Motorway Rape Case: Both rapists sentenced to Death!

A special bench of an anti-terrorism court in Lahore has handed a death sentence to Abid Malhi and Shafqat Ali alias Bagga for raping a woman on the Lahore-Sialkot motorway last year.

The two men raped the woman in front of her three children on September 9, 2020. It took the police one month to arrest prime suspect, Abid Malhi, while Shafqat Bagga surrendered himself.

The police submitted challan in the case on Feb 20 and the accused were indicted on March 3. The court held seven hearings and reserved a verdict on March 18. Judge Arshad Hussain Bhutta announced the verdict at Camp Jail in Lahore today (Saturday).

Forty witnesses recorded their testimonies and the prosecution succeeded in proving its case.

Both accused were handed death sentence under Article 376 and life imprisonment under 365 A of the PPC. They were sentenced to 14 years in prison separately.

Here’s what happened during the trial:

—The woman was accompanied by the police to the jail for the identification of the suspects.

—The prosecution argued that they found the DNA of the two suspects.

—Abid Malhi confessed to raping the woman twice, while Shafqat raped her once. They ran away after snatching Rs100,000 from her.

—Qasim Arain, the defence lawyer, made the following arguments.

  • Call records don’t show Shafqat’s presence at the rape site.
  • Shafqat was identified 22 days after his arrest. The law says that suspects should be identified in one week.
  • Shafqat was coerced into confessing.
  • IO was present was Shafqat was recording his statement. This is against the law.
  • The policeman was who accompanying the survivor during the identification parade had seen the suspects before, adding that allowing him to accompany the woman was suspicious.
  • It was claimed Abid Malhi is 35 years old, while he is 20 years old.

Good! Former CCPO's investigation was done properly to secure conviction. 17 days of non-stop trial in jail and these scum have been sentenced to death. Let's see if libturds/aurat march lot start crying over this sentence now.
 
The real point is if we want we can close cases within days and months. I hope this speedy justice gets available to every person in Pakistan

As long as it’s done by the book. We don’t want to create a situation where people are wrongfully convicted and executed only to find out years later it was some one else. Proper evidence, identification, and interview techniques need to be assured.

But I agree with your general sentiment. Speedy justice is badly needed so every person can know they will get justice from the courts

But I agree with your general sentiment. Speedy justice is badly needed so every person can know they will get justice from the courts
This should be among the top priority of PTI. Police and justice reforms. Unfortunately its a provincial subject and we karachi people dont know anthying happening on this in rest of 3 province.

Can people from other than sindh tell us is there any improvement or atleast any restructuring in process.

Some friends of mine from KPK are very happy from PTI on this front. Whant about punjab and balochistan

Let's celebrate when they really will be hanged. Most probably after few years they will get bail . I've seen hundreds of cases like this.
A real justice means a quick execution or a quick surgical castration.Not handing over a lengthy sentence along with it so he will be able to breathe long ,enjoy his life on tax payers money before he will be out again to rape someone else.

my concern is that there is no cover-up and only real culprits are punished.

the way that tragic incident played out suggests that the culprits had inside information to be there in the dead of the night in wilderness when the victim made the distress call.

The white man will not allow free handouts if your suggestion gets implemented ------- no more asylums, no more "ease" of finding a safe heaven .


Imagine what would a segment of our elite gonna do with all that dirty money in case of a momentary loss of power and the one being at the helm of affairs is really pissed at them for any personal reasons ? Obviously they may want to run for the hills

Exactly, when a party literally with the name justice in its name is in power, the one thing it should do is deal with the backlog of court cases, so disputes are resolved and proper administration is assured to everyone that seeks redress in the courts.

If in the two plus years they have left in office, until the next election, the PM need to get this done in an organized and through manner. He just won his vote of confidence, so he has his mandate to make big changes. But, by the book, so innocent people are not swept up and punished for crimes they did not commit.
