Mumbai gets its first Shariah court to settle civil, marital disputes

Shariah courts? if india starts turning into a pakistan like this, as a christian, i am not going to feel very safe and may have to emigrate

Lol. It is probably pathological. Unless he imagines a NE muslim, he cannot get motivation to speak against racism towards North Easterners in India.
 
Our legal systems has been anyways marred and mangled by loopholes and is run by jokers, this will be just another addition to the circus.

He can't. The judges of these courts are not the fatwa issuing mullahs you imagine them to be. These people are well-versed in law, at least to the extent of cases they deal with and their limits of jurisdiction. The fatwa factory in India is a separate institution called Dar-ul Uloom Deoband.

If a judge proclaims that the wife be killed like you said, the same thing happens as what would happen if a normal civil magistrate orders the same thing. The order will be appealed in a higher court and the judge will be hounded in media.

The shariah court only stands as a symptom of the separate civil code which we have. There is nothing to get alarmed by the court as such. They were in place for a long time now. I would be happy if the jurisdiction of the civil code excludes alimony and child support, equal marriage and property rights for women.

Beyond that there is not much gain in pushing for a uniform civil code. Any Indian members here disagree? @Bang Galore ?

However, seriously speaking, no such courts ever go beyond the purview of the Supreme Court, and these courts have also been functioning without much controversy for quite some time in different parts of India.

Thus, it is not only fine, but also very logical since the right of people to practice their tradition is preserved.

Such news should always be welcomed in a democracy where people can raise their voices against any judgment that goes against their common sense. Remember the case of "Talak Talak Talak"?
 
People are getting their imagination run wild now. These courts are purely personal law, not criminal.

However these guys can be totally cuckoo - remember the imrana rape case, the shahbano case? I totally oppose religion based courts, law of the land must rule. The really religious pious people shoud simply lead a perfect life and never need courts and stuff, problem solved :lol::lol::lol:

Shariah is what keeps Muslims backward.

Dont celebrate this news...pity them.

I would be too. Precisely the reason it will not happen. Once the women have their freedom, these religious laws are on a one way road to the nearest dustbin.

Morally....there has to be a uniform civil code. The fact that Muslim women who are Indian citizens have lesser rights than other women simply for a mistake of birth should not be acceptable to anyone. Outdated ideas like polygamy, ridiculous divorce rules that are gender discriminatory have no place in the 21st century. We cannot expect any change in God's rules, we will have to look at men for rules of better wisdom.


Practically, no change will happen. Muslims will continue to languish in backwardness for a very long time.

Not a good news for muslims, they could be coerced by to seek justice in sharia court.
But then its not much change from status quo, they were doing it elsewhere, so why not mumbai. I would say its the failure of civil courts who are understaffed and drag cases for years, making justice expensive. This might reduce the burden on courts though.

Its a waste IMO.

It is clearly not working in UK, so how do people expect that it will work in India or somewhere else.

In UK, there was clerics who told women to live with abusive husbands and denied to give them a divorce. Its useless, scrap it.

Saw a sting operation by BBC yesterday. They concluded the same.
 
I am pretty sure it will be at least as good as caste and village panchayats that we keep hearing about.

Actually that person was asking whether she can bring her husband to find an amicable solution. So it was not a complete denial. I believe it can do the purpose of counselling if implemented properly.

Mohammed Arif Khan (Naseem Khan) is a cheat...i belong to his constituency...all he has done in the name of development is zilch...he is a big cheat and is anti-development...because for him there are certain areas which are under developed in kurla....the jari mari road project is stuck since 2000 because he has got a lot of benami properties...his brother sharif khan is a big goon....and these guys are extremely communal.....

why you want to exclude these things mentioned in your post?

This court is more focused on the same things. Under Muslim law kids, women proprty rights are well guardeded.

Shariah is what keeps Muslims backward.

Dont celebrate this news...pity them.

why are majority hindus backward in India?
