ISLAMABAD: President Asif Ali Zardari has appointed justice (retd.) Bhagwandas the chairman of Federal Public Service Commission on Wednesday, Geo news reported.

According to sources, new chairman FPSC held meeting with president Zardari here at presidency while spokesman to president camp house said, Zardari felicitated Bhagwandas on acceptance of new responsibilities.

He said the president appointed him chairman FPSC in accordance with powers under constitution of Pakistan.

Profile of Justice Bhagwandas:-
Honourable Mr. Justice (R) Rana Bhagwandas (Urdu: رانا بھگوان داس) (b. December 20, 1942), a highly respected name of the Pakistani judiciary was a senior judge and former acting chief justice of the Supreme Court of Pakistan. He remained the acting CJP during the 2007 judicial crisis in Pakistan and also briefly became the acting Chief Justice of Pakistan when the incumbent Iftikhar Muhammad Chaudhry went on foreign tours in 2005 and 2006, and thus became the first Hindu and the third non-Muslim to serve as chief of the highest court in Pakistan.

Very good news indeed. After late Chief Justice Mr. Justice Alvin Robert Cornelius, Mr. Justice (rtd) Bhagwan Das is the second minority Justice whose character is as flawless as it could possibly be for a human being. The one decision made by Mr. Zardari that has my full support and I wish all the best for Mr. Justice (rtd) Das as the Chairman of FPSC.

The Public Service Commission was set up for the first time in British India in
1926. After independence, the Commission was established in Pakistan in 1947
under the provision of Government of India Act, 1935. At present, the
commission is functioning under article 242of the constitution of Islamic Republic
of Pakistan. It has been provided autonomy under the Rules of Business, 1973
and FPSC Regulations, 1978 in its working. The Commission has also been
given administrative as well as, to some extent, financial autonomy to perform its
functions independently.
The Commission consists of a Chairman and Members. The Chairman is
appointed by the President of Islamic republic of Pakistan, in his discretion,
under Article 242 (IA) of the Constitution of Islamic Republic of Pakistan, 1973.
The members are appointed by the President on the advice of the Prime Minister
of Pakistan. The Commission is assisted by the Secretary who provides a link
among the Commission, its Secretariat and the Government Agencies.
The term of the office of members is as follow:
1) A Member of the Commission shall hold office for a fixed term from the date
on which he enters upon office and shall not be eligible for re-appointment.
2) A Member may resign his office by writing under his hand addressed to the
President.

I agree with Justice Bhagwandas at the helm i think the hiring process will be based more on merit than connections. This is a good sign that things in Pakistan are hopefully changing for the better.

I have heard and read that he is an honest man so what I am writing below is no disrepect to Justice Bhagwandas.

Why do we need a former judge to head the FPSC?

We, the Pakistanis, have become so desperate that every honest guy is our Masiah and we look to them to become our leaders.

Sometimes we hope that CJP becomes the President and sometimes we pray for AQ Khan to lead Pakistan.

Please understand one thing, there are honest and capable people within Pakistan's bureaucracy who have worked for many years in service of Pakistan. One of those bureaucrats should have been promoted to the top post.

Justice Bhagwandas may have a very good understanding of our structure but he is not more knowledgeable than a serving bureaucrats.

This seat is the right of a bureaucrat and this will only create disappointment within bureaucrats, imagine yourself serving in an organization for 35 years and then top post is awarded to an outsider.

Some people commented that now FPSC will select people on merit. Well that is wishful thinking because we still have the same level of corruption in our Judiciary so I don't see any change coming. Change will only happen when the GoP will start paying the right salary and perks to the members in Judiciary and Bureaucracy.

Zaradri is hoping that Justice Bhagwandas may help improving his relationship with the CJP and the Judiciary. Aitezaz Ahsan will also take an important post soon and then it will become much clearer.

If an Army Chief can take the post of the President while at the same time keeping his post of COAS for 8-9 long years and in the process forcing several well deserving officers to retire without being promoted to the top most post and you have no problem with it, what is the big deal if the honorable Justice (rtd) Bhagwan Das is appointed as the Chairman FPSC?

How many serving Army officers were appointed as the Chairmans of the dozens of Government and semi-Government Institutions by Musharraf? Did you ask the same question to him why he did that? Did you ever think about dozens of those who had worked for many years and were inspiring to lead their respective Institutions one day yet were denied from their rights?

If you had not asked these questions than, why are you asking them now? Because it is Mr. Zardari not Musharraf who has appointed and it is honorable Justice (rtd) Bhagwan Das not a serving Army officer?

Here are some interesting comments from Aitezaz Ahsan:

LAHORE: Former president of Supreme Court Bar Association, Barrister Aitzaz Ahsan has said it is by no means an objectionable act to hold an office of the government and if he qualifies for a specific post, it shouldn’t bother any of his critics.

To a query, Aitzaz said under Section 2 of Article 248 of the Constitution, no court was authorised to summon the president and the governor till they were holding their offices. He said his membership of the Central Executive Committee had been suspended, but as he was still affiliated with the party, he would comply with the party orders whenever he is called by the leadership.

He said Pervez Musharraf introduced the NRO on October 6, 2007 and it ended on February 4, 2008. Those who succeeded in getting their cases abolished under the NRO could not be challenged. However, those who got their criminal cases abolished after introduction of the NRO would have to go to the courts to get themselves bailed out.

Getting Aitezaz Ahsan (AA) on his side was step one and getting Justice Bhagwandas on his side will be step # 2. Rumours are flying around that AA will be the next AG. Now that will be a good move for the govt. and no one should be upset if AA does accept that post because that is completely legal. It will greatly hurt AA's reputation but it is still legal and ethical.

I still have the same POV that instead of Justice Bhagwandas someone from the bureaucracy should have go that job.
