Mumbai attack 'mastermind' Lakhvi detained under MPO

ISLAMABAD: Alleged mastermind of the 26/11 Mumbai attacks Zakiur Rehman Lakhvi who was granted bail by an anti-terrorism court in Islamabad yesterday has been detained under the Maintenance of Public Order (MPO) at Rawalpindi's Adiala Jail.

A senior government source told Dawn that the government has also decided to appeal against the approval of Lakhvi's bail in superior courts.

The ATC had ordered the release of Lakhvi after his post-arrest bail plea was accepted and Judge Syed Kausar Abbas Zaidi had set Lakhvi’s bail at Rs1 million. The decision drew a sharp reaction from India and surprised many with its unfortunate timing, coming just days after one of the deadliest terror attacks the country has ever seen.

Lakhvi is among the seven persons charged with planning and helping carry out the 2008 Mumbai attacks. The six other men facing trial in Adiala Jail for their alleged involvement in Mumbai attacks are Hammad Amin Sadiq, Shahid Jamil Riaz, Younas Anjum, Jamil Ahmed, Mazhar Iqbal and Abdul Majid.

At the time of the attacks, Lakhvi was believed to be the operational head of the banned Laskhar-i-Taiba (LT) that has been accused by India of carrying out the attacks in India's financial capital.

Lakhvi along with Zarar Shah was allegedly the key planner of the attack that killed 166 people.

The acceptance of his bail plea had come as Pakistan was mourning the deaths of school children and other victims of Tuesday's Taliban massacre and New Delhi had made a visible effort to show solidarity with Islamabad.

The massacre and the reaction to it was followed by Prime Minister Nawaz Sharif's lifting ofthe moratorium imposed on capital punishment in the country.

Atleast he is arrested till the appeal by government is heard about rejection of his bail.

Very thankful to the Pakistani authorities for acting rightly on this matter. I wish the authorities had done the same to those who spewed hatred against other sections of the society, esp those who termed Shia/Ahmedis wajib-ul-qatl. If such people do not qualify to be arrested under MPO, then MPO is useless.

Poor decision. The gov must respect the courts. Also the courts should have stalled his bail in order to let things cool off then bail him.

Great decision ...we really appreciate Pakistani authorities for arresting this hard core terrorist - monster. There is nothing called good & bad terrorists ... They are simply terrorists

24 hours ago the indians here were ranting and raving......now they've gone quiet.

if he posted bail then he posted bail and it was accepted....maybe some new information came out or for precautionary measures as MPO suggests, it was decided it will be better to keep him detained

Hafiz Saeed was also put under house arrest under this law he went to court and came out most probably Lakhvi will be out too.

Because threat perception is so high in South Asian countries . perhaps pak authorities realised that lakhvi is a threat to public order.

correct...within 15 days of his house arrest (under this same MPO) the prosecution by law had to produce justification to KEEP him under detention.....they were unable to do so due to lack of evidence from india and the prosecution itself

that's why he was released

Many a time ranting and raving brings an issue to the forefront where it becomes political suicide to ignore it.

MPO is a law that Pakistan uses often when bail is granted by a judge in cases of terrorism. It kinda absolves the judge from a decision often made in fear.

Not to the same extent of America's "precautionary measures" - which entails rendition sites and Gitmo bays :laugh:

I'd like you to consider something. It is not always a case of lack of evidence that leads to these characters freedom. Pakistani establishment and many others have spoken of their frustration with the judicial system which allows several terrorists to simply walk.

There are a few absolutes I can guarantee you, this is one of those. Hafiz Saeed is a terrorist, he was involved as one of the masterminds of the Mumbai attack. Evidence of his involvement was presented in our courts in Chicago and when Headley was tried and convicted by us.

Pakistan has plenty evidence to convict him.

I don't argue it is a precautionary measure, a measure that is only applied when bail is incorrectly granted by a said judge. Gitmo is not a precautionary measure, it is for non combatants aka non state actors found in countries.
