According to Indian independence act of 1947, there was official boundary between India & Pakistan (which made Kashmir independent from both), now the independent kingdoms had to select between joining India or Pakistan or to remain independent (there was no issue of religion here), maharaja of Kashmir decided to join India in 1948 finally.
