I want to make one clarification. What LHC heard, was not appeal against the judgement of the Special Court, but a special petition, made under Article 199 of the Constitution, challenging the prosecution process and the formation of the Special Court. Consequently, this present judgement is not against the judgement of the Special Court, which has not even been discussed. The process of the prosecution and formation of the Special Court, which are executive functions, have been annulled and, consequently, the decision of that court then automatically stands annulled and void, as well.

The special court's formulation was a directive of the Supreme Court and high Court in no way can supercede any order of the SC.
