New Delhi: The Centre on Wednesday told the Supreme Court that there was an "enormous amount of control" over the working of the intelligence agencies, including their finances, by the government as it opposed a plea by an NGO for some oversight over their functioning.


"There is an enormous amount of control over the working of the intelligence agencies. A parliamentary sub-committee (looks) into their working and tables report in parliament which are not published," Additional Solicitor General P.S. Narasimha told the bench headed by Justice Dipak Misra.

ASG Narasimha said the accounts of the intelligence agencies were audited.

He refused to part with the documents sought by petitioner NGO CPIL, saying they were privileged documents.

He, however, said the same could be shown to the judges for their examination.

The government response came as counsel Prashant Bhushan, appearing for the NGO, told the court that they just wanted to have some "oversight" and "accountability" of the intelligence organisations like legislative control and auditing of their accounts by the CAG.

The intelligence agencies that the NGO was seeking to be brought under legislative scrutiny and the auditing of their accounts by CAG includes the Intelligence Bureau, Research and Analysis Wing (RAW) and the National Technical Research Organisation (NTRO).

The NGO contended that these intelligence agencies were snooping on the privacy of the citizens and were operating without any legislative mandate.

It said it was not seeking any disclosure of secrets but merely asking that there should be some guidelines to regulate the operations of intelligence agencies.

"The primary task of intelligence agencies is to collect intelligence of threats to the nation's security, from external as well as internal sources," the CPIL said.

"However, these agencies (IB, RAW and NTRO) have often been used for carrying out illegal acts by politicians and bureaucrats."

The misuse of these agencies, the PIL said, includes "offering bribes to members of political parties to induce them change their loyalty, rigging and purchasing votes during elections, toppling elected governments, monitoring the activities and telephones of political opponents, and so on".

To buttress its point, the PIL cited books written by those who had served these agencies, including "The Kaoboys of R&AW" by B. Raman, "Inside IB and RAW" by K. Sankaran Nair, "Open Secrets - India's Intelligence Unveiled" by Maloy Krishna Dhar.

Less than a week after Pakistan, Bangladesh and Myanmar nationals were arrested for fraudulently obtaining Indian Passports, another major racket dealing with fake identity documents was busted by the Cyberabad Police.

The Special Operations Team (SOT) of Cyberabad Police found that about 400 PAN and Voter ID cards were obtained illegally by bribing the government officials and also by taking advantages of loopholes in the system.

Using these documents, the accused M. Jagan Mohan Reddy acquired 167 credit cards from various banks and gained money to the tune of Rs. 63 lakh — all this in the last couple of months. The police also arrested 13 of his accomplices who helped the accused get ID and credit cards on fictitious names.

On Tuesday, Cyberabad Commissioner C.V. Anand explained the modus operandi of the accused. The accused, Jagan Mohan Reddy, studied up to class 10. He initially worked as security guard and then as a field verification officer for banking institutions. Having gathered knowledge about processing and issuing of credit cards, he hatched a plan to make a fast buck.

As per the plan, he started collecting a number of PAN, Voter ID cards and IT returns on random names and addresses since these documents were basic requisites for obtaining credit cards.

For PAN cards, the accused allegedly bribed the official and lawyer in the sub-ordinate courts to get address proof certificates and an affidavit which was submitted along with application to UTI. The accused then influenced the delivery boys of Blue Dart to hand over all the PAN cards to him directly.

To procure Voter ID cards, the accused used agents and also GHMC outsourcing employees by paying them bribes.

Finally, all these documents were used to apply credit cards from HDFC, SBI, American Express and IndusInd banks, which he received by bribing sales executives and field verification officers. The accused also converted his house into a mini-telephone exchange by installing 37 landline connections and using 155 SIM cards for aiding phone verifications. Calling this incident as a “threat to national security”, Cyberabad Commissioner Mr. Anand said that there is every chance that terrorists might take advantage of the system and indulge in something similar.

Focus on refugees

Alarmed by the spurt in cases related to fake identification documents in the recent past, Mr. Anand informed that they will focus on refugees and illegal immigrants to check if they were trying to procure documents using illegal methods. Cyberabad Police officials along with NGOs concerned will start verifying the status of 1,700-odd Rohingya Muslims from Myanmar, staying under Cyberabad police limits.

Submission of Annual Returns by NGOS

About 6,000 NGOs have been served show cause notices for not submitting annual returns for various Financial Years for the period 2010-11 to 2015-16. The details of these NGOs is available on website www.fcraonline.nic.in of Ministry of Home Affairs.

As per FCRA, 2010 and rules made thereunder, every person who receives foreign contribution under FCRA, 2010, shall submit a signed or digitally signed report electronically online with scanned copies of income and expenditure statement, receipt and payment account and balance sheet for every financial year within nine months of the closure of the financial year.

The details of receipts and utilization of foreign funds are being furnished by NGOs in their Annual Returns. The same are monitored in accordance with the provisions of FCRA 2010, and rules made thereunder.

This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in a written reply to question by Shrimati Hema Malini and Dr. Bhola Singh in the Lok Sabha today.

Cancellation of Licence of NGOs

In the year 2017, since 4842 NGOs did not submit annual returns in compliance with FCRA, 2010 and Rules made there under, their registrations were cancelled. The details of cancellation of registration certificate are available on the FCRA web Portal www.fcraonline.nic.in of the Ministry of Home Affairs.

As per available information, in the year 2015, registration of more than 8500 NGOs were cancelled for not adhering to the provisions of FCRA 2010 and Rules made thereunder.

This was stated by the Minister of State for Home Affairs, Shri Kiren Rijiju in written reply to a question by Shri Sanjay Seth in the Rajya Sabha today.
