LHC annuls new UCs
Justice Shahid Karim of the Lahore High Court Friday annulled establishment of new union councils and their headquarters by Punjab Delimitation Authority during the process of delimitation for upcoming local government polls in the province.
A number of voters and candidates of different UCs had filed the petition.
The petitioners had submitted that the delimitation authority acted beyond its jurisdiction by creating new UCs and their headquarters.
They said the authority did not take up their appeals against flaws in delimitation process and decided the matter ex-parte (one sided).
Creation of new UCs by the authority was a violation of section 11 (3) of Punjab Local Government Act, said the petitioners.
They further said that the law empowered provincial government to make new UCs.
A law officer, however, said that the new UCs were made in view of the increasing population.
After hearing both sides, the judge declared new UCs as null and void for being without lawful authority.
Moreover, the LHC sought detailed reply from the Election Commission of Pakistan on a petition challenging phase vise local bodies’ elections in the province.
Pakistan Justice Party had filed the petition and pointed out that the Punjab government wanted phase vise elections and, therefore, schedule of election had been issued.
The petitioner said that the schedule had been issued only in those areas from the ruling party had won the general elections while in the areas from where they could not win, the schedule had not been issued.
It was malafide act of the government, he said.
He prayed the court to set aside the phase vise elections of the local governments in Punjab.
After hearing initial arguments, the court issued notices to Election Commission of Pakistan and the Punjab government to submit replies by Sept 11.
