Moscow, July 5 (IANS/RIA Novosti) Iran has filed a $4 billion law suit against Russia's state arms corporation Rosoboronexport in an international court in Geneva over a missile deal that Russia suspended.

Rosoboronexport said the law suit was filed by the Iranian defence ministry and the Aerospace Industries Organization.

"The case was started April 13, 2011. The subject of the case is 'Possible damages of $3,985,159,773.32 to fulfil obligations for delivery of special property'," the Russian organisation said in reference to ongoing legal case.

The case has not yet been heard by the court.

In June 2010, the UN Security Council passed a resolution imposing sanctions on Iran, including suspension of arms deliveries.

Russia responded by saying it would cancel a contract to deliver S-300 missiles to Iran, and subsequently returned a $166.8 million deposit.

Iran previously applied to the International Court of Justice to try to force Russia to fulfil the terms of a 2007 contract to deliver S-300 air defence missile systems or pay compensation.

In view of sanctions it can't be paid...but it should be put into a fund that will be turned over to the Iranians once this blows over (with the acrued interest), contracts need to be legally binding or the whole economic system comes crashing down.

Why? Does the money legally fall under the sanctions? I doubt.

What is beyond me is how they've reached to the 4$ Bn figure. Isn't that too much for a deal worthy of 900$ mln if it had been implemented completely?

What damages? how can you claim damages for non delivery of an anti air system when
A:no one has attacked you so even if you had the system it would just be siting around gathering dust

B: Press TV regularly points out that the Iranian version tracks 100 more targets and is so powerfull it shoots down zionist aircraft before they take off.

Yea, I'm wondering the same. Maybe reputation damage? Or maybe there was an article or something in their deal so if one of the sides of the contract canceled the deal one-sidedly they had to pay compensation? I don't know. It's still a lot of money for that deal I think.
Meanwhile, I'm sure that 32 cents is very important, we should sue Russia for it if they don't pay the 32 cents. Or maybe that's VAT? LOOL.

P.S: PressTV hasn't pointed out that the Iranian version tracks more targets as far as I'm aware.

Probably to spite the Russians for holding their money. As well as the need for money too.

That basically means Russia is an unreliable supplier. I guess the West leaned on Russia to have the contract breached.

The Russians had paid the prepaid money back. So it comes as a surprise why Iran is still pushing the law suit forward. Well, 4$ Billion could be a good money for R&D for Iran to build her own Bavar-373, but again Iran isn't in need of that money really and it should be weighed to see whether our military ties with Russia are more important or this 4$ bn money that won't be easily given to Iran.

An Iranian general says the Islamic Republic has built an ingenious air defense system which surpasses the Russian S-300. Moscow intended to provide S-300s to Teheran, but canceled the sale due to UN sanctions against Iran.

"The flaws and defects of the S-300 system have been corrected in the indigenous version of the system and its conceptual designing has been finished,” Fars news agency quoted Brigadier General Farzad Esmaili as saying on Tuesday.
