UNITED NATIONS: Pakistan once again resorted to its old tactics of raking up Kashmir in the United Nations when its President Asif Ali Zardari sought a solution to the issue under UN resolution.

He said Kashmir remains a symbol of failure of the UN system and Pakistan's principled position on territorial disputes remains a bedrock of its foreign policy.

"Kashmir remains a symbol of failures, rather than strengths of the UN system," Zardari said in his 20-minute speech at the 67th session of the UN General Assembly here.
"We feel that resolution of these issues can only be arrived in an environment of cooperation," he said.

"We will continue to support the right of the people of Jammu and Kashmir to peacefully choose their destiny in accordance with the UN Security Council's long-standing resolutions on this matter," the Pakistani president said.

Later, as Zardari exited the General Assembly hall, he was asked by to comment on his remarks that Kashmir is a "symbol of failure" of the UN system.

Zardari, however, did not clarify or elaborate further.

Pakistan's foreign minister Hina Rabbani Khar also did not elaborate on the president's remarks on Kashmir.

"It is in the speech, please read that. He said what he said. It is elaborated enough," she said.

Pakistan has raked up the issue of Kashmir at the UN forum time and again but India has insisted that it is its internal matter.

US President Barack Obama has also ruled out any "outside" solution to the Kashmir issue, saying in an interview in July that disputes between India and Pakistan can only be resolved among themselves.

Highlighting his country's foreign policy towards its neighbours in the sub-continent in his address, Zardari said Pakistan approaches its relations with India on mutual trust.

"Our principled position on territorial disputes remains a bedrock of our foreign policy," he added.

Noting that contacts between the leadership of India and Pakistan are "expanding", Zardari said he was "encouraged" by his discussions with Prime Minister Manmohan Singh last month in Tehran.

Here are some facts regarding the issue of holding a plebiscite in Kashmir according to UN Resolutions that Zardari and Co are bellyaching about:

RESOLUTION 47 (1948) ON THE INDIA-PAKISTAN QUESTION SUBMITTED JOINTLY BY THE REPRESENTATIVES FOR BELGIUM, CANADA, CHINA, COLUMBIA, THE UNITED KINGDOM AND UNITED STATES OF AMERICA AND ADOPTED BY THE SECURITY COUNCIL AT ITS 286TH MEETING HELD ON 21 APRIL, 1948. (DOCUMENT NO. S/726, DATED THE 21ST APRIL, 1948).

Noting with satisfaction that both India and Pakistan desire that the question of the accession of Jammu and Kashmir to India or Pakistan would be decided through the democratic method of a free and impartial plebiscite.

Recommends to the Governments of India and Pakistan the following measures as those which in the opinion of the Council and appropriate to bring about a cessation of the fighting and to create proper conditions for a free and impartial plebiscite to decide whether the State of Jammu and Kashmir is to accede to India or Pakistan.

I will touch upon the preamble which is the crux of the issue. However before I do that, I would like to mention that Resolution 47 was passed by the United Nations Security Council under chapter VI of UN Charter. Resolutions passed under Chapter VI of UN charter are considered non binding and have no mandatory enforceability, as opposed to the resolutions passed under Chapter VII.

A - RESTORATION OF PEACE AND ORDER

The Government of Pakistan should undertake:

To secure the withdrawal from the State of Jammu and Kashmir of tribesmen and Pakistani nationals not normally resident therein who have entered the State for the purposes of fighting, and to prevent any intrusion into the State of such elements and any furnishing of material aid to those fighting in the State.

The Government of India should:
When it is established to the satisfaction of the Commission set up in accordance with the Council's Resolution 39 (1948) that the tribesmen are withdrawing and that arrangements for the cessation of the fighting have become effective, put into operation in consultation with the Commission a plan for withdrawing their own forces from Jammu and Kashmir and reducing them progressively to the minimum strength required for the support of the civil power in the maintenance of law and order.

Firstly, Pakistan has yet to comply with their part of the resolution, ie, to withdraw tribesmen and Pakistani nationals not normally resident therein who have entered the State for the purposes of fighting. Failure to withdraw their troops resulted in the inability of India to put into effect their part of the undertaking. And this includes the whole state of Jammu and Kashmir including Gilgit and Baltistan.

Secondly, these Resolutions are under Chapter VI and therefore non enforceable. Why did Pakistan agree to this? Why did they not insist on including it under Chapter VII which is enforceable?

Thirdly, there is nothing in this Resolution that mentions the so called ‘third option’ which is independence to Kashmir that Pakistan is now pushing for in what they say is ‘In accordance with the wishes of the Kashmiri people’.

Fourthly, since the whole of J&K is disputed according to the resolutions, what about the area of Kashmir ceded to China by Pakistan? It legitimately belongs to the Kashmiris, right?

It's therefore not as simple as it looks. Considering the present situation, complying with UNSC Resolutions is a total non starter. Both countries need to look ahead and think of solving this dispute with out-of-the-box solutions. This requires statesmanship of a very high order. I don't see the likes of it in either India and Pakistan as of now.

Quite right.

One reason why I believe that a permanent and lasting peace between Pakistan and India is not possible until the deep state is substantially or wholly dismantled. I think it will be very good for Pakistan as well.

^you misread RP, i'm not saying PK has given up on kashmir. i'm simply opining that they have decided to take it up once the internal situation becomes a bit more settled.

and no political party will publicly say that they have shelved kashmir for a decade without the approval of the powers that be.
 
Sonia has billions, why don't see give him few millions for keeping his mouth shut and ask him to work more on terrorism directed against India and improve relations.

She will have something to brag about and He might have a chance to be re-elected,
