to her. We absorbed different provision in different democratic countries for our Constitution.
I was talking about some aspects about Sharia law for punishment cases like this.
