In the decision ,of the Libyan court is characteristically mentioned that....... "the interim government is prohibited from signing in any way agreements under the sovereignty of the Libyan state, on its land, sea and air territory, as well as agreements on the demarcation of borders or the exploitation of strategic natural resources, unless approved by the General National Congress,"
GNU Government is an emergency government, set up to manage a political transition following the collapse of the governing administration. Can not sign any treaties, has only one obligation: to take Libya to elections soon, which it is not doing.
The decision by the Tripoli Admin Tribunal to suspend the "hydrocarbon cooperation agreement" between Turkey & GNU has major implications for the maritime demarcation/security cooperation agreements. Judges based on the decision on this GNC legislation from 2013. The suspension is based on a lawsuit against the MoU filed by a lawyer.
