Judicial Coup in Pakistan

It is indeed it is a Judicial coup by a corrupt judge; Don Ifthikhar Chaudary and family. This act of disqualification of the Prime Minister is just a political stunt or a gimmick to gear up on lost ground that is CJP's popularity graph among the populace. Suffice to say that this gimmick was to ramp up his dented image in the eyes of the people. Given all the architects behind FAKE 'independent judiciary' circus have now been exposed. Corrupt media, lawyers and judges. The jahil awam of Pakistan fell for it just as they did with for the circus.

What they do NOT see, these actions are specific to one party or people who exposed judicial corruption. Nawaz Sharif aka Ganja Bros and Co. get no questions asked policy along with PTI's Javed Hashmi in Mehran Gate scandal and others. Never in the history of any country has the Supreme Court been politically active only in Pakistan. This Supreme Court is biased and corrupt. The court is not blinded by law but is being run by Don Ifthikhar Chaudary and his ego to be the chief executive of the country.

I'm no fan of the PPP but this is the truth.

After reading this, I agree with some of what Katju says. According to Pakistan's constitution,no court can order Gilani to do or not do something. So the contempt verdict against Gilani was unconstitutional. He could have appealed against it to avoid conviction. But since he did not, now it is fair play to disqualify him. All because of the stupidity of not appealing.

After reading this, I agree with some of what Katju says. According to Pakistan's constitution,no court can order Gilani to do or not do something. you should ask yourself these questions:

Why did this not happen earlier while Gilani continued to serve as PM? why did this happen right after family gate or Dr. Arslan case? why are there no cases being heard against Ganja Bros or PTI's leaders? there's more but I think these should be enough for now.

I did mention Mehran Gate, Arslan case and CJP's personal involvement in promotions of his son, etc. What else?

EDIT: forgot to mention CJP family's assets have multiplied over the years. Soo many questions.

I still say it was not a judicial coup and disqualification was the right verdict. I am only saying that the contempt case conviction against Gilani was not constitutional and should have been challenged by the PPP.

these are also valid questions......if there are corruption charges that can be proved against ANY entity (i dont care WHO it is or what outfit or uniform they wear) -- the corrupt must be brought to book!

Indeed. I agree but when this act was done to bring the corrupt to justice jahil awam went the other way. The prime example of such a scenario is reference sent against CJP by Gen. Musharraf which we now know was valid and based on truth. Nevertheless, now at present I don't think justice would prevail as this corrupt lunatic is being supported by political parties such as PTI and PML-N. Again, only in Pakistan.

Removal of an elected prime minister by unelected and unaccountable judges is unprecedented in any parliamentary democracy anywhere.

So there are significant issues of precedent. The judgement cites, for instance, two Indian court cases. Both the Rajendra Singh Rana vs Swami Prasad Maurya case and the Jagjit Singh vs State of Haryana case deal with the disqualification of members of State Assemblies on charges of defection which cannot serve as precedent for removing a Prime Minister or even a Chief Minister.

So where have you seen the "elected judges"? and what exactly do mean by unaccountable?

Parliments make laws, Judiciary interprets and implements that law. To be honest it was the PM who acted as unaccountable by constantly ignoring Judiciary's instructions. Smaller thief protecting the bigger thief.

Even the President is so shameless, knowing that the PM went because of him, he is still there. He should resign, but these are opportunists taking advantage of whatever time they can stay in power and plunder the people mony.

The prime minister is not just another MNA. He's the leader of the House elected by overwhelming majority of MNAs.

The prime minister as the head of the executive branch is a co-equal of the Chief Justice.

And the legislature repeatedly gave Gilani their vote of confidence even as Judge Chaudhry pursued him relentlessly.

So it is a power struggle involving the judiciary versus executive and legislature.. two other co-equal branches of govt

This is nothing but a coup against the entire system of democratic governance in Pakistan.

And if this coup is hailed, then it opens up windows for other future coups most likely by the military.

Instead of giving resolutions they should have made a constitutional amendment that "Yousuf Raza Gilani may break the law", then Article 63 g may not have been violated.

SC did not take any action against his title of PM, they ruled that he was in violation of article 63 g of the constitution that the parliament has made. So he was removed him from member of Parliament by the ECP and since he was removed from Parliament he stopped being leader of parliament.

I think Contempt of court would entitle the court to Jail him or fine him. To disqualify a person as Prime Minister is strange. The only grounds on which they can do that is that he is not qualified to be an Member of Parliament (Pakistan equivalent) because of the election technicalities.

I think the Judiciary has overstepped its authority and infringed on the constitutional rights of the Members of Parliament to elect their leader.

ps: I am not an expert of Pakistani Constitution, but my disagreement is general based on how most Constitutions are like.

Sir the rule is very simple - as per Article 63 (1) (g)

(g) he has been convicted by a court of competent jurisdiction for propagating any opinion, or acting in any manner, prejudicial to the ideology of Pakistan, or the sovereignty, integrity or security of Pakistan, or morality, or the maintenance of public order, or the integrity or independence of the judiciary of Pakistan, or which defames or brings into ridicule the judiciary or the Armed Forces of Pakistan, unless a period of five years has elapsed since his release; or

So the courts followed the constitution of Pakistan and in such cases obviously part of the supporters of that particular party do not accept the court's judgements as is evident in this forum for example. The only way out for the Prime Minister was to amend the constitution of Pakistan and remove this article from the constitution or add other articles to protect himself from the punishment that he didn't...
